Acts Of Sovereignty In Light Of Administrative And Constitutional Juisprudence In Palestine, Osayd Awawda, Bassam Qawasmeh
BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية
This paper examines the concept of acts of sovereignty within the Palestinian legal system by analyzing its application in administrative and constitutional adjudication, particularly in cases arising from the 2021 presidential decree postponing the general elections. The paper presents the arguments advanced by the parties before the administrative courts and the Supreme Constitutional Court, and evaluates the extent to which the judicial rulings align with constitutional principles, especially the right to litigation and the right to political participation, including voting and candidacy. The paper also discusses the theoretical and practical foundations for excluding acts of sovereignty from judicial review, and …

Al Shura In Light Of The Concept Of Reality, A Historical, Jurisprudence And Legal Study, Fawzi Adham
BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية
This research undertakes an in-depth study of the concept of Shura (Consultation) in Islam from historical, jurisprudential and legal perspectives. It begins by reviewing the concept itself, starting with a realistic understanding of it. This involves defining Shura in its current form, presenting the views of Islamic jurists on the matter, highlighting the methodological flaws in the current understanding, and offering a corrective approach to the pre-Islamic tribal view of Shura. The research also distinguishes between Shura and the concept of Mashurah. Furthermore, it presents the political concept of Shura based on the era of Caliphs Alrashidin, the Umayyad and …

Mediation As A Mechanism For Resolving Family Disputes In Lebanon: An Analytical Study Of Current Practice And Development Prospects, Amer El Masry
BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية
This study examines the effectiveness of mediation as a mechanism for resolving family disputes in Lebanon, with a particular focus on the gap between the legal framework governing mediation and its practical application. The research addresses the extent to which mediation, in its judicial and consensual forms, can provide effective and fair solutions to family disputes within a legal system characterized by multiple personal status laws, diverse judicial authorities, and the absence of a specialized framework for family mediation. It further explores challenges related to the protection of vulnerable parties, the balance of power between disputants, institutional integration, and public …
The State’S Responsibility To Prevent And Investigate Violations Of The Right To Life In The Beirut Port Explosion, Ali Wehbi Dib
The State’S Responsibility To Prevent And Investigate Violations Of The Right To Life In The Beirut Port Explosion, Ali Wehbi Dib
BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية
The right to life is recognised in International Human Rights Law (IHRL) as the "supreme right." It is considered a jus cogens norm, fundamental for both individuals and society as a whole. IHRL provides a general guarantee of the right to life. To effectively protect it, the state must take all feasible measures to prevent violations of the right to life and to respond to them. This includes investigating incidents and, when appropriate, prosecuting and punishing those responsible.
The Beirut Port explosion on 4 August 2020 was one of the most powerful non-nuclear explosions in history. It resulted in the …

By using the descriptive qualitative methodology, this research article draws data from secondary sources which includes; academic journals, news reports, as well as international legal instruments to analyze the moral trajectory of the conflict. This research begins with jus ad bellum, to assess Ethiopia’s government justification in declaring conflict within Tigray. From Minimum To Meaningful: A Use Of Force Training Regimen For Rural Police Departments, Joseph Corley
From Minimum To Meaningful: A Use Of Force Training Regimen For Rural Police Departments, Joseph Corley
Dissertations, Theses, and Projects
This paper examines how small and rural law enforcement agencies can improve use of force training despite limited staffing, budgets, and training opportunities. Current Minnesota POST Board minimum standards establish baseline requirements but allow significant variation in how agencies develop and deliver training, contributing to inconsistent officer preparedness and skill retention. Drawing on current research in police training, motor skill retention, and scenario based learning, this paper argues that infrequent, skills based training is insufficient for preparing officers to manage dynamic, high risk encounters. The paper proposes an evidence based training regimen centered on two department led use of force …

Systematic Review Of The Institutionalization Of Service Learning In Higher Education, Wilmer Hernan Cruz Gutierrez
ASEAN Journal of Community Engagement
An increasing number of universities are integrating service-learning (SL) to fulfill their social mission. However, sustainable institutionalization of SL remains a persistent challenge. This study identifies and analyzes the factors, actors, and strategies that drive and inhibit SL institutionalization in higher education. Using the PRISMA 2020 guidelines, a systematic literature review analyzed 52 documents from seven academic databases (including WoS, Scopus, and ERIC). The findings were grouped into three sections: cultural (integration into institutional values/missions), process (articulation within teaching, research, and outreach), and structural dimensions (dedicated support entities). The results obtained reveal a reciprocal relationship where cultural alignment enables processual …

Rethinking The Legal Status Quo In Cyberspace To Legally Attribute State Responsibility, And Enhance Accountability And Deterrence, Dan Efrony
International Law Studies
The absence of formal legal attributions of State responsibility for malicious cyber operations reflects a strategic choice by influential States—foremost the United States and the United Kingdom—rather than doctrinal certainty. So long as States avoid creating legal rules for attribution, they entrench cyberspace as a legal gray zone and expose the limits of collective attribution as a governance mechanism. This article identifies probative and institutional impediments in the secondary rules of attribution: the effective control test is difficult to satisfy for proxy cyber operations, the lack of an authoritative standard of proof enables plausible deniability, and, absent consent, States remain …

