Finding The Pearl In The Oyster: Strategies For A More Effective Implementation Of Virginia's Chesapeake Bay Preservation Act, Patrick J. Skelley Ii

Since our nation's infancy, the Chesapeake Bay ("Bay") has been one of Virginia's natural treasures. The Bay is America's largest and historically most productive estuary, valued today as an economic resource, a wilderness sanctuary, and an aesthetic asset. Every year, commercial fishermen harvest blue crabs, oysters, and a multitude of fish species in mass quantities to satiate our desire for seafood. Nature aficionados can observe ospreys, laughing gulls, and other shorebirds taking their share of the Bay's bounty. From the -shoreline, quiet vacation homes overlook the waters across coves and inlets. Despite these idyllic images, the Bay has been facing …

Refracting The Spectrum Of Clean Water Act Standing In Light Of Lujan V. Defenders Of Wildlife, Karl S. Coplan

First, this article will review the impetus and purposes for the Clean Water Act of 1972, including its citizen suit provision, particularly as these purposes relate to the elimination of specific harm or causation requirements in enforcement actions under its provisions. Second, this article will briefly review the basic elements of Article III standing requirements as enunciated by the Supreme Court, and the development of Supreme Court standing doctrine in environmental cases leading up to and including the Defenders of Wildlife decision. The Role Of Riparian Water Law In Protecting Biodiversity: An Indiana (Usa) Case Study, Robert L. Fischman

This article discusses how the rules affecting the use of surface water ground water in a typical riparian state, Indiana, can promote the conservation biological diversity. The article first surveys the basic water laws that apply to surface water, diffused surface water, underground streams, and ground water. The rules governing the uses of these waters originate in common law property doctrines and substantially clarified by state legislation. Next the article considers state administration of water. The article examines regulatory tools and administrative opportunities control uses of water in a manner that protects biodiversity. Programs requiring permits for construction in floodplains, …
