Justice Kennedy’s “significant nexus” test may emerge as the proverbial silver lining of the U.S. Supreme Court’s June 2006 decision in Rapanos v. United States, at least so far as recognition of ecosystem services is concerned. The Court’s opinion in Rapanos was fractured. Nevertheless, it left no doubts that the Clean Water Act’s jurisdiction over “navigable waters” had been limited, drawing criticism for both its lack of clarity and its restriction of federal jurisdiction under the Act.
The extent of that restriction, however, would depend on which of the three major opinion’s in the case – Justice Scalia’s plurality, Justice …

Estimating Discount Rates For Environmental Quality From Utility-Based Choice Experiments, W. Kip Viscusi

We estimate rates of time preference using a utility-based choice experiment administered to a nationally representative sample of 2,914 respondents. For the full sample, the rate of time preference is very high for immediate benefits and drops off substantially thereafter, which is inconsistent with exponential discounting but consistent with hyperbolic discounting. Estimates of the hyperbolic discounting parameter range from 0.48 to 0.61. Visitors to water bodies have low rates of discount but exhibit hyperbolic discounting, whereas those who do not visit have consistently high rates of discount and low valuations of water quality.

In Re Annandale And The Disconnections Between Minnesota And Federal Agency Deference Doctrine, Mehmet K. Konar-Steenberg

This article explores each of these differences between Annandale’s view of deference and comparable federal authority. Part II begins the discussion with an explanation of the somewhat complicated legal and factual background that gave rise to Annandale’s unusually thorny agency deference issues. This section includes an extended discussion of the Annandale administrative record and the reasoning of the Minnesota Court of Appeals and Minnesota Supreme Court. Part III then critically analyzes the Annandale court’s claims to have acted consistently with federal agency deference case law in each of the three areas discussed above. Testing The Waters: Jurisdictional And Policy Aspects Of The Continuing Failure To Remedy Drinking Water Quality On First Nations Reserves, Constance Macintosh

This paper considers why, from a policy and legal perspective, there is such a disparity between the water quality on First Nations reserves, and that experienced in the majority of other Canadian communities. This involves engaging with how jurisdictional allocations, governmental policies, statutory or policy-del-egated mandates, and operational practices con-verge. In this discussion, two inter-related tensions emerge. The first is between Aboriginal aspirations to self-govern and community capacity to effectively engage in governance activities. The second is Canada's proper role and responsibilities in resolving the governance/capacity tension, and in resolving the water quality problems.
