Many industries are subject toregulation, whether by the federal government,the state, or both. Electric utilitycompanies’ retail rates are subject to regulationby the states, and their wholesale ratesharged among enterprises involved in providing the electric power to retail sellers are regulated by the federal government. Under the Federal Power Act of 1935 (“FPA”), the Federal Energy Regulatory Commission (“FERC”) is responsible for ensuring that rates for wholesale electric power sales and electric transmission are “just and reasonable.” The “classic scheme” of administrative rate setting called for rates to be established unilaterally by the regulated companies and set forth in rate schedules …

The Renewable Fuel Standard: Food Versus Fuel?, Brent J. Hartman

Created by the Energy Act of 2005 and substantially amended by the Energy Independence and Security Act of 2007, the Renewable Fuel Standard (RFS) mandates an increasing amount of fuel from renewable sources that must be blended into the transportation fuel supply of the United States. Starting in 2008, RFS began with a mandated volume of nine billion gallons. By 2002, RFS requires blending 36 billion gallons of renewable fuel. Thus, in a little over a decade, RFS requires the amount of renewable fuel to quadruple. Meeting the targets of RFS would make substantial strides in energy security and independence, …

Expansion and improvement of the nation’s electricity transmission system are crucial for increasing the amount of electricity generated by renewable energy sources. Renewable energy sources, such as wind and tidal, tend to be located far from population centers, and electricity transmission lines must bridge that gap. In addition to its importance for meeting renewable energy goals, a better connected and more robust transmission system also bolsters reliability because it can draw on many generation sources in the event that a generator or segment of the transmission network fails. This article seeks to examine the United States commercial nuclear power plant decommissioning process, a look into a subject that begins at the end of a nuclear plant's life. The subject is often overlooked in favor of the more dominant and controversial issue of when and where a federal spent nuclear fuel repository will be established. Wood pellet production facilities have spread rapidly across the southeastern United States over the last decade, a market driven largely by electricity generators in Europe converting from coal-fired to wood pellet-fired boilers. This has raised concerns that non-timber values of southern U.S. forests are at risk and that CO2 emissions from burning carbon-based products will continue to exacerbate climate change. One element left out of the analysis regarding whether wood pellet market development is a net environmental positive or negative, however, is the likelihood that forestland will be converted to non-forest uses if Southern landowners do not have adequate markets …

Many scholars and policy makers celebrate cities as loci for addressing climate change. In addition to being significant sources of carbon pollution, cities prove to be dynamic sites of experimentation and ambition on climate policy. However, as U.S. cities set climate change goals far above those of their federal and state counterparts, they are butting up against the limits of their existing legal authority, most notably with regard to control over energy supplies. The Supreme Court recently stripped 47 or the 50 the states of legal power that the states thought that they possessed over power. The Court re-etched in great relief the most important “bright line” in American law. This article analyzes every important step of how the Supreme Court arrived at the legal point to reset the architecture of American power and did so through a unanimous decision. The article charts key implications for U.S. law going forward.

The Lawrence Berkeley National Laboratory (LBNL) recently issued a study entitled “Putting the Potential Rate Impacts of Distributed Solar into Context,” authored by Galen Barbose. The LBNL study estimates the potential rate impact of distributed solar on national average retail electricity prices, and importantly, compares that impact to the potential impact of other rate drivers such as natural gas prices, renewable portfolio standards, and utility capital expenditures.1

This brief applies a similar style analysis as used by LBNL to regional and state level data to estimate more granular impacts for New England. We estimate rate impacts for various penetration rates …

Donald Trump has won the 2016 presidential election, and, based on his campaign rhetoric, it seems reasonable to anticipate that the next four years will see a rollback of federal rules and regulations originally intended to combat climate change and environmental pollution in favor of increased production of fossil fuels, including coal. This raises the question of where we can look for protection of environmental goals, if not to federal law or agencies.
