This Article, for a collection in which authors were asked to “imagine a world without corporate criminal liability,” specifies the material questions that should be addressed if debate about the doctrine is to progress past longstanding and oft-repeated assertions. The strongest case for corporate criminal liability is based on the potential for its unique reputational effects to contribute to the prevention and deterrence of crime within corporations. Further research should take up a variety of unanswered questions about those effects having to do with mechanisms and audiences. The relevant inquiries are both theoretical and empirical. The law of business associations does not recognize gender. The rights and responsibilities imposed by states on business owners, directors, and officers do not vary based on whether the actors are male or female, and there is no explicit recognition of the influence of gender in the doctrine.

Sex and gender nonetheless may pervade business disputes. One co-owner may harass another co-owner; women equity holders may be forced out of the company; men may refuse to pay dividends to women shareholders.

This research examines information transparency on the governance of infrastructure investment funds in Indonesia, including the contrast with the concepts of collective investment schemes, European Long-Term Investment Fund, and infrastructure funds in Thailand. The hypothesis of this study is that the regulatory framework of infrastructure investment funds in Indonesia is less comprehensive in enabling the availability and clarity of information for investors’ informed decisions, compared to such concepts. This research examines establishment and enforcement of the right to be forgotten under the Chinese legal system, including the origin and characteristics of the "right to be forgotten", as well as the regulations on "erasure" in China. It finds that protection challenges stem from the fact that personal data can be publicly accessible online. In addition, different countries, which are electronically connected through the internet, may have different legal protection measures for a right to be forgotten. Despite increasing criticism, Delaware's dominance in corporate law has not experienced a significant decline: as of today, 67.8 percent of Fortune 500 companies are still incorporated in its jurisdiction. Nevada is known as Delaware's most important competitor, with an aggressive strategy that has overridden the efforts of any other jurisdiction. Yet, its success has been limited to a specific market segment: small firms with low institutional shareholding and high insider ownership.
