Sex-Bias Topics In The Criminal Law Course: A Survey Of Criminal Law Professors, Nancy S. Erickson, Mary Ann Lamanna Oct 1990

Sex-Bias Topics In The Criminal Law Course: A Survey Of Criminal Law Professors, Nancy S. Erickson, Mary Ann Lamanna

University of Michigan Journal of Law Reform

This Article addresses the empirical question of whether law school curricula have advanced to the stage of integrating materials on gender-related topics into core courses, thus exposing students to gender-related topics in the law and presenting a perspective shaped by women's as well as men's experiences. We examine one of the central courses of the law school curriculum: criminal law. Although some of the attention directed to sex discrimination in law has focused on specific areas of criminal law such as rape and spouse abuse, a more systematic scrutiny of the substantive rules of criminal law and the ways in …

The Work Of A Cuny Law Student: Simulation And The Experiential Learning Process, Vanessa Merton Jan 1990

The Work Of A Cuny Law Student: Simulation And The Experiential Learning Process, Vanessa Merton

Elisabeth Haub School of Law Faculty Publications

The work you do as part of a simulation is selectively, but not exactly, the same as what you would do as a lawyer confronted with a comparable problem. By drastically shortening the time frame of the actual process, the simulation allows you to experience the consequences of your choices relatively quickly. In a simulation, you are asked to assume certain roles, and to engage in a variety of tasks, some in-role and some out-of-role (except for the ubiquitous role of "law student").

Joining Hands And Smarts: Teaching Manual Legal Research Through Collaborative Learning Groups, Thomas Michael Mcdonnell Jan 1990

Joining Hands And Smarts: Teaching Manual Legal Research Through Collaborative Learning Groups, Thomas Michael Mcdonnell

Elisabeth Haub School of Law Faculty Publications

My hypothesis was that a group of law students who research a problem together will learn legal research better than students who work individually. I further hypothesized that if the group research could be undertaken during class time under the direct supervision of the instructor and the teaching assistant, the students would be less intimidated by manual research tools and would be better prepared to work on their own. The following three-step method was employed: (1) the students read about the tool; (2) the instructor discussed the tool in class; and (3) immediately following the discussion, students went to the …

The First Year Courses: What's There And What's Not, David L. Chambers Jan 1990

The First Year Courses: What's There And What's Not, David L. Chambers

Book Chapters

At the great majority of American law schools, students begin with a set of required courses that bear the titles of the next six chapters: Procedure, Contracts, Criminal Law, Property, Torts, and Constitutional Law. The six are likely to be taught in ways that resemble each other on the surface. Each will have a "casebook" slightly heavier than a Chicago phone book. Each casebook will devote more pages to the decisions of courts of appeals than any other form of material, and assignments will come almost entirely from the casebook. In class, the professors will have an arched eyebrow for …

Clinical Realism: Simulated Hearings Based On Actual Events In Students' Lives, Samuel R. Gross Jan 1990

Clinical Realism: Simulated Hearings Based On Actual Events In Students' Lives, Samuel R. Gross

Articles

This essay describes a novel clinical format, a simulation course that is based on students' testimony about actual events in their own lives. The two main purposes of the course, however, are not novel. First, I aim to teach the students to be effective trial lawyers by instructing them in the techniques of direct examination and cross-examination and by making them sensitive to the roles of the other courtroom players: the witness, the judge, and the jury. Second, I hope to encourage the students to think about the social and ethical consequences of our method of trying lawsuits.

Kevin E. Kennedy, Joseph Vining Jan 1990

Kevin E. Kennedy, Joseph Vining

Articles

Our first encounter was on one of Kevin's many triumphant days during law school. Kevin, then a second year student, had advanced to the final round of the Campbell Competition, the moot court competition in which students brief and argue a case as if before the United States Supreme Court. I was one of the five "justices" who heard the case. The others were the dean and three distinguished appellate judges. Four students presented oral arguments and all were fine, but, Kevin's, the "Justices" agreed, was simply of a different order. Archibald Cox, when Solicitor General of the United States, …
