This Essay examines U.S. Supreme Court Justice Sonia Sotomayor’s important role in shaping U.S. sports law. As a judge on the U.S. District Court for the Southern District of New York and later on the U.S. Court of Appeals for the Second Circuit, Sotomayor authored opinions that resolved two major sports law disputes: whether Major League Baseball (“MLB”) owners could unilaterally impose new labor conditions on MLB players during the 1994 baseball strike and whether Ohio State University sophomore Maurice Clarett was obligated to wait three years from the completion of high school to become eligible for the National Football …

One Strike And You're Out: Alcohol In The Major League Baseball Clubhouse, Steven B. Berneman

In the past decade, much has been written about Major League Baseball's (MLB) mistaken policies regarding performance-enhancing substance abuse by players. MLB executives are shortsighted, however, if they believe that steroids are the only substances being abused by players. Along with performance-enhancing drugs, professional baseball has a long-standing history of alcohol abuse. Steroids may provide better headlines--Congress has never held an investigation into alcohol abuse by professional athletes--but professional baseball faces a real danger from the unchecked liability of allowing players to overindulge at the ballpark and drive home shortly thereafter. Keeping Them Down On The Farm: The Possibility Of A Class Action By Former Minor League Baseball Players Against Major League Baseball For Allowing Steroid Abuse, Patrick S. Baldwin

Over the past five years, allegations and admissions of steroid abuse by professional baseball players have tarnished the image of "Our National Pastime." Although the players are ultimately responsible for using performance-enhancing drugs, they are not solely to blame. Major League Baseball and its franchise owners knew about the abuse and did nothing to stop it-mostly because the threat to home run records had begun refilling the seats that had been lost from the 1994-1995 labor strike.
