Misrepresentations In Labor Trafficking: State Laws As An Alternative Theory Of Liability For Recruiters, Hannah Garvin

When addressing labor trafficking of migrants, the focus is typically on prosecuting the traffickers directly involved in obtaining a victim’s labor, but traffickers cannot exploit labor without victims. Research has shown that recruiters, both those intending to provide labor traffickers with victims and those who have no knowledge of the subsequent exploitation perpetrated by the supposed employer, often misrepresent job opportunities to migrants. Both types of recruiters profit off of the exploitation of migrants and ultimately continue to propagate labor trafficking. The current academic discourse examining human trafficking is lacking in focus on survivors with a disability. The increased likelihood of abuse experienced by people with a disability is well documented in the research literature, and a small body of research indicates heightened sex trafficking victimization of minor girls with a disability. Yet, very little research specifically examines sex and/or labor trafficking of people with a disability, and no systematic research analyzes prosecuted cases of trafficking with disability as the focal point of analysis. More than two decades ago, the Trafficking Victims Protection Act (TVPA) established new, robust protections for immigrant victims of trafficking. In particular, Congress created the T visa, a special form of immigration status, to protect immigrant victims from deportation. Despite lofty ambitions, the annual cap of 5,000 T visas has never been reached, with fewer than 1,200 approved each year. In recent years, denial rates also have climbed. For example, in fiscal year 2020, U.S. Citizenship and Immigration Services denied 42.79% of the T visa applications that the agency adjudicated, compared with just 28.12% in fiscal year 2015. In recent years, the issue of “human trafficking,” or what some have deemed “modern slavery” has become increasingly salient in the United States. No doubt, human trafficking is a major humanitarian crisis, with the International Labor Organization estimating some 5.4 victims caught in trafficking networks for every 1,000 people in the world. And yet, the dominant discourse in the US tends to allude solely to the sex trafficking of women. This sex trafficking hysteria in the United States is the backdrop of my research.

This article provides a review and analysis of United States v. Jungers and United States v. Bonestroo, important court cases providing precedent for charging buyers of sex as traffickers in cases involving minors. The decisions in these court cases, and in subsequent cases, further solidify the presence of end-demand efforts in the form of prosecution. Yet, the decisions in these cases raise additional questions about their implications for state-level prosecution, the prosecution of buyers in cases involving adults who experience sex trafficking, and the buyers of trafficked labor. Human trafficking has become an issue for global concern. Here in the United States, the Federal government and all fifty states are taking steps to combat the pervasive problem. This study looks at the anti-human trafficking statutes of all fifty states and compares them with each other to see how each state stacks up against the other. Nebraska was the focus of the study as the unicameral has recently been enacting changes to the state’s laws against human trafficking. This paper is a detailed analysis of criminal statutes in 4 U.S. states: Arizona, Colorado, Washington, and Texas. The types of statutes analyzed are each states laws that affect human trafficking, sex trafficking, child pornography, and child prostitution. The analysis looks at statutory language which includes differences in sentencing lengths, the imposition of fines, mistake of age defense, car impounding, training for law enforcement or prosecutors, victim services and prostitution prevention and intervention accounts, elements of “force, fraud, and coercion” present, the mens rea component “knowingly” present, states that outlaw distribution of child pornography, as well as possession, criminalizing intentional …
