Annual Survey Of Virginia Law: Administrative Procedure, Charles H. Carrathers Iii.

This article covers all changes made to the Virginia Administrative Process Act ("VAPA") during the 1990 session of the General Assembly. It also covers selected Supreme Court of Virginia cases dealing with administrative procedure, together with selected reported cases from the Court of Appeals of Virginia and Virginia circuit courts. Two cases decided by federal district courts sitting in Virginia that involve issues related to Virginia administrative procedure also are discussed. The cases reviewed in this article were decided between May 1989 and June 1990.

Municipal institutions are the forgotten partners in the Canadian confederation. This is true in both political and legal terms. In political terms the agencies of local government are often under-valued. With respect to the law, the municipal level of government has too often been ignored. Both municipal councils and their related boards and tribunals have an important impact on the lives of citizens at the grass roots level. In carrying out their duties, municipal authorities exercise a wide range of discretionary powers and it is becoming increasingly important that they recognize the legal limits on their powers. The Air Toxics Dilemma: Whither Section 112?, Michael E. Herz

The Clean Air Act was the product of a spasm of extraordinary political unanimity. Its actual implementation, however, has been divisive and controversial from the start. For two decades now, politicians, members of the regulated community, environmental activists, and academics have been debating whether the Act represents a rational investment (current expenditures for air pollution control are generally estimated at something above thirty billion dollars), uses optimal or even sensible regulatory mechanisms, or has accomplished anything at all.
