The Need For Liability Constraints In Successful High-Technology Development: A Comparison Of The French And U.S. Commercial Nuclear Programs, Thomas J. Daemen

Northwestern Journal of International Law & Business

The history of America's nuclear program is replete with examples of shining brilliance and dismal failure. After examining America's successes and failures, this Comment reviews the highly structured French development history. The internationalization of nuclear safety is then addressed, as international efforts continue to play a critical role in future nuclear production. Finally, a variety of key recommendations for current and future activity are analyzed.

Dalhousie Law Journal

Small power producers' are in the vanguard of the movement towards the increased use of "alternative" modes of generating electricity. Wind, water, solar, biomass, and cogeneration (which creates useful heat and electricity in one process) power sources promise increased efficiency, reduced environmental impacts and increased energy self-sufficiency. This paper undertakes to examine the interactions between small power producers and the established utility sector in North America. In particular, it examines the economic and institutional barriers faced by small producers attempting to gain access to utility-controlled electricity markets.

In addition to challenging readers to help make the principle of self-determination a reality for indigenous peoples, this Article challenges indigenous leaders, especially those in the United States, to help formulate our collective vision of a sustainable future and to provide leadership in making that vision a reality. The United Nations has designated 1993 the International Year for the World's Indigenous Peoples, and this event will provide tribal leaders with opportunities to have their voices heard. Tribal leaders in the United States should take full advantage of these opportunities and step to the forefront of the movement to hasten the …

The effects of consuming fossil fuels have disproportionately elevated human importance by the collective impact made on the world environment. Even the most buoyant optimist can be depressed by adding the global climactic changes of the greenhouse effect to a list that already includes air pollution, water pollution, soil contamination, health effects, balance of trade deficits, declining technological competitiveness, and vanishing natural resources. In Texas the primary source of electricity, and a major source of environmental problems, is the combustion of fossil fuels. Energy policy has been at the center of American political rhetoric since the early 1970s. Twenty years, five presidents and ten Congresses later, however, the United States still has no coherent energy policy. It is time to measure progress under section 316 of the Clear Water Act, the one section of the Act that focuses not on discharges, but on intakes. Part II of this Article discusses the environmental hazards in more detail and explains how cooling water intakes produce them. Part III of this Article examines the history of regulation and nonregulation under section 316(b) of the Clean Water Act, describes the development of the "common law" concerning the regulation of cooling water intakes, and explores the effect of EPA's regulatory actions and omissions on state regulatory efforts.
