Distraction Or Necessity: A Post-Pandemic Examination Of Digital Devices In The Law School Classroom, Marcia Goldsmith, Karen Sanner

Digital devices are a constant presence in the law school classroom; however, faculty members and students report mixed feelings about the role of digital devices in the classroom learning experience. While data suggests that use of digital devices has a deleterious effect on acquiring and retaining information, digital device usage is sometimes helpful and often necessary to facilitate learning in the modern law school classroom.

“Implicit bias” describes the unconscious stereotypes and attitudes that all humans have hard wired in their brains. It can go awry when we have implicit biases based on race or ethnicity that are unrealized and unfair. Gen Z students are famously diverse, and they are proud of their diversity, but they are also uncomfortable talking about sensitive topics, including implicit bias. Legal Practice professors are in a unique position to work with their Gen Z students to identify and eliminate implicit bias because of our year-long course and the interactive nature of our class. [Excerpt] "At the State House, attention has returned to New Hampshire's so-called 'divisive concepts' law. The law, enacted in 2021, bars public K-12 teachers from engaging in certain forms of instruction on issues of race, gender, and other forms of discrimination. The Legislature is presently considering bills both to repeal the law and to extend it to the higher education context.

While a doctoral student studying andragogy (the art and science of adult education), the author noticed what appeared to be similarities in the techniques used by trial lawyers and those used by teachers of adults. To better understand these similarities, the author conducted a study investigating the degree, if any, to which successful attorneys incorporate adult learning instructional approaches into the way they conduct trials. Specifically, the study aimed to uncover whether successful trial attorneys utilize strategies in the courtroom that are similar to the andragogical approaches used by teachers of adult learners. The modern lawyer cannot practice without some deployment of technology; practical and ethical obligations have made technological proficiency part of what it means to be practice-ready. These obligations complicate the question of what constitutes best practices in law school.

Today’s law schools are filled with students who are digital natives who don’t necessarily leverage technology in maximally efficient ways, and faculty who span multiple generations, with varying amounts of skepticism about modern technology. New law students traditionally learn better when they can connect what they are learning to a familiar non-legal experience. Therefore, the use of an analogy, which can be defined as a comparison showing the similarities of two otherwise unlike things to help explain an idea or concept, is an obvious way to facilitate a student’s connection between the new and what is already known. Reflections on lessons learnt during online teaching during COVID-19. Despite the difficulties of the term, I realized that online teaching had certain strengths that traditional face-to-face teaching formats lacked. This started me on the path to adapting online teaching practices to improve our current modes of teaching, such as using online tools to improve interactivity, and reduce bias in interacting with students. I also started reconsidering whether our traditional classroom structures are indeed the best way to teach. While my experiences are based on teaching law, I believe that these points are also applicable to teaching in other disciplines.
