The Preference Clause Revisited: Central Lincoln Peoples' Utility District V. Johnson And The Pacific Northwest Electric Power Planning And Conservation Act, Joseph P. Mentor Jr., David C. Jory

This article analyzes the legislative development of the preference clause to its inclusion in the Pacific Northwest Electric Power Planning and Conservation Act (Northwest Power Act). This analysis demonstrates the Northwest Power Act's reaffirmation of the supply preference traditionally included in federal power marketing legislation. The analysis also reveals a unique price discount for customers entitled to a supply preference under the Northwest Power Act. Additionally, the article considers recent Ninth Circuit decisions applying the preference clause to various forms of power allocation by federal agencies. This Comment is limited in scope and purpose. It surveys the laws of the four Northwest states and identifies the problems and programs that are unique to each. By assembling the different ways that each state has addressed conservation and renewable resource development, this Comment hopes to aid policy makers in each of the states to copy the successes, and avoid the failures, of the others.

High Ross Dam: The International Joint Commission Takes A Hard Look At The Environmental Consequences Of Hydroelectric Power Generation—The 1982 Supplementary Order, Mary Patrice Mccausland

This Note discusses a 1982 decision by the International Joint Commission (IJC) that effectively prohibits Seattle from raising the dam. It surveys the forty-year history leading to the decision, especially noting the role of the IJC. The Note compares the 1982 decision and the procedures used by the IJC in reaching its decision, particularly its examination of environmental concerns, with the application and operation of the "hard look" doctrine as it is used in environmental cases in the American judicial system. It suggests that applying the priniciples of the "hard look" doctrine is both appropriate and consistent with the IJC's …

The Arab oil embargo of 1973 and the severe energy shortage it caused in the United States prompted federal authorities to formulate a national energy policy that would encourage exploitation of domestic energy resources. As the federal government has implemented this energy policy, states rich in natural resources have begun to tax the energy mining and production operations within their borders.
In this Article Professor Shurtz discusses the constitutional limits of this taxation and examines how the revenues from these taxes alter the balance of wealth between energy-producing and energy-consuming states. Professor Shurtz concludes that revisions in revenue sharing formulae, …

Few countries in the industrialized West are more energy directed than Norway. Whereas most nations have paid particular attention to the relationship between their economic growth and the consumption of energy, Norway has to a high degree based her industrialization and economic growth on the exploitation of indigenous energy resources. Therefore, establishing principles of developing and using energy resources has been an important political topic in Norway since industrialization gathered headway near the turn of the century.

In 1977, Congress enacted the Surface Mining Control and Reclamation Act. The Act, designed to protect the environment and society from the adverse effects of surface coal mining and to insure uniform minimum nationwide regulatory standards, established a comprehensive regulatory scheme for surface mining and reclamation operations of both federal and non-federal lands within the United States.
The Secretary of the Interior, acting through the Office of Surface Mining and Reclamation within the Department of the Interior, is charged with administering and implementing the Act. Implementation is divided into two stages. During the initial, or interim phase, all surface mining …

Since its unveiling on October 28, 1980, Canada's National Energy Program has been commented upon abundantly in government circles, newspaper articles, trade magazines, and financial industry seminars, drawing both oil industry and foreign reactions. It has received less notice in scholarly publications, however, perhaps because it is a complex and continuously changing program that did not become effective until legislation was enacted. The purpose of this Article is to sketch a broad picture of the National Energy Program (NEP) while focusing on its Canadianization aspects, the new oil and gas taxation situation, and the Program's various transnational law implications. Coal, a primary energy source, is presently fueling the fires of debate in Virginia. The controversy has arisen over a plan developed by private investors to construct a coal slurry pipeline. The pipeline, as proposed, would transport between five and twenty-five million tons of coal annually from southwest Virginia to the Tidewater area. The coal would be pulverized and combined in a fifty percent mixture with water. Once the coal reaches its destination, the water would be extracted by centrifuge, leaving the coal ready for use.

The use of wind to produce energy has ancient roots. Prior to World War II over six million small windmills had been in operation in the United States. Then, during the post-war industrial boom, wind generation of energy was largely abandoned in favor of cheaper, more convenient fossil fuels. In recent years, the rapidly escalating price of imported oil and consequent search for alternative domestic energy sources has generated renewed interest in the utilization of wind energy.
