Under The Radar: The Cost And Benefits Of Wind Energy Through The Lens Of National Security, David N. Cassuto

This Article examines wind energy through the lens of national security. The benefit resides with helping the United States become energy independent. National-security concerns also present a cost because wind energy interferes with military radar, posing a potential threat to the systems that monitor possible attacks. This Article attempts to analyze the overall impact of wind energy while noting the inherent difficulties when so much uncertainty is involved in the process.

Part I of this Article discusses the benefits of wind energy. Part II examines its costs, specifically its interference with radar, and what that means for national security. This …

The smart grid promises an efficient, reliable, and sustainable energy system. Smart meters provide machine-to-machine communication capacity and are key elements of the smart grid. Smart meters allow utilities to improve system efficiency and reliability and allow electricity users to closely monitor, fine-tune, and reduce energy consumption and costs. For these and other reasons, positive expectations for the smart grid and smart meters run high among policymakers, regulators, engineering and computer science professionals, industrialists, environmentalists, and others. This article uses a sociotechnical systems approach to advocate for an alternative way of thinking about the role of innovation in international development efforts, specifically those focused on environmental sustainability and a post-carbon world. This approach views technology and society as inextricably linked, highlighting how particular values, norms, individual rights and responsibilities, social practices and relationships, and aspects of political culture are embedded in the design, development, implementation, and use of technology. As government actors and the private sector attempt to decarbonize the economy, the role of life cycle analysis (also know as life cycle assessment or LCA) has become increasingly important. In this essay, we explore the use of life cycle analysis in the transportation sector to assess its influence in federal and state policy efforts to move to a low-carbon energy future. We first define life cycle analysis and explain its use in evaluating the environmental impacts of all stages of a product from production, to use, to disposal. The Medium matters; Details matter. Two important, somewhat overlooked Supreme Court decisions, reconfigured the law on the most important technology in the United States. One decision of the Court was unanimous, and together these decisions determine the future of American power. The two Supreme Court decisions created a simultaneous legal equation with a clear independent variable, a dependent variable, and a constant term now to be solved in the regulation of energy in America.

Decarbonizing the U.S. energy system will require a program of building onshore wind, offshore wind, utility-scale solar, and associated transmission that will exceed what has been done before in the United States by many times, every year out to 2050. Executive Order 13211, promulgated in 2001, requires the federal government to consider the impact of federal action on energy independence as part of the George W. Bush’s National Energy Policy. This law review examines whether EO 13211 was used to curtail environmental protection and natural resource conservation. The article begins with a review of the procedure required of federal agencies under EO 13211 and its associated documents. The paper then examines case law and published federal rulemaking proceedings and examines how federal agencies apply tests to evaluate the potential energy effect. China is believed to have the world's largest exploitable reserves of shale gas, although several legal, regulatory, environmental, and investment-related issues will likely restrain its exploitation. China's capacity to face these hurdles successfully and produce commercial shale gas will have a crucial impact on the regional gas market and on China’s energy mix, as Beijing strives to decrease reliance on imported oil and coal, and, at the same time, tries to meet growing energy demand and maintain a certain level of resource autonomy.
