Review Of Ian Kerr And Jane Bailey, The Implications Of Digital Rights Management For Privacy And Freedom Of Expression, 2 Journal Of Information, Communication & Ethics In Society 87 (2004), Ann Bartow
Law Faculty Scholarship
Ian Kerr, who passed away far too young in 2019, was an incisive scholar and a much treasured colleague. The wit that sparkled in his papers was matched only by his warmth toward his friends, of whom there were many. He and his many co-authors wrote with deep insight and an equally deep humanity about copyright, artificial intelligence, privacy, torts, and much much more.
Ian was also a valued contributor to the Jotwell Technology Law section. His reviews here display the same playful generosity that characterized everything else he did. In tribute to his memory, we are publishing a memorial …

Protection of personal data in recent decades became more crucial affecting by emergence of the new technologies especially computer, internet, information and communications technology. However, Europeans felt this necessity at time and provided for up-to-date and supportive laws. The General Data Protection Regulation (GDPR) is the latest legislation in EU to protect personal data of individuals based on the recent technological advancements. However, its’ domestic and international output still is debatable. This doctrinal legal study by using descriptive methods, aimed to evaluate the GDPR through analyzing and interpreting its’ provisions by especial focus on its’ innovations. The results show that …

Memoryranger Prevents Highjacking File_Object Structures In Windows Kernel, Igor Korkin
Journal of Digital Forensics, Security and Law
Windows OS kernel memory is one of the main targets of cyber-attacks. By launching such attacks, hackers are succeeding in process privilege escalation and tampering users’ data by accessing kernel-mode memory. This paper considers a new example of such an attack, which results in access to the files opened in an exclusive mode. Windows built-in security features prevent such a legal access, but attackers can circumvent them by patching dynamically allocated objects. The research shows that the newest Windows 10 x64 is vulnerable to this attack. The paper provides an example of using MemoryRanger, a hypervisor- based solution to prevent …

Fast Forensic Triage Using Centralised Thumbnail Caches On Windows Operating Systems, Sean Mckeown, Gordon Russell, Petra Leimich
Journal of Digital Forensics, Security and Law
A common investigative task is to identify known contraband images on a device, which typically involves calculating cryptographic hashes for all the files on a disk and checking these against a database of known contraband. However, modern drives are now so large that it can take several hours just to read this data from the disk, and can contribute to the large investigative backlogs suffered by many law enforcement bodies. Digital forensic triage techniques may thus be used to prioritise evidence and effect faster investigation turnarounds. This paper proposes a new forensic triage method for investigating disk evidence relating to …
Improved Decay Tolerant Inference Of Previously Uninstalled Computer Applications, Oluwaseun Adegbehingbe, James Jones
Improved Decay Tolerant Inference Of Previously Uninstalled Computer Applications, Oluwaseun Adegbehingbe, James Jones
Journal of Digital Forensics, Security and Law
When an application is uninstalled from a computer system, the application’s deleted file contents are overwritten over time, depending on factors such as operating system, available unallocated disk space, user activity, etc. As this content decays, the ability to infer the application’s prior presence, based on the remaining digital artifacts, becomes more difficult. Prior research inferring previously installed applications by matching sectors from a hard disk of interest to a previously constructed catalog of labeled sector hashes showed promising results. This prior work used a white list approach to identify relevant artifacts, resulting in no irrelevant artifacts but incurring the …

Cybersecurity Paradigm Shift: The Risks Of Net Neutrality Repeal To Energy Reliability, Public Safety, And Climate Change Solutions, Catherine J.K Sandoval
Cybersecurity Paradigm Shift: The Risks Of Net Neutrality Repeal To Energy Reliability, Public Safety, And Climate Change Solutions, Catherine J.K Sandoval
San Diego Journal of Climate & Energy Law
This Article contends that the Federal Communications Commission’s (FCC) January 2018 repeal of net neutrality rules created a “zero-day” cybersecurity vulnerability for the energy sector and other criti¬¬¬cal infrastructure. “A zero-day cybersecurity vulnerability is a previously unknown flaw in a computer program that exposes the program to external manipulation.” The flaw may also reside in compromised hardware that creates a “back door” into the internet-connected device. This Article argues that cybersecurity has been primarily viewed from a “hacker paradigm” that obscures systemic threats an Internet Service Provider (ISP) can create to energy reliability and cybersecurity through paid priority and other …
Comparative Analysis Of The Eu’S Gdpr And Brazil’S Lgpd: Enforcement Challenges With The Lgpd, Abigayle Erickson
Comparative Analysis Of The Eu’S Gdpr And Brazil’S Lgpd: Enforcement Challenges With The Lgpd, Abigayle Erickson
Brooklyn Journal of International Law
In the wake of the adoption of the European Union’s General Data Protection Regulation (GDPR) in May 2018, other countries and jurisdictions have contemplated personal data privacy legislation. In August 2018, the former president of Brazil, Michel Temer, signed the country’s comprehensive data privacy regulation, Lei Geral de Proteção de Dados Pessoais (LGPD), into law. Temer, however, vetoed many of the enforcement provisions. Shortly before leaving office, Temer signed an executive order creating a regulatory agency as the bill initially called for, but situated the agency under executive control instead of creating a wholly independent agency. This Note provides a …
The Need For A Shared Responsibility Regime Between State And Non-State Actors To Prevent Human Rights Violations Caused By Cyber-Surveillance Spyware, Anna W. Chan
Brooklyn Journal of International Law
Technology has undoubtedly contributed to the field of human rights. Internet connection and a smartphone has enabled activists to call out political leaders, shine light on human atrocities and organize mass protests through social media platforms. This has resulted in many authoritarian governments spending large amounts of their resources to purchase cyber-surveillance spyware systems from multi-national corporations to closely monitor and track their citizens for any signs of dissidence. Such technology has enabled authoritarian regimes to commit human right violations ranging from invasion of privacy, arbitrary arrest, arbitrary detention, torture and even murder. Despite the uncovering of such questionable transactions …
Enhancing Forensic-Tool Security With Rust: Development Of A String Extraction Utility, Jens Getreu, Olaf Maennel
Enhancing Forensic-Tool Security With Rust: Development Of A String Extraction Utility, Jens Getreu, Olaf Maennel
Journal of Digital Forensics, Security and Law
The paper evaluates the suitability of the Rust ecosystem for forensic tool development. As a case study, a forensic tool named Stringsext is developed. Starting from analyzing the specefic requirements of forensic software in general and those of the present case study, all stages of the software development life-cycle are executed and evaluated. Stringsext is a re-implementation and enhancement of the GNU-strings tool, a widely used program in forensic investigations. Stringsext recognizes Cyrillic, CJKV East Asian characters and other scripts in all supported multi-byte-encodings while GNU-strings fails in finding these in UTF-16 and other encodings. During the case study it …
