This article explains that the United Nations Committee against Torture (hereinafter “the Committee”) has played a significant role in addressing the serious problem of torture in health care settings. In particular, the Committee’s Concluding Observations and Recommendations under Article 19 of the Convention against Torture have been an important tool in this area. The Committee has used these means to remind States parties of their obligation to provide adequate health care for persons held in detention centers and prisons, to address abuses and poor conditions in mental health institutions and psychiatric facilities, and to denounce the practice of punishing or …

Challenges To Freedom Of Expression Within The Inter-American System A Jurisprudential Analysis, Claudio Grossman

Freedom of expression is a "cornerstone upon which the very existence of a democratic society rests" [citation omitted]. Its importance takes on a special meaning in the Western Hemisphere where numerous societies are building and developing democracies while coping with the legacy of authoritarianism, which exercised a profound institutional and cultural influence in the region. This article critically examines the Inter-American system of Human Rights, systematizing its jurisprudence while providing an analytical framework designed to fully realize this essential human right. Finally, this article proposes a series of measures to help achieve that important objective.

The Inter-American system is a combination of human rights norms and supervisory institutions within the Americas. The applicable rules consist primarily of the American Declaration on the Rights and Duties of Man ("American Declaration") and the American Convention on Human Rights ("American Convention"). The institutions involved are the organs responsible for supervising compliance with the established rules: the Inter-American Commission on Human Rights ("the Commission") and the Inter-American Court of Human Rights ("the Court"). The system performs supervisory functions basically through country reports adopted by the Commission which describe the overall human rights situation in a country and decisions in …

The people of Awas Tingni did not set about to forge an international legal precedent with implications for indigenous peoples throughout the world, yet that is what they have done. Awas Tingni is one of numerous Mayagna, or Sumo, indigenous communities in the isolated Atlantic Coast region of Nicaragua. The Community has sought simply, but doggedly, to be secure in the peaceful possession of traditional lands. It has achieved a major step toward that end, and more.
