Reforming Regulation In The Markets For Home Loans, Susan Block-Lieb, Edward J. Janger

This article explores the content and institutional context for recently revised regulation of the markets for residential mortgages. The authors compare and contrast the House and Senate bills relating to the market for home loans proposed and/or passed in the wake of the 2008 financial crisis and examines how the Dodd-Frank Act reconciled the various proposals. The article also focuses on the creation and role of the Bureau of Consumer Financial Protection. Lastly, this article examines the portion of the Dodd-Frank Act intended to regulate predatory mortgages.

A Simple Approach To Preventing The Next Housing Crisis-Why We Need One, What One Would Look Like, And Why Dodd-Frank Isn't It, David A. Dana
Fordham Urban Law Journal
This article considers the adequacy of The Dodd-Frank Act in terms of its potential ability to prevent another crisis in the housing market. The author argues that Dodd-Frank, even if implemented broadly, will not address the key problem of excess complexity in the housing and financial markets. The author then suggests additional reform focusing on simplicity, exemplified by the existing regulatory framework in Denmark. Lastly, the author addresses the current political economy, which is blamed for making the passage of effective regulation too difficult.

Toward Legitimacy Through Collaborative Governance: An Analysis Of The Effect Of South Carolina's Office Of Regulatory Staff On Public Utility Regulation, William H. Ellerbe

In 2004 the South Carolina General Assembly instituted a major reform to its system of public utility regulation. Previously, the Public Service Commission, the administrative agency in charge of regulating public utilities, both adjudicated utility proceedings and, through its staff,a advocated for the public interest. A scandal concerning revelations of extensive ex parte communications between regulated utilities and members of the Public Service Commission led to the 2004 reform, which created the Office of Regulatory Staff (ORS) as a separate agency to perform the Commission's advocative functions. Globalisation of business makes it important for firms to predict how their behaviour is likely to be treated in the roughly 200 nations that have competition laws. In that context, a crucial question is: are we in a position to develop a common intellectual framework that would give coherence to policy statements made on specific competition related issues and, at the same time, be acceptable, broadly, in a variety of legal systems, not necessarily based on identical assumptions? From The Schoolhouse To The Poorhouse: The Credit Card Act's Failure To Adequately Protect Young Consumers, Eboni S. Nelson

The article discusses the Credit Card Act of 2009 specifically its provisions aiming to protect college-aged consumers. The author cites the students' high debt figures and discusses the negative impact on their academic, personal and future professional lives. He identifies loopholes that have enabled circumventions and deliberates on proposals which include increases in age and ability-to-pay requirements, limits to increasing credit limits and imposition of usury or interest rate caps.

Americans have access to more health-related information today than ever before. Consumers are bombarded with medical messages and flooded with health-based claims. Television and magazine advertisements inform consumers about everything from insomnia and erectile dysfunction to the importance of dietary fiber and the allegedly wondrous properties of pomegranates. Product labels and promotions provide more food for thought about fat, sodium, and carbohydrates; nutritional supplement makers further supplement consumer nutritional information. Were that not enough, the internet provides access to still more data (and opinion), much of it of questionable provenance and reliability.

The article contends that the Dodd-Frank Act and the case, Morrison v. National Australia Bank, restrict the extraterritorial reach of U.S. fraud laws to private rights of action involving domestic transactions of U.S. securities. The author notes that the U.S. legal jurisdiction is governed by the policy of minimal interference and respect for sovereignties and by the principle of comity. He states that this position will help establish a cooperative regulatory effort across global markets.
