The Art Of Sore Losing: The Effect Of Outsider Candidates On The Democratic Nomination System, Cassidy Holzer

Abstract: The 2016 election posed a series of interesting questions about outsider candidates: Who are they? Why do they run? How do they affect the party? What party mechanisms either foster or hinder outsiders? To answer these questions, I look at every election after 1968-- the year the McGovern-Fraser reforms flipped the Democratic nomination system on its head. I classify every competitive candidate in every post-1968 election as an outsider, an establishment-like, or an establishment candidate, evaluating their political experience and reliance on small-donors. I find that Iowa and New Hampshire serve a pivotal point for all candidates, encouraging a …

This Article considers how presidential candidates use the Supreme Court as an issue in their election campaigns. I focus in particular on 2016, but I try to make sense of this extraordinary election by placing it in the context of presidential elections over the past century.
In the presidential election of 2016, circumstances seemed perfectly aligned to force the Supreme Court to the front of public debate, but neither Donald Trump nor Hillary Clinton treated the Court as a central issue of their campaigns. When asking how fake news in social media can be combated under U.S. and German law, one must first take the systems’ most fundamental differences into consideration. U.S. law is characterized by its federal structure, the interaction of state laws often with the federal, U.S. Constitution, usage of pretrial discovery, as well as the role of juries in calculating damages. In contrast, Germany, as a civil law system, is characterized by its usage of separate legal actions to acquire information, lack of pretrial discovery, and broader array of available remedies, none of which allow for punitive damages. The ability to obtain a security clearance has a wide-ranging impact from job placement to questions of fitness in a presidential election. Sustaining a functional career in intelligence, national security, and many other federal fields within the United States is nearly impossible without proper security clearance. In 2016, the importance of proper clearance evolved into a national debate as each presidential candidate staked claims that their opposition should be excluded from receiving sensitive material.

With nonviolent revolution in particular, displaced governments leave a power and governance vacuum waiting to be filled. Such vacuums are particularly susceptible to what this Article will call “strategic ideological cooptation.” Following the regime disruption, peaceful chaos transitions into a period in which it is necessary to structure and order the emergent governance scheme. That period in which the new government scheme emerges is particularly fraught with danger when growing from peaceful chaos because nonviolent revolutions tend to be decentralized, unorganized, unsophisticated, and particularly vulnerable to cooptation. Freedom, democracy and human rights are not solely the province of the West; they are universal principles. America's human rights policy sets high standards for other nations and an even higher bar for itself. Meeting the standard will require us to break from established foreign policy tradition by treating every country equally. Universal enforcement is at the very heart of the issue. The state of Arkansas is no stranger to succession crises. As early as the Reconstruction era, struggles for power emerged, and controversies surrounding the appropriate use of power among acting governors have kept the issue unsettled. One such instance, the Arkansas gubernatorial succession crisis of 1996 became yet another episode in this saga. While never fully examined, the succession crisis did influence modern politics in the state.
