Making A Wrong Thing Right: Ending The "Spread" Of Reclamation Project Water, Reed D. Benson, Kimberley J. Priestley

In the Pacific Northwest, especially east of the Cascade Range, water is a limited and precious resource. Diversions of water for out-of-stream uses regularly dry up certain reaches of many rivers and streams. Such diversions provide water for municipalities, industrial users, and farmers who irrigate millions of acres in Idaho, Oregon, and Washington. Diversions also harm fish and wildlife (including threatened and endangered salmon stocks), impair recreational uses of affected waterways, and degrade water quality.

Taking Uncertainty Seriously: From Permissive Regulation To Preventative Design In Environmental Decision Making, R. Michael M'Gonigle, T. Lynne Jamieson, Murdoch K. Mcallister, Randall M. Peterman

This paper contrasts two paradigms of environmental regulatory decision making, "permissive regulation" and "preventative design," with respect to their treatment of scientific and legal uncertainty and the allocation of legal standards and burdens of proof. "Permissive regulation," which is the predominant approach in Canada, suffers two types of statistical errors. A type I error occurs when, for example, a pollution control device is unjustly imposed on an industry. A type II error occurs when no action is taken to control an industry when, in fact, damage is taking place. Concern to prevent type I errors often leads to type II …

This article addresses selected developments in environmental law occurring between the publication of the 1992 Annual Survey of Virginia Law1 and June 24, 1994. Due to significant federal litigation since publication of the 1992 Survey, this article places primary emphasis on those developments which most significantly affect potential liabilities under state and federal environmental laws. Pollution taxes are a sound environmental instrument. The principal means of controlling pollution in the United States is by command and control regulation, setting standards or limits on emissions and requiring particular pollution control technologies. Command and control regulation of pollution, while necessary to assure pollution reductions, has its limits. While much more certain of reducing pollution than pollution taxes would be, controls tend to be set only at levels that are politically acceptable. Seldom are the full social costs of pollution eliminated in pollution control standards, except where particularly noxious products are banned outright, such as the prohibitions against …
