This dissertation examines whether an arbitration clause in a construction contract governed by Qatar Arbitration Law No. 2 of 2017 can be extended to a non-signatory party. The study addresses a problem that arises in major construction projects, in which employers, main contractors, subcontractors, consultants, and suppliers are linked by separate yet interdependent contracts. At the same time, arbitration remains structured around bilateral consent.

This dissertation examines how emerging judicial and dispute resolution architectures can sustain cross-border commerce, investment, and enforcement in the post-Soviet space and beyond, at a time of institutional fragility, geopolitical tension, and rapid digitalization. Drawing on the experience of Kazakhstan, Russia, Ukraine, and key global hubs, it argues that institutional innovation in courts, arbitration, and enforcement mechanisms is central to rebuilding credible governance frameworks for international business. Indian arbitration has emerged as a preferred method of dispute resolution, offering the benefits of flexibility, cost-effectiveness, and confidentiality over conventional litigation. Although this flexibility, more specifically in evidentiary matters, has brought procedural inconsistencies and uncertainties that detract from the enforceability of arbitral awards.

This is in line with Section 19 of the Arbitration and Conciliation Act of 1996, which prohibits arbitral tribunals from following the Indian Evidence Act of 1872 or the Code of Civil Procedure of 1908. Sexual harassment (SH) is a prevalent, costly, and often unreported problem in the U.S. Federal Government. Despite decades of research from multiple perspectives and recommendations to address SH, the problem persists and remains complex. At the beginning of 2011, Egypt witnessed radical political developments that led to the emergence of a pressing tendency to adjudicate the collapsed regime’s policies and practices. Shortly thereafter, the Egyptian State Council issued a number of judicial decisions that confirmed that the sale of the privatized governmental enterprises had been tainted by corruption. Crucially, the Court maintained that flagrant breach of law, regulations, and administrative orders that encompassed these transactions created serious suspicions about corruption committed by public officials and investors. The technological advancement and cross-border nature of e-commerce have posed significant challenges to the Egyptian legal framework highlighting the limitations of general commercial contract rules with regards to electronic contracts. The No Child Left Behind Act (NCLB) was enacted as an education intervention to close the achievement gap by increasing student attendance, graduation, and standard testing rates. NCLB held teachers and administrators accountable for successfully meeting adequate yearly progress gains. However, the emerging NCLB research uncovered a culture of conflict with academically at-risk students being pushed out of the public school system and rise in disciplinary actions towards minority students.