Reinforcing Media Governance In Indonesian Dynamic Cyber Space, Poppy Setiawaty Nurisnaeny, Hendra Kaprisma, Chrisna Yudhawinata, Sudirman Sudirman
International Review of Humanities Studies
Following the rapid change in technology development, the Indonesian mass media have undergone a digital transformation. This digital mass media and its users have evolved, assimilated, and integrated themselves to fit in the cyber world. This distinguishing feature distinguishes them from traditional mass media. The cyber environment's infinite international boundaries are both advantageous and disadvantageous, as it is difficult to govern digital activity outside Indonesia's jurisdiction. This unregulated environment became a breeding ground for cybercrime, making the digital space unsafe for individuals and threatening national security. In response to this issue, the Indonesian government has enacted various laws and policies, …
The Indonesian Conjunction Dan ‘And’ And Its Chinese Correspondences: A Corpus-Based Approach To Syntactic And Register Variation, Hatmi Idris
International Review of Humanities Studies
This study examines how the Indonesian conjunction dan ‘and’ is rendered in Chinese across syntactic units using a corpus-based contrastive approach. Focusing on children’s books, classic novels, and online news, it analyzes coordination at word, phrase, and clause level from a syntactic and register perspective. Findings show that dan ‘and’ does not correspond to a single Chinese form. At the word and phrase level, nominal coordination employs hé (和) ‘and’, yǔ (与) ‘and’, and yǐjí (以及) ‘as well as’ , with formal news discourse favoring yǔ (与) ‘and’ and yǐjí (以及) ‘as well as’. In verbal coordination, bìng (并) ‘furthermore’ …

Persuasive Strategies In Umrah Marketing On Social Media: A Comparative Study Of Arabic And Indonesian, Stevania C. Asahri
International Review of Humanities Studies
This study examines persuasive strategies in Arabic- and Indonesian-language Umrah marketing flyers circulated on social media. As public interest in Umrah continues to grow, travel agencies increasingly rely on digital platforms not only to promote travel packages but also to construct spiritual appeal, religious credibility, and consumer trust. This study therefore aims to analyze how spiritual imagery is constructed, how rhetorical and pragmatic persuasive strategies are used, and how persuasive patterns differ between Arabic- and Indonesian-language Umrah marketing flyers. The study adopts a qualitative-dominant convergent parallel mixed-methods design. The qualitative analysis is based on Fairclough’s Critical Discourse Analysis (CDA), integrated …

Radical Responsibility: Sartre And The Ecocentric Erosion Of Human Agency, Khodadad Azizi, Naupal Asnawi, Abby Gina Boang Manalu
International Review of Humanities Studies
Contemporary ecological crisis persists despite decades of environmental ethics discourse and rising public awareness, a discrepancy researchers have named the awareness-action gap. One influential corrective, running from Aldo Leopold’s land ethic through Arne Naess’s deep ecology, addresses anthropocentric domination by folding the human being back into the biotic community as one member among others. This article argues that such levelling, whatever its merits against domination, carries an underexamined cost: it erodes the very ground on which anyone can be held responsible for ecological destruction, since only a being capable of choice, not soil, water, or rock, can be asked to …

Paediatricians' Liability To Patients' Parents For Negligent Genetic Testing, Anthony Sangiuliano
Paediatricians' Liability To Patients' Parents For Negligent Genetic Testing, Anthony Sangiuliano
Osgoode Hall Law Journal
The Ontario Superior Court of Justice has recently held that a paediatrician might owe a duty of care to a patient’s parents when performing genetic testing on the patient and communicating test results to the parents. The parents may be able to claim damages against the paediatrician for breach of this duty if, in reliance on a miscommunication about the test results, they conceive a subsequent child who is later born with a disability. I call the tort alleged by the parents in these circumstances a subspecies of “paediatric triangular torts.” In this article, I demonstrate the conceptual feasibility of …

Constitutionality Test: Judicial Review Of Mining License Prioritization For Religious Organizations In Indonesia, Qurrata Ayuni, Fitra Arsil
Journal of Environmental Science and Sustainable Development
The enactment of Government Regulation No. 25/2024 has sparked constitutional debate in Indonesia. The regulation prioritizes Special Mining Business Permit Areas (Wilayah Izin Usaha Pertambangan Khusus, WIUPK) for religious organizations, raising critical questions about distributive justice and democratic resource governance under Article 33(3) of the 1945 Constitution. This study examines the constitutionality of this policy by asking whether the prioritization of WIUPK for religious organizations, as reviewed in Constitutional Court Decision No. 77/PUU-XXII/2024, violates Article 33(3) of the 1945 Constitution and what implications this holds for Indonesia's natural resource management paradigms and constitutional interpretation. Using doctrinal legal research, …
