Salmon remain the cultural and economic soul of the Pacific Northwest, a species whose very life cycle largely defines the region. At the center of the salmon region lies the Columbia River, which once supported the world's largest salmon runs and which now is home to the world's largest interconnected hydroelectric system. These massive federal and non-federal dams have devasted Columbia Basin salmon runs, some of which are now exinct, others are on life-support.

Lessons From The Procedural Politics Of The "Comprehensive" National Energy Policy Act Of 1992, Jim A. Rossi

This Article examines the political and procedural history of the EP Act in order to arrive at some general lessons and recommendations regarding congressional formation of energy policy. At least two commentators on the EP Act praise it as the "second generation" of federal energy policy, based in laws that achieve "their mandates more by consensus than coercion." The EP Act's history, however, was far from smooth. Procedural obstacles, such as filibuster, inter-committee conflict, and inter-chamber conflict, led many to declare the EP Act dead on several occasions prior to its passage.

Although other areas of natural resources law have been hit by hard times, the environ- mental area is burgeoning. The intricacies of the Comprehensive Environmental Response, Com- pensation and Liability Act (CERCLA or Super- fund), as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA), ensure attorney participation. Further- more, much of the fuel that drives CERCIA lit- igation is the presumption by many clients that their attorney fees are costs that can be re- covered as response costs under section 107 of CERCLA. 42 U.S.C. On August 16 through 18, 1987 a delegation of 10 Americans met with a 14-member Chinese delegation to compare the systems of environmental law in the two countries. The meetings were held on and near the campus of the University of Peking in Beijing, People's Republic of China. This program was the fruition of nearly three years of discussion, planning, and organization involving Dean Betsy Levin and the Natural Resources Law Center.

The United States is faced with a nuclear dilemma. On the one hand, nuclear power seems to be the only significant energy source that is presently capable of meeting the country's electrical energy needs. On the other hand, it is uncertain whether the United States has the technological and managerial capability to make nuclear power reliable and safe. In view of this situation, the United States should begin to develop less dangerous alternatives such as solar power. But development of an efficient solar energy system may require 30 years or more. Regulatory alternatives for the surface mining industry have come under intense public and political scrutiny in recent years. Recent studies have found that the impacts of federal surface mine reclamation regulations' will be noticeable, but perhaps not as substantial as some had expected. Nationwide, coal production from surface mines would be reduced by about five percent, with a similar increase in underground coal production. The federal reclamation legislation, depending on the regulations eventually adopted for its implementation, is unlikely to be a major disruptive influence in the coal industry or a substantial impediment to the long-run national goal of increased …
