The Legacy Of Lead: Lead Exposure's Harmful Effects And Its Concentration In Poc Communities, Layla Sophronia Barber
The Legacy Of Lead: Lead Exposure's Harmful Effects And Its Concentration In Poc Communities, Layla Sophronia Barber
Student Theses 2015-Present
This thesis examines the disproportionate burden of lead exposure carried by low income, POC communities. The systemic nature of this problem is a symptom of a longstanding legacy of environmental injustice in the United States. Decades of federal neglect are reflected in the higher statistics of lead exposure and poisoning in predominantly black communities. While it is understood that lead exposure poses a serious threat to physical health and early cognitive development, there is a discouraging lack of urgency to remove the toxin from non-wealthy communities. The material covered by this thesis aims to identify and correct the discriminatory social …

Mercer Law Review
The 2025 Survey period yielded a range of decisions impacting trial practice in the United States Court of Appeals for the Eleventh Circuit, from detailed analysis of the constitutional requirements for personal jurisdiction, expounding upon the limited opportunities for interlocutory appeal, and reinforcing pleading standards. This Article analyzes some of this Survey period’s notable opinions on issues of first impression in the Eleventh Circuit, but it is not intended to be an exhaustive discussion of the Eleventh Circuit’s important decisions during the Survey period.
What Attorneys “Ott” To Do: The Supreme Court Clarifies Judgmental Immunity In Georgia, Valeria Notte
What Attorneys “Ott” To Do: The Supreme Court Clarifies Judgmental Immunity In Georgia, Valeria Notte
Mercer Law Review
The Supreme Court of Georgia dealt a swift blow to the Court of Appeals of Georgia’s interpretation of judgmental immunity in a recent decision. For over three decades, the court of appeals recognized a subjective defense that shielded attorneys from liability for mistakes made while representing a client. Under this interpretation of judgmental immunity, attorneys prevailed on motions for summary judgment by demonstrating that they had exercised their honest professional judgment in making the challenged decision. Now, in Cox-Ott v. Barnes & Thornburg, LLP, a unanimous opinion by the supreme court held that attorneys are no longer entitled to the …

From Promise To Practice: An Analysis Of The De Jure-De Facto Gap In The Individuals With Disabilities Education Act, Alyssa S. Piccoli
Honors Scholar Theses
Children with disabilities face educational disparities in the United States despite the existence of the Individuals with Disabilities Education Act (IDEA), which was enacted by the U.S. Congress to ensure a Free Appropriate Public Education (FAPE) for such children. As promises of protection are overshadowed by discrepancies in access, quality, and consistency across school districts (Seligman 2005), this paper examines the legal factors that aggravate the paradox between de jure educational rights and their de facto fulfillment for children with autism. To better understand how these challenges manifest in the legal arena, I analyze twenty-four legal cases and seventy claims …
"Market Shift Liability" For Generic Drugs: Market Share Theory's Eccentric New Cousin, Lars Noah
"Market Shift Liability" For Generic Drugs: Market Share Theory's Eccentric New Cousin, Lars Noah
UF Law Faculty Publications
Market share liability, which permits allocating proportional responsibility to each tortious member of an industry when victims cannot identify the exact source of their injurious exposure, enjoyed its judicial heyday in the 1980s. It originated in the peculiar setting of litigation over a distinctive cancer that developed decades after in utero exposure to the drug diethylstilbestrol (“DES”), which a few hundred companies had produced and sold for the prevention of miscarriages before federal regulators withdrew it from the marketplace. Although judges have occasionally attempted novel extensions of this theory to other products, and academic commentators remain fascinated by its use, …
Foreign Judgments In U.S. Courts, Yanbai Andrea Wang
Foreign Judgments In U.S. Courts, Yanbai Andrea Wang
Fordham Law Review
American law on foreign judgments is at an inflection point. For over a century, the doctrine has been shaped by concerns about outgoing U.S. judgments seeking asset collection in the civil law countries of continental Europe. But shifting trade flows and changing litigation tactics have carved a new landscape, demanding a return to foreign judgments law’s conceptual and doctrinal underpinnings. This Article first maps the new landscape, in which China is rapidly rising as a foremost foreign judgments interlocutor. Meanwhile, litigants are increasingly pursuing parallel litigation in multiple countries. The impact of incoming judgments and the interactions between related litigations …

