After the Supreme Court decided Lopez, a number of commentators speculated about its impact on the Endangered Species Act. This Article reexamines the issue in light of Morrison and SWANCC. Part V demonstrates that, even after Lopez, Morrison, and SWANCC, the Commerce Clause reaches federal regulation of intrastate endangered or threatened species because conservation of such species has traditionally been a shared federal and state function that recognizes the legitimacy of federal regulation whenever the need for preservation is great and states have failed to address important conservation issues. Legal Obstacles To Private Ordering In Marine Fisheries, Jonathan H. Adler
Faculty Publications
Part II of this Article surveys the challenges of marine conservation, the failures of existing regulatory regimes, and the potential for property rights in marine resources. Part III discusses the nature of private ordering, providing examples that arise from the fisheries context. Part IV discusses how legal rules can inhibit private ordering. That section focuses in particular on how antitrust law has impeded cooperative fishery management. Part V then explores possibilities for overcoming antitrust obstacles to private ordering. This Article concludes with some broader thoughts about the implications of this research for resource conservation.

Water And Population In The American West, Denise D. Fort

The American West is justly famed for its sunshine and wide skies.1 However, there is a potent combination of low rainfall and growing population in the West that ensures that water, or the lack of it, will remain another well-known feature of the region. As the number of people sharing already stressed water supplies increases, the economic, ecological, and social costs of providing water become more evident. Agriculture consumes about 90% of the water that is extracted in the West, and the transfer from agricultural to municipal and industrial uses is invariably complex. Sturm College of Law: Faculty Scholarship
This article argues that in some instances the EU is committed to sustainable development and is actively engaged in substantive actions to achieve it, while in other instances, notwithstanding an outward com- mitment to sustainable development, the commitment is more symbolic than substantive. The article concludes that the effort to integrate sus- tainable development into the CTP is beginning to achieve results and that, in any case, the EU has established a world leadership position with respect to sustainable development, a position that it would be ill-advised to abandon.

Elimination Of The Depletion Deduction For Fossil Fuels, Wendy B. Davis

This article argues that the depletion deduction provision is a misguided incentive that has been falsely analogized and justified, and it should be abolished in order to provide funds to protect and preserve the environment. The additional revenue generated should be used to encourage the development of renewable resources and to remediate the harm caused by the extraction and use of fossil fuels. Specifically, the depletion deduction for reduction in the supply of nonrenewable resources such as coal and oil should be eliminated to (1) ensure certain and equal treatment under the tax laws; (2) encourage development of renewable energy …

Sustainable Development Law & Policy
The purpose of this paper is to introduce the precautionary principle in terms of its history, use, and application in several different international agreements. The precautionary principle is preventative in nature and stems from the idea that just because an activity cannot be proven unsafe does not mean that it does not have any negative effects. It has been heralded and criticized by scientists alike, and it has been applied in so many different ways that its definition depends on which international agreement one is reading.
