Proche-Orient, Études juridiques

On December 22, 2023, the Law “Amending Some Provisions of the Social Security Law and Establishing the Retirement and Social Protection System” was enacted. This law introduces the pension system to replace the end-of-service indemnity. Despite the advantages of adopting indexed periodic payments over lump sum compensation, it is clear that the transition to the new system is threatened by the on-going end-of-service compensation crisis. What stands out is the contradiction between the approach adopted to address the end-of-service compensation crisis and the mechanisms stipulated in the 2023 Law. While the pension system relies on periodic indexation in order to …

تقييم قانون التنظيم القضائي في ضوء المعايير الدوليّة, رينا قسطنطين

This study examines Lebanon’s Law on the Organization of the Judicial Court System, adopted by the Chamber of Deputies on July 31, 2025, and returned to the Chamber by the President of the Republic for further discussion, on September 5, 2025. It represents one of the most significant judicial reform initiatives since the Taif Agreement of 1989. The study traces the evolution of the Law’s provisions in successive drafts in light of the recommendations of the Venice Commission – the advisory body to the Council of Europe – and international standards regarding both institutional and individual judicial independence. The article …

في معنى استقلالية السلطة القضائية وتجلياتها, رزق زغيب

Proche-Orient, Études juridiques

The independence of the judiciary in Lebanon, as constitutionally guaranteed, carries a particular meaning that is embodied exclusively in the judicial function performed by any sitting judge issuing rulings in the name of the Lebanese people. The Constitution that elevates the judiciary to the level of a power does not provide itself for guarantees akin to the legislative and executive branches. Rather, it entrusts the determination of judicial safeguards to the legislature, under the oversight of the Constitutional Council. The Council has consistently interpreted these safeguards as measures that protect judges in the exercise of their functions by removing any …

La Réforme De La Justice Administrative Au Liban, Nadi Abi Rached Apr 2026

La Réforme De La Justice Administrative Au Liban, Nadi Abi Rached

Proche-Orient, Études juridiques

The Lebanese administrative judiciary is undergoing a profound crisis, exacerbated by the broader institutional disintegration affecting the country. This crisis appears rooted in deeper and more specific causes: an alleged original illegitimacy of the institution and the recurrent instabilities that have marked its development. Today, this branch of justice operates at a minimal level, remains dependent of the executive, and struggles to fully guarantee the right to a fair trial. Two reform proposals aim to address this situation. This article first seeks to reaffirm the historical legitimacy and institutional continuity of the administrative judiciary, thereby providing a sound basis for …

Le Rôle Du Conseil D’État Dans L’Élaboration Du Droit, Joseph Chaoul Apr 2026

Le Rôle Du Conseil D’État Dans L’Élaboration Du Droit, Joseph Chaoul

Proche-Orient, Études juridiques

The centenary of the Lebanese Conseil d’Etat, established in 1924 on the French model, offers an opportunity to reflect on its role in the development of law. This institution, which embodies the dual jurisdictional system characteristic of legal systems inspired by French law, has a dual mission – advisory and judicial – making it a central actor in the creation of law. In its advisory function, it provides the government with guidance on the legality and administrative advisability of draft texts. Through its judicial function, the Conseil d’Etat contributes to the formation of administrative law through its case law. …

Socio-Legal Framework For Vulnerability: Using Public-Private Partnerships As A Tool For Disaster Management, Latisha Nixon-Jones

Pepperdine Law Review

As disasters continue to grow in size and intensity, the question arises: can governments effectively meet local and regional disaster response and recovery needs? This Article examines the history of utilizing public-private partnerships (PPPs) to enhance government functions in disaster management. The primary objective of this Article is to assess whether involving private entities in governmental roles is an effective strategy for building resilient communities and ensuring public safety, particularly for vulnerable populations. Existing literature focuses on the financial and logistical aspects of PPPs with mere mentions of legal importance. To address these failures, this Article proposes a novel socio-legal …

Ultra Vires Review In Administrative Law For Dummies, Jack M. Beermann

Richard W. Murphy, Ultra Vires Review of Federal Agency Action Made Simple(r), 2025 Utah L. Rev. 1201 (2025).

Non-statutory review, ultra vires review, and Leedom v. Kyne, the leading case on non-statutory review, all have one thing in common—when I come across them, my eyes glaze over, and I pretend it never happened, hoping they will all go away. It’s like an allergic reaction. I’ve avoided talking about them, writing about them, and covering them in my Administrative Law course like the plague. Leave it to Richard (“Chip”) Murphy, famous for his entertaining and informative annual reviews of …

Alaska Dep’T Of Fish And Game V. Federal Subsistence Bd., Mj Fiedler Apr 2026

Alaska Dep’T Of Fish And Game V. Federal Subsistence Bd., Mj Fiedler

Public Land & Resources Law Review

A subsistence hunt in Kake, Alaska, during the COVID-19

pandemic sparked a lawsuit from the State of Alaska Department of Fish

and Game challenging the authority of the Federal Subsistence Board to

open the hunt. This lawsuit is a recent addition to a long history of the

State of Alaska’s resistance to federal enforcement of the Alaska National

Interest Lands Conservation Act provision establishing priority for rural

subsistence users. The Ninth Circuit ultimately affirmed the Federal

Subsistence Board’s authority to open the subsistence hunt.

