The Status Of International Treaty In The United Arab Emirates Constitution, Wael Allam
The Status Of International Treaty In The United Arab Emirates Constitution, Wael Allam
UAEU Law Journal
Like other countries, the United Arab Emirates (UAE) needs to enter into treaties to regulate its relations with States and the international community. Indeed, the UAE is a party to several international treaties in several areas; including labor, human rights, aviation, international humanitarian law, judicial cooperation, the fight against organized crime and human trafficking, etc. In light of the existence of these numerous international treaties concerning the UAE, the question arises about the status of international treaty in the United Arab Emirates; i.e., what is the binding force of the International Treaty in relation to other legal rules? What is …

Private Governance Responses To Climate Change: The Case Of Global Civil Aviation, Michael P. Vandenbergh, Daniel J. Metzger
Private Governance Responses To Climate Change: The Case Of Global Civil Aviation, Michael P. Vandenbergh, Daniel J. Metzger
Vanderbilt Law School Faculty Publications
This Article explores how private governance can reduce the climate effects of global civil aviation. The civil aviation sector is a major contributor to climate change, accounting for emissions comparable to a top ten emitting country. National and international governmental bodies have taken important steps to address civil aviation, but the measures adopted to date are widely acknowledged to be inadequate. Civil aviation poses particularly difficult challenges for government climate mitigation efforts. Many civil aviation firms operate globally, emissions often occur outside of national boundaries, nations differ on their respective responsibilities, and demand is growing rapidly. Although promising new technologies …

The Road To Yamoussoukro, Vivica Brown
Journal of Comparative Urban Law and Policy
Air transportation plays an important role in any country’s evolution because it accelerates the convergence of goods and people. Creating a cooperative air transport system could unlock the potential for a long awaited, remarkable economic growth in Africa. “The African aviation market is perhaps one that has the most potential for growth out of the global regions, due to it being a comparatively young industry and servicing a large and rapidly developing population.” Africa is home to 15.96% of the world’s population, over 1.1 billion people, but it still accounts for less than 4% of the global air service market. …

The German Rocket Jet And The Nuclear Programs Of World War Ii, Max Lutze
The German Rocket Jet And The Nuclear Programs Of World War Ii, Max Lutze
Honors Theses
German military technology in World War II was among the best of the major warring powers and in many cases it was the groundwork for postwar innovations that permanently changed global warfare. Three of the most important projects undertaken, which were not only German initiatives and therefore perhaps among the most valuable programs for both the major Axis and Allied nations, include the rocket, jet, and nuclear programs. In Germany, each of these technologies was given different levels of attention and met with varying degrees of success in their development and application. By the end of the war, both rockets …

Exploits Of A Helicopter Tv Journalist, Jerry Foster
ERAU Prescott Aviation History Program
Jerry Foster was the first TV helicopter pilot/reporter in the country; the first to go live over the scene of a breaking story. High speed police chases; devastating floods and daring rescues now splashed all over cable TV, started in the early 1970s in Phoenix. Hear this fascinating story from a remarkable aviator who won the Harmon Trophy for his flying exploits. What he pioneered would later be copied by medical and law enforcement agencies throughout the country leading to the saving of countless lives.
Transnational Legal Practice, Laurel Terry
Transnational Legal Practice, Laurel Terry
Faculty Scholarly Works
This 2015 Year-in-Review article continues the tradition of collecting and publicizing the developments that occurred during the year related to transnational legal practice (TLP). This year’s article builds on the work set forth in the 2014 Year-in-Review.
The 2014 TLP Year-in-Review provided a departure from the Year-in-Review’s typical method of presentation by identifying two categories of what that article called “TLP-Nets.” One group of TLP-Nets is nationally based and the other is inherently transnational. The 2014 article identified examples of TLP-Nets and highlighted the meeting points and relationships that facilitate border-crossing for the variety of actors involved in TLP policy-making …
The Impact Of Governmental Regulation On Air Transportation, Hamilton Desaussure
The Impact Of Governmental Regulation On Air Transportation, Hamilton Desaussure
Akron Law Review
THE FOURTH ANNUAL International Law Symposium held at the University of Akron on November 13 and 14, 1975, concerning the impact of governmental regulation on air transportation, presented the issue of whether too much regulation of the domestic airline industry exists, and if so, how such regulation can be curtailed without diminishing route stability or damaging the public interest in a broad, well-integrated air transport network. This subject is of great importance to the traveling public. It is an issue which has drawn the particular attention of Congress.
Uncrashworthy Aircraft And The Manufacturer's Liability, Robert Kent
Uncrashworthy Aircraft And The Manufacturer's Liability, Robert Kent
Akron Law Review
The concept of crashworthiness has now been accepted by a resounding majority of states if not all states. Although widely used since Larsen in automobile crash cases, crashworthiness has only recently been successfully applied to the aircraft. Perhaps this foreshadows the future. The automobile differs only slightly from the helicopter and the airplane. All are products; all are accepted modes of transportation; and all may be designed to be reasonably safe. The doctrine of crashworthiness has been so widely accepted with respect to the automobile that the time has now arrived for the doctrine to be accepted in the field …

