The Afterlife Of Confederate Monuments, Jess Phelps, Jessica N. Owley
The Afterlife Of Confederate Monuments, Jess Phelps, Jessica N. Owley
Indiana Law Journal
As communities increasingly remove Confederate monuments from public spaces, they must decide what to do with these troubled statues. Given the recent wave of monument removal, we consider how property law and other restrictions impact community decisions on the disposition of monuments removed from public spaces on two levels—by location and future owner. In considering the fate of removed monuments, we profile potential destinations including museums, battlefields, cemeteries, and even storage. Alongside these examples, we discuss how laws constrain (or fail to constrain) the options for new owners and the restrictions on where monuments can be relocated. Even where laws …
Collaborative Constructions: Designing High School History Curriculum With The Lost & Found Game Series, Owen Gottlieb, Shawn Clybor
Collaborative Constructions: Designing High School History Curriculum With The Lost & Found Game Series, Owen Gottlieb, Shawn Clybor
Articles
This chapter addresses design research and iterative curriculum design for the Lost & Found games series. The Lost & Found card-to-mobile series is set in Fustat (Old Cairo) in the twelfth century and focuses on religious laws of the period. The first two games focus on Moses Maimonides’ Mishneh Torah, a key Jewish law code. A new expansion module which was in development at the time of the fieldwork described in this article that introduces Islamic laws of the period, and a mobile prototype of the initial strategy game has been developed with support National Endowment for the Humanities. The …

Playing At The Crossroads Of Religion And Law: Historical Milieu, Context And Curriculum Hooks In Lost & Found, Owen Gottlieb
Playing At The Crossroads Of Religion And Law: Historical Milieu, Context And Curriculum Hooks In Lost & Found, Owen Gottlieb
Articles
This chapter presents the use of Lost & Found – a purpose-built tabletop to mobile game series – to teach medieval religious legal systems. The series aims to broaden the discourse around religious legal systems and to counter popular depiction of these systems which often promote prejudice and misnomers. A central element is the importance of contextualizing religion in period and locale. The Lost & Found series uses period accurate depictions of material culture to set the stage for play around relevant topics – specifically how the law promoted collaboration and sustainable governance practices in Fustat (Old Cairo) in twelfth-century …

Lost Campbelltown Heritage, Ian C. Willis
Lost Campbelltown Heritage, Ian C. Willis
Faculty of Law, Humanities and the Arts - Papers (Archive)
Campbelltown and surrounding areas have lost much in the way of their local heritage. Heritage is what the community considers of value at present and is worthy of handing on to the next generation. The loss of Campbelltown's heritage is part of the story of the urban growth of the town and surrounding area. Andrew Allen has started to detail the loss of Campbelltown heritage buildings that coincided with a period of incredible urban growth the Campbelltown LGA in his history blog The History Buff. Campbelltown like other communities has gone through loss and renewal, and some are only interested …
Jewish Games For Learning: Renewing Heritage Traditions In The Digital Age, Owen Gottlieb
Jewish Games For Learning: Renewing Heritage Traditions In The Digital Age, Owen Gottlieb
Articles
Rather than a discontinuity from traditional modes of learning, new explorations of digital and strategic games in Jewish learning are markedly continuous with ancient practices. An explication of the close connections between traditional modes of Jewish learning, interpretive practice, and gaming culture can help to explain how Jews of the Digital Age can adopt and are adapting modern Games for Learning practices for contemporary purposes. The chapter opens by contextualizing a notion of Jewish Games and the field of Games for Learning. Next, the chapter explains the connections between game systems and Jewish traditions. It closes with a case study …

Interpreting, Stephanie Jo Kent
Interpreting, Stephanie Jo Kent
Doctoral Dissertations
What do community interpreting for the Deaf in western societies, conference interpreting for the European Parliament, and language brokering in international management have in common? Academic research and professional training have historically emphasized the linguistic and cognitive challenges of interpreting, neglecting or ignoring the social aspects that structure communication. All forms of interpreting are inherently social; they involve relationships among at least three people and two languages. The contexts explored here, American Sign Language/English interpreting and spoken language interpreting within the European Parliament, show that simultaneous interpreting involves attitudes, norms and values about intercultural communication that overemphasize information and discount …

THE Straits of Malacca and Singapore Strait have been vital shipping routes for international trade for hundreds of years. The region around the Straits of Malacca and Singapore Strait is steeped in a long and continuous history of trade, shipping, colonisation and the race towards attaining political and economic supremacy, both before and during the age of European dominion.
The Straits of Malacca was initially known as the “Sea of Malayu”. The first reference to the “Sea of Malayu” was from an Arabic document dating back to the 9th century AD, noting the Malay influence in the region. Both the …