The Deregulation Of Cancer, Daniel G. Aaron Apr 2026

The Deregulation Of Cancer, Daniel G. Aaron

Texas A&M Law Review

Fifty years ago, the U.S. embarked on a radical new path. Under pressure from the environmental movement, Congress passed an array of statutes aimed at regulating carcinogens out of our world. This regulatory experiment sprawled from air and water to food and consumer products.

Legal scholars have paid scant attention to this wave of cancer regulation despite its size and importance and the public’s apparent interest in avoiding carcinogens. But there is a growing literature finding flaws with individual regimes within the framework, such as the Clean Air Act, the Toxic Substances Control Act, and the Tobacco Control Act. In …

Individualized Cannabis Reparations, Scott Bloomberg Apr 2026

Individualized Cannabis Reparations, Scott Bloomberg

Texas A&M Law Review

This Article makes an argument that should be obvious. The best way for governments to right the wrongs of cannabis prohibition is to give money to people with cannabis offenses. Nonetheless, this straightforward reform has been consistently overlooked, dismissed, or minimized by policymakers and scholars alike, eschewed in favor of other social equity programs that do not right those wrongs nearly as effectively. Governments have indeed invested hundreds of millions of cannabis tax dollars in social equity licensing programs and community reinvestment initiatives. These programs—while often worthwhile—do not benefit the vast majority of people with past cannabis offenses.

Governments should …

Brief Of The American Immigration Lawyers Association And Immigration Law Scholars As Amici Curiae In Support Of Respondents, Lindsay Nash

Amicus Briefs

Amicus curiae brief submitted by the American Immigration Lawyers Association and immigration law scholars in support of the respondents in Mullin v. Doe and Trump v. Miot before the Supreme Court of the United States. The brief argues that the Temporary Protected Status (TPS) statute strictly limits the Executive Branch's authority to terminate TPS designations and requires continuation of protection unless the statutory conditions justifying designation no longer exist. The amici further contend that TPS serves a critical humanitarian function by protecting individuals from removal, detention, and loss of work authorization while conditions in designated countries remain unsafe.

Place Names And Presidential Control, Austin Kruse Apr 2026

Place Names And Presidential Control, Austin Kruse

Northwestern University Law Review

Since the start of his second term, President Trump has issued executive orders at an extraordinary pace, using them to advance a broader ideological agenda across the administrative state. While scholarly attention has largely focused on the most sweeping of these directives, less prominent orders raise similar concerns about the reach of presidential power. This Note examines one such order: Executive Order 14,172, which directs the renaming of the Gulf of Mexico and Denali and expands presidential influence over the U.S. Board on Geographic Names (BGN).

Although geographic naming is ostensibly apolitical, place names are deeply entangled with questions of …

Procedural Guarantees For Disciplining Federal Employees, Khalifa Abdullah Al Mulla Apr 2026

Procedural Guarantees For Disciplining Federal Employees, Khalifa Abdullah Al Mulla

Thesis/ Dissertation Defenses

Procedural disciplinary guarantees aim to protect public or federal employees from being penalized for violations without following specific procedures. Such violations could invalidate or taint administrative decisions. This thesis aims to ensure public employees are protected from penalties through legislation and legal texts that achieve this objective. In the United Arab Emirates, regulatory legislation exists that aims to establish effective procedural guarantees for employee discipline, whether through local legislation or other means. The study addressed the procedural safeguards for disciplinary investigations, which are essential at the outset of the investigation process. These safeguards allow the competent disciplinary authorities to initiate …

The Executive’S Takeover Of Independent Agencies: How Institutional Design Gave Way To Political Will, Neal Devins Apr 2026

The Executive’S Takeover Of Independent Agencies: How Institutional Design Gave Way To Political Will, Neal Devins

Pepperdine Law Review

The anticipated demise of the independent agency is a saga that implicates Congress as much as it does the President or the Supreme Court. By capitulating to presidential initiatives and failing to defend their institutional prerogatives, Congress has facilitated presidential control of the administrative state. Indeed, irrespective of whether the Court formally repudiates Humphrey’s Executor, Congress has largely acquiesced to a regime whereby presidents essentially control independent agencies. By highlighting the competing incentives of Congress and the White House, this Essay explains the rise of presidential unilateralism vis-à-vis independent agencies. This Essay also casts light on a critically important but …
