The Priorities And Accomplishments Of Kentucky Legislators : Is There A Gender Difference?, Amanda Allen
The Priorities And Accomplishments Of Kentucky Legislators : Is There A Gender Difference?, Amanda Allen
College of Arts & Sciences Senior Theses
This thesis uses Kentucky as a case study of gender differences in the policy priorities and perceptions of accomplishments of state legislators. The research question is, “are there gender differences in the legislative priorities and perceptions of accomplishments of Kentucky legislators?” The legislative priorities of the legislators seemed to be similar, along with their own classification of women’s issues. The perceptions of success demonstrated that male legislators were not necessarily more likely to attribute success to themselves, whereas women would attribute success to collaboration efforts. The research was completed through confidential interviews with Kentucky legislators and analysis of the 2015 …

The sixth and final UTOPIA500 presentation was April 21, 2016. Malloy, organizer of the UTOPIA500 project. Professor Herman delivered a presentation on Constitutional Utopianism. Friendly Precedent, Anthony Niblett, Albert H. Yoon
Friendly Precedent, Anthony Niblett, Albert H. Yoon
William & Mary Law Review
This Article explores which legal precedents judges choose to support their decisions. When describing the legal landscape in a written opinion, which precedent do judges gravitate toward? We examine the idea that judges are more likely to cite friendly precedent. A friendly precedent, here, is one that was delivered by Supreme Court Justices who have similar political preferences to the lower court judges delivering the opinion. In this Article, we test whether a federal Court of Appeals panel is more likely to engage with binding Supreme Court precedent when the political flavor of that precedent is aligned with the political composition …
The Second Dimension Of The Supreme Court, Joshua B. Fischman, Tonja Jacobi
The Second Dimension Of The Supreme Court, Joshua B. Fischman, Tonja Jacobi
William & Mary Law Review
Describing the Justices of the Supreme Court as liberals and conservatives has become so standard and the left-right division on the Court is considered so entrenched that any deviation from that pattern is treated with surprise. Attentive Court watchers know that the Justices are not just politicians in robes, deciding each case on a purely ideological basis. Yet the increasingly influential empirical legal studies literature assumes just that that a left-right ideological dimension fully describes the Supreme Court. We show that there is a second, more legally-focused dimension of judicial decision making. A continuum between legalism and pragmatism also divides …

The fifth UTOPIA500 presentation was April 7, 2016 about St. Thomas More and his Utopia in Antebellum American Lawyers' Thought. A former dean at Kansas Law and a renowned historian of colonial and pre-Civil War America, Professor Michael H. Hoeflich is also a fellow of the Royal Historical Society. He explored the publication history of More's UTOPIA, and the extent to which editions of the book were available in antebellum America. Professor Hoeflich noted that the novel, as a work of "politics," was well known by the likes of Jefferson, Madison, and John Adams, but its influence thereafter ebbed and …

Agonizing Identity In Mental Health Law And Policy (Part Ii):A Political Taxonomy Of Psychiatric Subjectification, Sheila Wildeman
Dalhousie Law Journal
This is the second part of a two-part essay exploring the function of identity in mental health law and policy or more broadly the function of identity in the politics of mental health. Part one began with the Foucauldian exhortation to undertake a "critical ontology of ourselves," and adopted the methodology of autoethnography to explore the construction or constructedness of the authors identity as an expert working in the area of mental health law and policy. That part concluded with a gesture of resistance to identification on one or the other side of the mental health/ illness divide (the divide …

The Quid Pro Quo Quark: Unstable Elementary Particle Of Honest Services Fraud, Brian H. Connor
The Quid Pro Quo Quark: Unstable Elementary Particle Of Honest Services Fraud, Brian H. Connor
Catholic University Law Review
From 1946 to 1987, the federal mail fraud statute, 18 U.S.C. § 1341, was a powerful tool for the prosecution of political corruption. In a line of decisions beginning with the Fifth Circuit’s in Shushan v. United States, and ending with the Supreme Court’s decision in McNally v. United States, courts upheld the use of the statute to prosecute officials who had deprived the public of its “intangible right” to the official’s “honest services.” In 1988, after the Supreme Court held this theory unconstitutionally vague in McNally, Congress enacted § 1346, intending to restore “honest services fraud” …
