Companies frequently make efficacy claims in advertisements to introduce new products featuring innovative technology. When such claims are supported by information obtained from scientific research or expert testimonials, they are subject to the doctrine of prior substantiation. Under the doctrine, an advertisement claim based on seemingly credible authorities must be substantiated by a reasonable basis before it is released to the general public. Otherwise, the advertisement will be in violation of Section 5(a) of the Federal Trade Commission Act that prohibits "unfair or deceptive acts affecting commerce."' High-priced prescription drugs have been a problem for U.S. consumers. The United States market economy coupled with patent protection for these products creates an incentive for pharmaceutical companies to charge as much as possible. Unable to afford these drugs, many people are reaching out to neighboring countries and abroad to seek lower-cost options. It has also created a market for online mail-order pharmaceuticals. Despite the need for these drugs, the Food and Drug Administration (“FDA”) continues to make importation illegal. In formulating its policy, the FDA cites to safety and innovation concerns. Defending State Exemptions In Bankruptcy, Tristan G. Axelrod

Throughout the past century’s cyclical battles for bankruptcy reform, legislators and scholars have debated the need for federal control over bankruptcy estate exemptions. Millionaire criminals and Wall Street hucksters shielding assets from creditors provide perennial fuel for the argument that bankruptcy exemptions inspire systemic abuse. Few legislators, scholars, or pundits, however, have investigated the actual economic and social policy wisdom in state-specific exemptions as they affect the lives of millions of Americans. This Article examines the origins and policy implications of state-specific exemption laws and argues in favor of limited federal deference to state law.

Abstract: In Clapper v. Amnesty International, the Supreme Court ruled that lawyers and journalists do not have standing to challenge government warrantless wiretapping of international correspondence under the 2008 amendments to FISA. The Court refused to recognize the increased costs of protecting confidential communications as injuries-in-fact unless surveillance is “certainly impending.” But more tellingly, the plaintiffs did not even allege the real injury at stake—the loss of a reasonable expectation of privacy for groups the government targets.
