This conference is a sequel to the 2009 World Energy Justice Conference (WEJC 2009) which began examining ways of mainstreaming safe, clean, and efficient energy for the world's Energy Poor (EP). The EP number two and a half billion people living on less than $1-2 a day who have no access to modern energy services. WEJC 2010 more fully develops these themes. WEJC 2010 will explore how the next round of global warming meetings in Cancun could design new flexibility mechanisms that give credits, for example, for the reduction of black carbon by the adoption of cookstoves, and embrace small …

Renewable Portfolio Standards (“RPS”) are stated to have a plethora of benefits: job creation, renewable energy growth, reduced carbon emissions, and a reduction in retail electricity prices. Often when a policy has multiple agendas, the policy fails to meet any of the objectives. Twenty-nine states have implemented an RPS, but state policies vary with regard to the sources considered eligible, out-of-state generation, credit trading, and the process of ensuring compliance. The various policy facets affect the growth of renewable energy within the state and affect the additional stated benefits of job creation and reduced emissions. This paper examines Illinois’s RPS …

Thirty states now have renewable portfolios standards that require generators of electricity to increase their use of renewable energy. Originally intended to promote “energy independence” and other environmental goals, today the programs are among the few U.S. programs which respond to the threat of global warming. This article considers how they work and whether they are effective. It concludes that, in the absence of comprehensive international or federal greenhouse gas controls, renewable portfolio standards are an effective and productive means to retard global warming.

Bruce Finley's article lauded trees for absorbing smog. Trees also mitigate CO2 emissions. But not all trees are equally beneficial: some species emit more volatile organic compounds than they absorb. In urban environments, we need more restrictions to avoid negative impacts on those around us: e.g., wood burning or watering restrictions. Sunlight plays an increasing role in energy solutions - for solar energy and urban gardens. Trees that mature at over 70 feet can create shade pollution for neighbors up to three lots away. The attempt by many U.S. states to copy verbatim the European model of feed-in tariffs to promote renewable power and recent efforts of states to promote their renewable power development or greenhouse gas (“GHG”) emission restrictions have been successfully challenged legally in the past few months. These challenges have reinforced that these E.U. and Kyoto mechanisms employed by the states in the U.S. as a governance tool, run afoul of the U.S. Constitution. Renewable and climate change policy in the U.S. is undertaken by regulatory actions at the state, rather than federal, level. This is a significant issue going forward …

The Limits Of A National Renewable Portfolio Standard, Jim Rossi

Vanderbilt Law School Faculty Publications

In this Commentary Article, Professor Rossi highlights some of the distributional and operational problems presented by a national renewable portfolio standard ("RPS") in electric power. He also offers several solutions to these problems as a way of advancing a cautionary defense of a national RPS. Ultimately, Professor Rossi concludes that addressing climate change will need to involve more systemic and larger scale modifications to regulation of the electric power industry, including addressing infrastructure issues such as transmission and carbon pricing.