Reckitt-Benckiser And Buprenorphine: Opioid Addiction Treatment, Drug Monopolies, And Consumer Implications, Peri G. Heyen
Theses/Capstones/Creative Projects
The opioid crisis in the United States is a deadly epidemic that demands fair and accessible treatment for those affected. The introduction of buprenorphine for opioid addiction disorder in 2002 allowed for the first treatment of the disorder beyond the time intensive and stigmatized practices of methadone clinics, which proved to be revolutionary. Reckitt-Benckiser (“Reckitt”) and former subsidiary Indivior were able to gain a legal monopoly of buprenorphine through their orphan drug exclusivity designation on Suboxone tablets that was approved by the FDA. Once orphan drug exclusivity was near expiration and generic competition began to prepare to enter the market, …

Russian Linguistic Policy In The Post-Soviet World, Payton G. Deichler
Russian Linguistic Policy In The Post-Soviet World, Payton G. Deichler
The Dialogue
This paper examines the role of the Russian language as an instrument of soft power in the post-Soviet space, arguing that its geopolitical influence extends beyond demographic prevalence to the institutional frameworks through which it is promoted and mediated. Rather than functioning solely as a neutral medium of communication, Russian operates as an infrastructural component of influence that shapes access to media ecosystems, educational systems, and professional mobility across former Soviet republics. Drawing on the concept of a “Monopoly of Interpretation,” this study proposes that the centralized, state-linked promotion of Russian enables the consolidation of political narratives within shared linguistic …

The seminar entitled “Repayment of Debts Denominated in Foreign Currency Amid the Financial Crisis” addresses the severe financial turmoil Lebanon has been experiencing since the end of 2019, marked above all by the sharp depreciation of the Lebanese pound. This collapse created profound difficulties in repaying debts denominated in foreign currency, and in some cases made repayment impossible. The issue is closely tied to Lebanon’s reliance on foreign currencies, particularly the U.S. dollar. Anticipating such risks, many Lebanese citizens had safeguarded their savings by depositing them in banks in foreign currency, as protection against the recurring devaluation of the national …

This paper addresses one of the conditions for the recognition and enforcement of foreign judgements in the United Arab Emirates, namely verifying the jurisdiction of the foreign court that issued the judgment. In this regard, the UAE Civil Transactions Code provides that the Emirati enforcement judge cannot order the enforcement of a foreign judgment before verifying that the Emirati courts do not enjoy exclusive jurisdiction over the dispute that had led to the issuance of the judgment or the order, and that the foreign court that issued the judgment or the order enjoys jurisdiction under the international jurisdiction rules laid …

The importance of the "qawaed kulliya" (Fundamental Rules) lies in the fact that they are recognized in the various laws due to the values they represent, arising from sound logic. They are called kulliya because they are the source from which legal provisions derive, and they help in understanding the causes and aims of rules allowing for deduction and analysis. The UAE being sensitive to the importance of the Fundamental Rules has dedicated a special chapter to them, titled "Certain Doctrinal Interpretative Rules", in the Civil Transactions Law promulgated by the Federal Law No. 5 of 1985. This study dealt, initially in 2018, with a long-running controversial issue in doctrine and case law, namely the determining criterion in civil liability of board members in a joint-stock company allowing to differentiate between the company’s claim that the shareholder can exercise alone (known as ut singuli claim) and the shareholder’s claim to request compensation for his "individual" damage. The new 2015 UAE law for commercial companies has confused, in the wording used in Article 166, between the damage suffered by the company and the "individual" damage suffered by the shareholder. This confusion has been corrected in the amending Law …

Force Majeure And Economic Hardship Under Uae Law, Myrna Saad
Proche-Orient, Études juridiques
The recent COVID-19 pandemic has sparked a renewed interest in the concepts of force majeure and economic hardship, which both deal with unforeseen and unavoidable events disrupting the performance of a contract. Despite many overlapping features between the two concepts, major divergences exist, both in conditions and effects. This article examines how force majeure and hardship are approached in the UAE Civil Transactions Code by analyzing their constitutive elements and comparing their consequences on contract performance and liability.

The general conditions for the formation of the contract in the Lebanese case law The Lebanese lawmaker enacted the general conditions for the formation of the contract in Articles 186 and following of the Code of Obligations and Contracts. However, here as elsewhere, the legislative work had to be supplemented by case law. The analysis of the case law relating to the substantive conditions required for the formation of the contract, has allowed to identify the most significant points of litigation in this area, to list the solutions given by the courts and to infer their general guidelines. The Lebanese …