Last week the New South Wales Independent Commission Against Corruption (ICAC) began investigating a political donation of A$18,000 made by Nathan Tinkler’s Buildev corporation.
The 2010 donation helped fast-track approval for 1,400 medium-density homes in Sydney’s western suburb of North Richmond. Local residents have long been opposed to the development; they claim it will choke already congested roads in and out of the area. But recent news reports have missed a crucial aspect of the development proposal: it will obliterate a site of national heritage significance.
Gaps, Issues And Prospects: International Law And The Protection Of Underwater Cultural Heritage, Lowell Bautista
Gaps, Issues And Prospects: International Law And The Protection Of Underwater Cultural Heritage, Lowell Bautista
Lowell Bautista
The protection and preservation of underwater cultural heritage is becoming an increasingly important issue as technologies develop which allow for its exploitation. The UNESCO Convention on the Protection of Underwater Cultural Heritage ("UCH Convention") is an important step in the international regulation of this resource. This paper examines the theoretical and historical antecedents of the UCH Convention, and outlines the Convention's most significant provisions. Specifically, this paper examines how the UCH Convention protects underwater cultural heritage in six areas: internal waters, the territorial sea, the contiguous zone, the exclusive economic zone, the continental shelf, and the Area. This paper then …

Entrusting The Commons: Agricultural Land Conservation And Shared Heritage Protection, Angela Labrador
Entrusting The Commons: Agricultural Land Conservation And Shared Heritage Protection, Angela Labrador
Angela M Labrador
The start of the twenty-first century is marked by new levels of globaliza- tion, environmental degradation, and social conflict that are endangering the cultural landscapes and agrarian heritage of rural areas. In the wake of these threats, heritage profes- sionals are imagining new, holistic models for shared cultural and natural heritage protec- tion that support active community engagement around issues of cultural identity, material and ecological sustainability, and shared ethical values. Agricultural land conservation is fertile terrain in which to theorize how heritage protection can contribute to the mobiliza- tion of social cohesion to restore a balanced human ecology. Agrarian …

River Rats, Megan M. Carpenter
River Rats, Megan M. Carpenter

[Excerpt] "At their essence, river rats are aquatic rodents. They live in, on, and near the water and depend upon it for their livelihood. My family is, and have always been, river rats.
My mother's family grew up on the west bank of the Tygart River in north central West Virginia. My great grandparents used this land as a summer camp: a place to ride horses named Honey and Chief; a place to host parties; a place to plant flower bulbs from Holland. My grandfather spent most of his childhood working the land for his parents. While his older brother …

The concept that the powerful and wealthy have the absolute obligation to offer political, financial, and social liberation to those at the margins of society should have special importance to those who are lawyers and professionals of color. People spend considerable time working through, working in, and centered in the dominant, or caucasian European culture. The legal system regularly fails to see, accept, realize, or believe when truth is presented at the margins. Nonetheless, it is at the margins that true legal and personal reform take place. Even in a friendly environment, where people are encouraged to step outside the …

The Impact Of Family Paradigms, Domestic Constitutions, And International Conventions On Disclosure Of An Adopted Person's Identities And Heritage: A Comparative Examination, D. Marianne Brower Blair
Michigan Journal of International Law
This article examines the extent to which international law has and will potentially influence the direction of the reform and implementation of adoption disclosure norms. Though it does not yet appear that international law mandates recognition of an absolute right to identifying information when such disclosure is opposed by a birth parent or adoptee, examination of these conventions and the response of the international community underscores the critical importance of identifying information to many adoptees, and a growing movement to afford primacy to their interests.

Of Seeds And Shamans: The Appropriation Of The Scientific And Technical Knowledge Of Indigenous And Local Communities, Naomi Roht-Arriaza
Michigan Journal of International Law
This article recasts the debates over access to, and control over, genetic and biological knowledge and resources in terms of the appropriation of indigenous and local communities' knowledge and resources. It first discusses recent examples of appropriation as currently conducted by global biotechnology, pharmaceutical, and agribusiness corporations and their associates in Northern universities, seed and gene banks, and research centers. Second, it describes and exposes the mechanisms of appropriation by focusing on the limited and culturally determined definitions of what is "wild" as opposed to "cultivated," what is "knowledge" and who can possess it, and what are "innovations" and "inventions." …

Nothing Lasts Forever: Toward A Coherent Theory In American Preservation Law, Kathryn R.L. Rand
University of Michigan Journal of Law Reform
Part I of this Note examines Grégoire's liberty-based theory of preservation and discusses the three rationales that underlie his theory. Part II examines the development of preservation law in the United States, following it through three stages: patriotic inspiration, aesthetic merit, and community. Part III examines Italy's experience with preservation in order to identify and discuss several problems inherent in preservation law. Part IV suggests preservation rationales for courts and legislators to consider and identifies problems for them to avoid.
