Law Faculty Scholarly Articles
The “law of primacy in persuasion” has been formulated as follows: The side of a controversial issue having the advantage of first position in the order of presentation is more effective in changing opinion than the side presented last, all other factors being equal. Recent experimentation has revealed that “primacy” is not “an indubitable factor in persuasion,” but occurs only under certain conditions. In this article, an effort has been made to evaluate the experimentation conducted in this area of communications research, and to determine if the conditions of the courtroom are such that order of presentation could be expected …

The problem discussed by Professor Stumpf in his book Morality and the Law can be summarized by these questions: Do we have two kinds of prescribed conduct, one prescribed by morality independent of the government, the other prescribed by government independent of morality? Or is prescription by government necessarily moral because government is necessarily moral by reason of being the government? If not, under what conditions, if any, does prescription by government become a moral prescription? Under what conditions, if any, is government, by law, a matter of expedience, not to be confused with morality?

§6.1. General. The most important development of the decade in contract law has been the gradual acceptance of the Uniform Commercial Code. Now, as over forty states have adopted the Code, another significant task is being undertaken: a revision of the Restatement of Contracts. A hurried reading of the first hundred-odd sections prompts a few general and tentative observations.

Law And Literature--A Comment, Harvey Couch, Iii
Law And Literature--A Comment, Harvey Couch, Iii
Vanderbilt Law Review
The author here examines the ways in which law and literature complement each other; legal settings providing dramatic backdrops to fine literature and literature serving to familiarize lawyers with writing style as well as the moral sentiments of the people expressed in literature. Yet law and literature need not remain distinct entities, but blend together in certain works of such authors as Hand, Camus, and Prettyman, providing, perhaps, the lawyers most enjoyable reading.

§6.1. Covenants not to compete. In the 1961 ANNUAL SURVEY, attention was called to the large number of cases involving covenants not to compete.1 In that year most of the litigation pitted employer against employee.2 During the 1964 SURVEY year two cases in which the buyer of a business attempted to enforce a covenant not to compete are worth noting. A third case,a decided in 1962, is also included as it provides the necessary background for one of this year's decisions.

Legal Education And The Demands For Stability And Change Through Law, John W. Wade
Vanderbilt Law Review
Our theme for this dedication program is "Stability and Change Through Law." The general plan has been to give consideration, first, to the demands made upon law and legal institutions to meet the basic social needs for security and order and to reach out toward the fuller realization of national ideals, while adapting to the stresses brought on by science, technology, and changing political, economic, and social patterns; and second, to the responses of law and legal institutions to these demands. The treatments of the law's response considered not only what has been done in the past and what is being …

§4.1. Introduction. None of the contract cases decided during the 1963 Survey year requires extensive comment. This conclusion probably reflects an approval of the manner in which the Supreme .Judicial Court handled the many issues presented by litigants. In reviewing a year's judicial production, it is easier to get excited about a decision that one disapproves. One trend is worthy of note. From the cases discussed in this and other chapters, it is apparent that the Court is becoming more sophisticated in its understanding and use of the Uniform Commercial Code.

Law And Liberal Education, Jacob Weissman
Law And Liberal Education, Jacob Weissman
Vanderbilt Law Review
Law, says the author, can be a useful tool in the building of a liberal education. Uniquely combining the study of past experience with the solving of present day problems, law study could very well supplement or replace traditional undergraduate courses in humanities and history of Western civilization. Nothing that thus far such changes have been made primarily at a few schools of business, the author discusses the advantages of similar use of law for liberal education in any undergraduate curriculum and, eventually, in the law schools.

§4.1. Introduction. The 1961 Annual Suroey of American Law pointed to the Uniform Commercial Code as the most significant development in the law of contracts during recent years. This statute, with its many provisions affecting the rules of offer and acceptance, consideration, unconscionable agreements and other aspects of the contractual relationship, will undoubtedly have a substantial effect upon traditional contract concepts. At the very least, there has been a shift from the Willistonian rigidity to Llewellynian flexibility in contracts involving the sale of personal property. Furthermore, with the natural tendency of some courts to reason by analogy and apply the …
