When one "follows the money," the current Administration‘s economic stimulus funding injected unprecedented billions of dollars into new energy-related capital investments. In doing so, it endeavors to fundamentally re-sculpt the legal fabric and infrastructure of the U.S. economy in a once-in-a-generation change of watershed proportion. However, this re-sculpting is hitting fundamental constitutional barriers under Articles I and VI.

There is a jurisdictional barrier: Renewable energy investments, promoted primarily at the state level, confront real challenges pursuant to the Constitution‘s Supremacy Clause (Article VI) and Commerce Clause (Article I). Financing renewable energy projects in the United States can be a complex, time consuming, and expensive process. Currently, most equity investment in new renewable power production facilities is supported by tax credits and accelerated depreciation benefits, and is constrained by the pool of potential investors that can fully use these tax benefits and are willing to engage in complex financial structures. For debt financing, non-government lending to renewables has largely been provided by foreign banks that may be under future lending constraints due to economic and regulatory conditions.

The future of the planet may depend upon our ability to increase energy supplies even as we reduce carbon emissions. This conference will address how a low-carbon energy program might evolve with a particular focus on the American West. It will focus on the future of energy in the West--on a “managed transition” to a different energy mix, on the need to nest this effort in a framework that acknowledges interconnections, and on identifying the most salient opportunities to consider the legal, political, financial, and technical challenges.

This Student Note assesses Congress and the Nuclear Regulatory Commission’s “new” nuclear licensing scheme by way of comparison with the old, two-step process under which the industry endured an era of dormancy lasting nearly forty years. With a focus on the novel ITAAC review process, this Note argues that while the Part 52 process is superior to its predecessor, certain significant issues (articulated herein) must be resolved before the new regulatory framework can support the economic, environmental, safety, and other advantages it aims to achieve.

A major part of China’s 12th Five Year Plan focuses on energy conservation and environmental protection. Its 12th Year Environmental Plan provides that China will increase its nuclear capacity by 30% from 2010 levels of 10.8 gigawatts to 43 gigawatts in 2014. Two questions arise from this plan. First, will enough energy be produced from other sources to supply the country’s energy needs or will there be the need for an expansion to its nuclear program? Nuclear power remains controversial on many levels. On the up side, the lifecycle emissions for nuclear power are second lowest only to wind in comparison to all other primary sources of electricity generation. Nuclear power compares favorably against coal-generated electricity on additional fronts including fewer transportation impacts and before Fukushima, historically lower radiation releases than coal. Its land footprint per kilowatt hour is the smallest for any generation source, including renewables. Last, but not least, the United States has significant domestic reserves of uranium to fuel the plants. On the down side, the civilian nuclear power industry is not competitive …

For thousands of years, the classical theory, which was considered the best science of the time and was observed my most cultures and religions of the world, held that there were four basic elements from which everything in life was constructed: Earth, Water, Air and Fire. This classical theory anchored Hinduism, Buddhism, Chinese and Japanese religions, as well as Greek philosophy. From these classical elements, all matter was derived. Emerging environmental problems and technologies, coupled with the existence of mature regulatory regimes governing most industrial sources of pollution, reveal with new clarity the harms that individual behaviors can inflict on the environment. Changing how individuals impact the environment through their daily behaviors, however, requires a reorientation of environmental law and policy and a balancing of government prerogatives with individual liberty. A growing body of legal scholarship recognizes the environmental significance of individual behaviors, critiques the failure of law and policy to capture harms traceable to individuals, and suggests and evaluates strategies for capturing individual harms going forward. Recent negotiations between Malaysia and the European Union (“EU”), aimed at establishing a free trade agreement, have come to a standstill, due in part to a policy implemented by the EU known as the Renewable Energy Directive. The Renewable Energy Directive grants a tax credit to renewable fuel sources that emit at least 35% less greenhouse gas than traditional fossil fuels. Malaysian officials have criticized the 35% level included in the EU policy because it grants a tax credit to rapeseed oil biofuel, produced mainly in Europe (which emits 38% less greenhouse gas than traditional fossil fuels), but does not …

This article begins by defining the “vehicle-to-grid” concept for a legal readership, and places it in context by discussing some major problems facing the United States electrical grid. There are several ways in which the vehicle-to-grid concept may potentially mitigate the grid’s problems as are described. Then, the article discusses the major legal and regulatory impediments to implementing a vehicle-to-grid program. Several of the hurdles are simply manifestations of uncertainties in the business environment. Others are more properly legal and regulatory impediments, but are expected to be surmountable.
