The Cost Of Doing Business: Corporate Vicarious Criminal Liability For The Negligent Discharge Of Oil Under The Clean Water Act, Katherine A. Swanson

In response to massive oil spills that damaged America’s waters, devastated local economies, killed wildlife, and cost taxpayers millions in clean-up costs, Congress passed the Oil Pollution Act of 1990. The Act amended the Federal Water Pollution Control Act to allow for criminal prosecution of negligent oil discharges. This Comment argues that although the plain language of the Federal Water Pollution Control Act’s negligent discharge provision is silent regarding corporate vicarious criminal liability, courts should give full effect to Congress’s intent—to protect the health and safety of the public and the environment and to stop corporations from accepting oils spills …

Despite the large contribution of individuals and households to climate change, little has been done in the US to reduce the CO2 emissions attributable to this sector. Motor vehicle idling among individual private citizens is one behavior that may be amenable to large-scale policy interventions. Currently, little data are available to quantify the potential reductions in emissions that could be realized by successful policy interventions. In addition, little is known about the motivations and beliefs that underlie idling. In the fall of 2007, 1300 drivers in the US were surveyed to assess typical idling practices, beliefs and motivations. Results indicate …

U.S. wind power capacity increased fifty percent in 2008, making wind one of the fastest growing energy sources. Wind has several advantages over conventional energy fuels: it is renewable, does not emit pollutants, and does not require scarce water resources to process the raw product or to generate electricity. Yet wind power’s rapid growth is creating its own crisis. Thousands of landowners across the country have severed their “wind rights,” splitting wind ownership apart from surface ownership. This Article takes a national view of the modernization of water law. Using Florida as an example, it identifies some of the most important and controversial challenges faced by states. Part II provides an overview of the process of water law reform. As states attempt to improve water management, they have modified their common law water allocation systems with an overlay of statutory law. Often, the process occurs in a piecemeal fashion, resulting in a patchwork of rules—common law and statutory, old and new. The surge of interest among international lawyers in "constitutionalism" represents one of several efforts to reconceptualize internationa governance; others include the research projects on global administrative law and legalization. The article applies the constitutionalist lens to international environmental law-one of the few fields of international law to which constitutionalist modes of analysis have not yet been applied. Given the protean quality oft he terms "constitution"and "constitutionalism,"t he article begins by unpacking these concepts. Empirical evidence suggests that diversion of instream flows for human use, coupled with the potential impacts of changing climatic conditions, is threatening the sustainability of aquatic life. Nonetheless, several states merely prevent stream flows from being reduced below the "7Q10 flow," or the average flow during the driest consecutive seven-day period that has a likelihood of recurring only once every ten years. Overwhelming scientific consensus suggests that 7Q10 merely preserves water quality standards by calculating the concentration of pollutants in point source discharges, without considering water quantity and numerous other core principles of instream management.

Local governments are beginning to require new, privately constructed and funded buildings to be “green” buildings. Instead of creating their own, locally-derived definitions of green buildings, many municipalities are adopting an existing private standard created by members of the building industry: LEED (Leadership in Energy and Environmental Design). This Article explains and assesses the privately promulgated LEED standards. It argues that the translation of LEED standards, which were intended to be voluntary, into law raises several theoretical and practical problems.
