Computer Abuse: The Emerging Crime And The Need For Legislation, Elizabeth A. Glynn
Fordham Urban Law Journal
Advancements in computerization and the growing use of computers in business, government, education, and the private sector has resulted in the expanding potential for criminal infiltration. The problems of computer crime are in great part attributable to the shortcomings of our criminal laws, which were written long before there was knowledge of computer crimes. Moreover, there is a reluctance of our legal establishments to adapt to the new technology's potential harm. This Note urges that new federal legislation be passed as a means to counteract future computer crimes.

The International Application Of The Second Computer Inquiry, Robert M. Frieden

This article chronicles the FCC's attempt to confront the confluence of telecommunications and data processing technologies by fashioning a regulatory scheme designed primarily for the United States. The Commission has chosen to apply this scheme, without significant qualification, internationally. Given the different objectives and structure of United States and foreign communications industries, the FCC's system cannot be transplanted abroad without prior consultation and substantial modification. After reviewing the international problems created by the Commission's application abroad of its newly developed scheme, this article concludes with recommendations for resolving these conflicts that currently threaten the well-being of carriers, customers, and international …

In the immediate past modem communication means such as efficient telephone and television systems have been viewed as the luxuries of well developed economies. Rapid advances in the field of communications and computer technologies have changed this basic outlook. Now, it is possible to use these technologies as tools of economic growth in both developed and developing countries. This is primarily because cost has gone down while efficiency has gone up. The threat depicted in War Games has been both rebuked as impossible and highlighted as much closer to the realm of possibility than even the creators of the movie may have surmised. Regardless of the actual possibility of a creative mind breaking through the security of the North America Air Defense Command computer with an auto-dialing modem and the simple password "JOSHUA" the adventures of the curious "hackers" and the singularly-directed criminal have been widely publicized and have captured both the fear and respect of computer owners throughout the country.

Federal Copyright Law In The Computer Era: Protection For The Authors Of Video Games, Jeffrey B. Mahan

This Comment analyzes both the manner and scope of copyright protection currently afforded computer video games. It then discusses the means available under federal copyright laws to protect the underlying computer program and concludes that the game should be regarded as a unit. The effect of treating the game as a unit of audiovisual and computer elements—as opposed to considering only the audiovisual display—will be to raise certain appropriations to the level of copyright infringement.

The merger of computer and communications technologies in the past two decades has revolutionized information processing throughout the world. The most recent telecommunications advances possible direct international transfers of sensitive personal data via computer-satellite links. Computerized data bases containing commercial information identifying citizens of one country are now routinely transferred to and stored in another, often without the knowledge of the individuals identified in the data. Numerous European countries have enacted data protection legislation with the avowed intent to protect their citizens from the improper use of personal information that is transferred extranationally. This comment will discuss the current status of national data protection laws and their effect on the conflict between the individual interest in retaining personal privacy and the business interest in preserving the free flow of information. Such discussion will highlight the consequences of the proposed Council of Europe Convention's regulation of personal data. A brief look at the history f the information industry, as well as the costs of and justifications for transborder data flow, will serve to establish a framework for the issues and controversies which the Convention addresses.
