The Clinical Method Of Legal Instruction: Its Theory And Implementation, David R. Barnhizer
The Clinical Method Of Legal Instruction: Its Theory And Implementation, David R. Barnhizer
Law Faculty Articles and Essays
This article assists the process of understanding the clinical methodology by analyzing the following premises. 1. The method of instruction termed "clinical" differs from the Langdellian appellate casebook method in only one respect--the clinical method collects directly experienced legal processes involving a third party (the client) as its core of material studied by the law student while the casebook method utilizes collections of vicariously or indirectly experienced two-dimensional material as its core of learning material. 2. Issues of what specific educational goals are selected by the law teacher, and the techniques of instruction (Socratic, lecture, discussion, videotapes, etc.) are not …
The History Of Legal Education In Virginia, William Hamilton Bryson
The History Of Legal Education In Virginia, William Hamilton Bryson
Law Faculty Publications
Many methods of legal education have been used over the years. Each has its strengths and its weaknesses. The study of the past is instructive and useful in showing both the good and bad goals and methods. We must cultivate the good and uproot the bad. This study suggests that there has always been progress, slow but constant improvement. The teaching of law is vital to the administration of justice, a noble cause. The continuing challenge is ever to strive for the improvement thereof.
Civil Rights And Legal Order: The Work Of A. Leon Higginbotham, Jr., Donald P. Kommers, Eugenia S. Schwartz
Civil Rights And Legal Order: The Work Of A. Leon Higginbotham, Jr., Donald P. Kommers, Eugenia S. Schwartz
Journal Articles
On October 11-12, 1978, Judge A. Leon Higginbotham, Jr.' delivered the Notre Dame Law School's Seventh Annual Civil Rights Lecture under the general title, "From Thomas Jefferson to Bakke: Race and the American Legal Process." It seems to us appropriate, therefore, on the occasion of the Higginbotham lecture, to consider his work as both historian and judge. Specifically, this article will serve the threefold purpose of (1) reviewing Matter of Color, (2) illustrating the author's use of history in two judicial opinions dealing with the rights of black Americans, and (3) reflecting upon the implications of Higginbotham's work in legal …

Reassessing Law Schooling: The Sterling Forest Group, Thomas L. Shaffer
Reassessing Law Schooling: The Sterling Forest Group, Thomas L. Shaffer
Journal Articles
This Article is the result of a weekend in December 1976 at the Sterling Forest Conference Center. Several legal educators came together there to explore the possible relevance of humanistic educational psychology to legal education, and the pieces that follow flow from the experiences in learning we shared there. The concerns that brought the ten of us together were not new; rather, they emanated from a longstanding challenge within the profession.
Although we taught at different institutions and in different fields, our experiences had led us to a common dissatisfaction with legal education and a hope that more was possible. …

Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Law Faculty Articles and Essays
This Commentary rests on five premises. The first is that it is both possible and necessary to understand clinical legal education as a general instructional method. The second is that all legal educators must be more willing to reexamine and clarify the purposes of legal education and to engage in discussion about the primary educational goals to be served. The third premise is that different educational methods possess distinct capabilities for the attainment of specific educational goals and that certain applications of the clinical method are manifestly superior vehicles to facilitate learning in the area of "professional responsibility." The fourth …

Studies Of Legal Education: A Review Of Recent Reports, Thomas L. Shaffer, Robert S. Redmount
Studies Of Legal Education: A Review Of Recent Reports, Thomas L. Shaffer, Robert S. Redmount
Journal Articles
Early in 1972, the Carnegie Commission on Higher Education published its report on legal education. It is the most prominent study of legal education in the last decade, and typical of discourse in and about law schools—urbane, speculative, unempirical, conceptual, rarely student-centered. The authors of the Carnegie report were articulate law teachers. They wrote with their feet up and their pipes lit, without attention to facts which did not come from their considerable experience. The value of such reports is the thoughtfulness of the people who write them, and their predictive accuracy is due to the fact that people who …

Legal Education: The Classroom Experience, Thomas L. Shaffer, Robert S. Redmount
Legal Education: The Classroom Experience, Thomas L. Shaffer, Robert S. Redmount
Journal Articles
Law students learn from what is in them, from what is directed at them, and from what is around them. The following is a study of an external dimension of the law-school learning experience-the classroom. Research strategy consisted of approaching the classroom phenomenon from two perspectives; what is presented and how students perceive it.
Learning The Law-Thoughts Toward A Human Perspective, Thomas L. Shaffer, Robert S. Redmount
Learning The Law-Thoughts Toward A Human Perspective, Thomas L. Shaffer, Robert S. Redmount
Journal Articles
The history of American legal education is notable for a sparsity of ideas on how to convey learning about law. There has been even less focal understanding of what learning is and what it takes to establish a process which will prepare lawyers for their profession. A window on this history was provided in historical survey by Alfred Z. Reed in 1921 and, more recently, by Professors Preble Stolz and Calvin Woodward. It is principally their accounts of eighteenth and nineteenth century developments that we here briefly integrate and summarize. The perspective-a consideration of legal education in terms of social …

The Design Of Videotape Systems For Legal Education, Dale A. Whitman, Gerald R. Williams
Faculty Publications
Over the past 20 years in which videotape technology has been commercially available, considerable literature has offered encouragement and advice concerning its general educational applications. More recently, a developing body of literature, materials, and practices has brought videotape to the attention of legal educators. One of the chief impediments to realization of the full potential of videotape in legal education, however, is the lack of an adequate description of the necessary facilities and electronic equipment. This comment will discuss the basic uses of videotape in legal education and the physical facilities and equipment (including types, arrangement, and costs) that might …

The Clinical Law Experiment: Michigan's First Five Years, Steven D. Pepe
Law Quadrangle (formerly Law Quad Notes)
Many Michigan law alumni continue to inquire about the Clinical Law Program, now entering its fifth year of fulltime operation. Prof. Al Conard's "Letter from the Law Clinic" in the fall, 1973, Law Quadrangle Notes gave a perceptive and entertaining glimpse into some of the case situations at the clinic and the types of learning in which clinic students are engaged. This article will sketch the development and operation of our clinical experiment in legal education. A future article will explore the goals, methodology, and problems of clinical legal education. A third and final article will focus on a particular …

Report Of The Dean 1973-1974, Thomas L. Shaffer
Report Of The Dean 1973-1974, Thomas L. Shaffer
Journal Articles
My assessments of the Law School have tended more to describe developments than to state aspirations. I continue to assess things in that vein; my preference for leadership in the Dean's Office is to build on the goals which are implicit in the work of the tireless, dedicated people who teach and learn law at Notre Dame. My hope in approaching our enterprise in this way is to discover myself, and to help my colleagues discover, the power with which they serve God, the University, the community, our embattled profession, and one another. "This power in us," St. Paul said, …

The Evaluation Of A Clinical Legal Education Program: A Proposal, Junius L. Allison
The Evaluation Of A Clinical Legal Education Program: A Proposal, Junius L. Allison
Vanderbilt Law Review
Even though the Code of Professional Responsibility sets only general standards for competency, the competence of individual lawyers is now an area of active inquiry by the courts. Likewise, Legal Services are subject to regular evaluations. While these evaluations have had poor track records, the fault lies with their administration rather than their concept. If the practice of law is subject to scrutiny, it follows that schools for training the lawyers, and certainly parts of their curricula, such as clinical programs, can be evaluated." Legal education on its most basic level is preparation for a profession, the 'public profession of …
