Supreme Guidance For Wet Growth: Lessons From The High Court On The Powers And Responsibilities Of Local Governments, Michael Allan Wolf

Before the merger of water law and land use planning can occur, local and state regulators need strong guidance from experts in the field, not only in extra-legal fields such as planning, hydrology, geology, engineering, biology, and transportation, but also in mainstream legal areas including legislation (local, state, and federal), administrative law, and enforcement. The purpose of this article is to identify a somewhat unorthodox source of guidance - the United States Supreme Court, specifically the Rehnquist Court from October, 1984, through June, 2005, a period of remarkable stability for the nation’s highest tribunal.

Latin America has been caught for centuries in a vicious cycle of land consolidation and land reform; the issue perennially resurfaces since concentration of land and associated resources results in conflict. Latin American nations are among the world's leaders when it comes to the inequality of land distribution.
Land reform, or agrarian reform, as it is more commonly referred to in Latin America, is hardly a new phenomenon. As we will show, the need to develop a policy to redress the consolidation of lands by a powerful few and redistribute it in the name of equity and development has its …

Regional Ocean Governance: The Perils Of Multiple-Use Management And The Promise Of Agency Diversity, Josh Eagle

Two high-level committees - the U.S. Commission on Ocean Policy and the Pew Oceans Commission - have recently issued reports expressing grave concerns about the condition of America's oceans. In these reports, the commissions suggest that institutional flaws underlie current problems. Specifically, the commissions' views are that state and federal agencies with marine jurisdiction lack the mechanisms, and the incentives, to coordinate their management activities. Accordingly, both commissions recommend the creation of regional ocean governance bodies. Although the commissions' designs differ, their goal is the same: management that operates on a larger scale and incorporates more ocean interests. This article …