Assessing The Commercial Aviation Impact Of The Year 2000 Open Skies Agreements Between The United States And African Countries With Longstanding Flights, Tyler B. Spence, Micah Walala, Richard O. Fanjoy
Aviation / Aeronautics / Aerospace International Research Conference
The U.S. started a comprehensive campaign towards Open Skies agreement in 1992. The major benefits of Open sky agreement are reported to include increase of passenger and cargo volume between partners. This study analyzes passenger traffic and cargo volume between six African countries that have had commercial aviation with the U.S. since 1990 to 2014, and with direct flights between them. Two of the countries have had no Open Skies agreement with the U.S., while four have had Open Skies agreement beginning in 2000. A multi linear modeling process was applied on the two categories to determine whether there is …

Abstract
Drone technology is evolving rapidly. Microdrones—what the FAA calls “sUAS”—already on the market at the $1,000 level, have the capability to supplement manned helicopters in support of public safety operations, news reporting, and powerline and pipeline patrol, when manned helicopter support is infeasible, untimely, or unsafe.
Larger drones–"machodrones”–are not yet available outside battlefield and counterterrorism spaces. Approximating the size of manned helicopters, but without pilots, or with human pilots being optional, their design is still in its infancy as designers await greater clarity in the regulatory requirements that will drive airworthiness certification.
This article evaluates drone technology and design …

Sms - Reaching Beyond Low Hanging Fruit, Stewart Schreckengast
International Journal of Aviation, Aeronautics, and Aerospace
Human nature predisposes us to maximize our accomplishments while making a concerted effort to balance resource expenditures so we achieve an optimal return on our efforts. All too often what this really means is that we do the easy things that can be done with minimal effort; we grab the low hanging fruit. Traditional incident investigation methodology enables us to reach beyond the obvious reactive solutions. The incident investigation methodology is also an exceptional foundation for safety management system (SMS) development because it supports a holistic approach to reaching the fruit that is ripe for harvesting, the deficiencies that become …
Legal Issues Concerning The Eu Unilateral Aviation Ets: A Chinese Perspective, Wenqiong Liang, Liying Zhang
Legal Issues Concerning The Eu Unilateral Aviation Ets: A Chinese Perspective, Wenqiong Liang, Liying Zhang
South Carolina Journal of International Law and Business
Since January 2012, carbon emissions from international aviation have been formally included in the European Union Emission Trading Scheme (EU ETS). Airlines from outside the EU have struggled to find an escape from this arguably unfair decision. China, the United States, Russia, India, and representatives from nineteen other countries signed the Moscow Joint Declaration in February of 2012 to demonstrate opposition to the EU’s unilaterally enacted aviation carbon tax. Originally, the EU had no intention of canceling or suspending its plan to tax the aviation industry’s carbon emissions; however, after international pressure from a number of opposing countries and airlines, …

The Environmentally Conscious Skies: Did The European Union’S Game Of Brinksmanship Lead To A Viable Global Plan For Emissions Trading In Aviation?, Darren Prum, Kathryn Kisska-Schulze
Darren A. Prum
Effective January 1, 2012, the European Union (EU) instituted the first emissions trading scheme (ETS) for aviation which affected the domestic and international commercial airline industry flying into and out of the EU. The EU established the ETS to counter the global aviation sector’s role in releasing greenhouse gas (GHG) emissions; however, such movement was met with heavy opposition by foreign countries, the International Civil Aviation Organization (ICAO), various commercial airlines and the Air Transport Association of America (ATA). This paper analyzes the legality of the EU’s unilateral ETS approach with respect to the commercial airline industry, examines the subsequent …

R2dford: Autonomous Vehicles And The Legal Implications Of Varying Liability Structures, Alexander P. Herd

The World Health Organization estimates that by 2030, traffic accidents will be the fifth leading cause of death in the world. Thus when Google announced that it had designed an autonomous car which could reduce traffic accidents by as much as ninety percent, there was cause for excitement. Some states have already started legislation to permit the use of autonomous cars in anticipation of the release later this decade. Courts and lawmakers need to consider who will be liable when the car that drives itself crashes. Standards used in aviation and naval cases regarding auto-pilot can be applied to the …
The Use Of Aviation Accident Reports By Civil Litigants: The Historical Development Of 49 U.S.C. Section 1441(E), Walter A. T. Welch Jr., John E. Faulk
The Use Of Aviation Accident Reports By Civil Litigants: The Historical Development Of 49 U.S.C. Section 1441(E), Walter A. T. Welch Jr., John E. Faulk
Pepperdine Law Review
When aviation accidents occur, the National Transportation Safety Board conducts an investigation to determine the conditions, circumstances, and ultimately the probable cause of the accident. There is a federal statutory privilege which renders these reports, as well as testimony from the attending investigator, inadmissible as evidence in any suit or action arising from the accident. However, certain judicially created exceptions have arisen which permit portions of the report and certain investigator testimony to be admitted into evidence. The authors delineate and analyze these exceptions as they discuss the trend toward increased report and testimony admissibility. The authors conclude with a …
