Privacy Or Safety? The Use Of Cameras To Combat Special Ed Abuse, Sarah M. Benites
University of Massachusetts Law Review
Self-contained classroom students face abuse from educators at disproportionate rates compared to general education students. To combat the abuse, several jurisdictions, including Massachusetts, have proposed or enacted bills enabling cameras to be placed in self-contained classrooms. This has sparked privacy concerns, particularly regarding whether the usage would amount to an infringement on the Fourth Amendment rights of students and educators. This note argues that surveillance is an ineffective deterrent to prevent violent and abusive behavior and should not justify bypassing potential privacy and constitutional violations. The aim of the study was to identify the procedural and objective legal principles specific to the deportation of foreigners that need to be considered within the legal framework of deportation. The study relied on a descriptive analytical approach, which involved observing, analyzing, and highlighting the elements of the subject. It concluded that the purpose of deporting foreigners is the state's right to expel non-citizens from its territory for reasons related to its internal or external security and in accordance with applicable laws. Privacy rights are under assault, but the Supreme Court’s judicial intervention into the issue, starting with Katz v. United States and leading to the Carpenter v. United States decision has created an inconsistent, piecemeal common law of privacy that forestalls a systematic public policy resolution by Congress and the states. In Gonzales v. Raich, the United States Supreme Court upheld the application of the federal Controlled Substances Act to bar the use of state-grown marijuana for instate personal medical use. In so doing, the Court ratified the expansion of Congress’ commerce power beyond any known limits. It abandoned the “substantial effects” test that it had used since 1937 and applied the “rational basis” test. This Article traces the historical development of Congress’ enumerated powers from the earliest cases, emphasizing the expansive view of commerce power found in Gibbons v. Ogden. Mental Health is an ever-increasing topic of discussion in several sectors of today’s society. One career, law enforcement, seems to correlate job-related responsibilities with rising numbers in post-traumatic stress disorder, depression, and anxiety. A group of nursing students from Olivet Nazarene University sought to incorporate their understanding of stressors associated with the helping profession of law enforcement while researching cost-effective, evidence-based, self-care methods that have a proven ability to reduce signs of depression and anxiety. One such method is the practice of mindfulness.

Purpose: The purpose of this qualitative phenomenological study was to describe citizen perceptions of the impact of community policing in 2 selected, ethnically diverse, low-income communities that have national safety ratings between 0% and 25%. The study explored the 8 pillars of community policing: partnerships, problem solving, procedural fairness, proscribed scope, protection, professionalism, purpose, and principles and their impact on citizens’ perception of their local law enforcement agencies.
Methodology: The study was qualitative with a phenomenological approach to research.

This article reports on the second stage of a national study of how the effects of alcohol and other drugs are treated by criminal laws and the criminal justice system. Based on a mixed methods analysis of more than 300 appellate court decisions from all Australian jurisdictions handed down in the period 2010-2014, we identify the multiple points at which legal significance is attached to evidence that the accused, the victim or a witness was 'intoxicated' at the time of the alleged commission of a criminal offence. By 2020 there will be billions of “things” connected through the “Internet of Things.” These smart devices built within our homes, cars, smartphones, clothing, and accessories present new possibilities for technological surveillance for law enforcement. This network of smart devices also poses a new challenge for a Fourth Amendment built around “effects.” The constitutional language protecting “persons, houses, papers, and effects” from unreasonable searches and seizures must confront this change. As documented by several scholars, such as Wulff (1889) and Navarro Tomás (1938), Eastern Andalusian Spanish (henceforth EAS), neutralises most consonants in coda position. However, there is no consensus on the effects that consonant deletion has on surrounding vowels. Researchers of EAS, such as Mondéjar Cumpián (1979), have distinguished between two types of vowels in this variety of Spanish: vowels in coda position and vowels followed by a deleted consonant. However despite the neutralisation of most consonants in coda position in EAS, phonemic value has only been given to vowels preceding deleted /s/, as in Salvador Caja (1950) and Carlson …

This article seeks to explore how the Australian Manufacturing Workers Union (AMWU) represented the Howard Government's 'WorkChoices' legislation in its official journal, AMWU News. Applying Kelly's (2008) study of industrial relations 'frames,' this paper seeks to explore the AMWU's characterisation of the legislation, the modalities of resistance it encouraged, and the level and nature of support given to the Australian Labor Party (ALP). It is argued that a consistent, total but untheorised vision of the negative impacts and key players of the WorkChoices legislation is forwarded, along with a campaign of resistance that is largely oriented to the political arena. …

If women outnumber men in graduate schools and are entering professional and other workplaces in unprecedented numbers, and if Title VII has aimed to eradicate workplace discrimination for almost fifty years, why are women still so woefully underrepresented at the highest levels of power, leadership, wealth, and prestige in the contemporary workplace? This Article is about abusive speech in the workplace. It explores how the expression of bias in the workplace has evolved and been shaped by anti-discrimination legislation and jurisprudence. Effect Precedes Cause: Kant And The Self-In-Itself, David G. Carlson

This article describes the metaphysics of Kant, according to which we never know the Thing In Itself but only the appearance of it. When applied to selfhood (which is a “thing”), Kant implies that we never know what motivates us to do what we do. Our reasons are after-the-fact apologies to justify our acts. For that reason the “cause” of our deed always (that is to say, our reasons) follows the deed itself. Effect precedes cause, on Kantian metaphysics.
