Tribe V. Rattler, 85-Ap-10 (Blkft. Tr. Ct. App., Nov. 27, 1985), Blackfeet Appellate Court
Court Decisions
In the Blackfeet Tribal Court of Appeals, the Court affirmed a lower court conviction of a Defendant for Assault and Battery after the Court found that there was sufficient evidence for the judge to find beyond a reasonable doubt that the defendant committed the crime. The Appellant posed otherwise. The prosecution presented evidence on ability, motive, and intent, which are all essential elements of the crime under Blackfeet Tribal Law and Order Code, Ch. 5, Sec. 2, “Any Indian who shall willfully strike another person...shall be deemed guilty of Assault and Battery.”

Survey Of Washington Search And Seizure Law, Justice Robert F. Utter
Seattle University Law Review
This Survey is designed to assist lawyers and judges who must argue and resolve search and seizure issues in Washington State. The Survey summarizes the controlling state and federal cases on search and seizure law and uses as an additional reference W. LAFAVE, Search and Seizure: A Treatise on the Fourth Amendment (1978). Washington courts are likely to analyze future search and seizure issues under both the fourth amendment and Washington Constitution article I, section 7. The difference in wording between the two provisions is substantial, suggesting different degrees or types of privacy protection. This Survey summarizes the predominant treatment …

The defendant-first approach advocated in this Article is more difficult to implement than either the current policy admitting any proffered expert testimony or the exclusionary reform advanced by many commentators. It requires some mechanism for apprising the state when the defense intends to use clinical prediction testimony. When no such intent is registered, it demands that any other clinical testimony, whether offered by the state or the defense, be carefully monitored to insure that the dangerousness issue is not raised; it may require revamping other procedures as well.2 " But the defendant-first approach also presents the factfinder with the most …

Money debts are frequently paid by checks and evidenced by notes subject to Article Three of the Uniform Commercial Code. Financial institutions and other creditors ordinarily take these instruments with the expectation that they will be paid on time without resort to litigation. This expectation fails when the debtor or some other obligor on the instrument claims that its signature was unauthorized or that there is a defense against payment. This Article analyzes the Uniform Commercial Code rules concerning burdens of proof that apply to these disputes and gives consideration to related procedural and evidentiary questions. It concludes with some …
