The Legal Intersectionality Of English Language Learners And Special Education Students: Ensuring Students Receive Mandated Services, Brett A. Geier Jan 2025

The Legal Intersectionality Of English Language Learners And Special Education Students: Ensuring Students Receive Mandated Services, Brett A. Geier

Seattle Journal for Social Justice

Students in the United States are afforded many rights and protections to ensure they receive an appropriate education. Supplemental programs that support academic achievement and social growth are common to eviscerate obstacles and equalize educational opportunities. Students who are disabled and students who qualify as English Language Learners are two categories that are entitled to receive state and federal financial and programmatic support. Despite being discrete programs, they have the potential to intersect so that students can qualify for both programs. For many reasons, though, these potentially dually qualifying students are often misidentified, leaving them underserved. There is a plethora …

Worker Protection Or Commercial Facilitation: The British Empire, Labor Governance And The Gradual Invisibilization Of Labor Coercion During The Age Of High Imperialism, Christopher Roberts, Michelle Ong Jan 2025

Worker Protection Or Commercial Facilitation: The British Empire, Labor Governance And The Gradual Invisibilization Of Labor Coercion During The Age Of High Imperialism, Christopher Roberts, Michelle Ong

Seattle Journal for Social Justice

This article considers labor governance and coercive labor practices in the British Empire between the late nineteenth and early twentieth centuries. In particular, it focuses its attention on several major commissions of inquiry undertaken around the British Empire in the period, as well as reforms that took place alongside those inquiries. In part, the article concludes these reforms were motivated by protective purposes, demonstrating some degree of genuine concern with workers’ well-being. More significantly, however, it finds these reforms were motivated by British imperial desire to ensure stable labor supplies, enhance the legitimacy of the British Empire, and establish more …

Thin Blue Advantage: Police Exceptionalism and the Two-Tier System of Public Sector Collective Bargaining

In general, California may be the most hospitable state to public sector collective bargaining. The basic rules are far more favorable to placing matters within the scope of mandatory subjects than any other state. There are, however, serious differences in how police and non-police bargaining is treated.

  • Choice of Forum for Police. Under California’s public sector collective bargaining law, most unions and employers must resolve their conflicts about the scope of bargaining through California’s Public Employment Relations Board (PERB). For police only, however, the parties can also bring the disputes to court.
  • Los Angeles Labor Relations. The scope …

Illinois, Elizabeth Ford

Thin Blue Advantage: Police Exceptionalism and the Two-Tier System of Public Sector Collective Bargaining

As compared with other states, the Illinois Labor Relations Board (“ILRB” or “Board) is unusually protective of the right to bargain. The Board is more protective still of the ability of police unions to bargain over employer decisions. In the last several years in cases involving the Chicago Police Department, the Board has moderated somewhat by, in key cases, refusing to issue a decision but rather holding the matter “in abeyance.” A few highlights follow:

  • Only Police Have the Right to Interest Arbitration. The Illinois Labor Relations Act requires police bargaining units to resolve contractual impasses through interest arbitration. …

U.S. Residents' Current Attitudes Towards Immigrants And Immigration: A Study From The Life In Hampton Roads Survey, Daniel K. Pryce Jan 2025

U.S. Residents' Current Attitudes Towards Immigrants And Immigration: A Study From The Life In Hampton Roads Survey, Daniel K. Pryce

Sociology & Criminal Justice Faculty Publications

Immigration is a fiery topic in U.S. society, as it generally brings to a boil native-born citizens’ disparate attitudes toward immigrants and immigration. While immigration has its fierce supporters and opponents alike, the topic provides fodder for politicians who use it to stoke the fear of an impending “immigrant invasion” among citizens. This is why scholars must regularly undertake empirical studies to assess community members’ views about immigrants and immigration in U.S. society. To add to the contemporary immigration debate, I analyze data from a random sample of 610 respondents who reside in the seven cities that make up the …

Is The Defendant Mad Or Bad? The Association Between Mental Health, Race And Sex In Sentencing In Federal Courts, Tracy Sohoni, Sylwia Piatkowska, Briana Paige Jan 2025

Is The Defendant Mad Or Bad? The Association Between Mental Health, Race And Sex In Sentencing In Federal Courts, Tracy Sohoni, Sylwia Piatkowska, Briana Paige

Sociology & Criminal Justice Faculty Publications

Although US courts regularly sentence individuals with mental health problems, to date, there has been little research on whether mental health indicators are related to sentencing decisions. The focal concerns perspective suggests that sentencing decisions reflect perceptions of the blameworthiness of the defendant, concerns about protecting the community, and practical considerations. Potentially, mental health issues could serve as a mitigating factor in sentencing decisions by making defendants seem less culpable for their actions and more deserving of assistance rather than punishment, and/or due to concerns about practical considerations related to higher costs of incarceration or of exacerbating current mental health …

Democratization Of The Private Markets?, Colleen Baker, Christina M. Sautter Jan 2025

Democratization Of The Private Markets?, Colleen Baker, Christina M. Sautter

Faculty Journal Articles and Book Chapters

U.S. initial public offerings are declining and the amount of private market assets under management are exploding. Simultaneously, the number of retail investors opening taxable brokerage accounts is increasing. Private market assets are hot. Everyone–both institutional and retail investors–wants in on the action. Yet considerations such as financial resources and U.S. securities laws make such investment less accessible for many retail investors. In this short article, we explore this changing investment landscape and, specifically, one development within this craze: retail investments in private company shares via closed-end funds (or CEFs).

Recently, CEFs like ARK Venture Fund and Destiny Tech100, Inc. …

Is Originalism Bullshit?, Michael L. Smith Jan 2025

Is Originalism Bullshit?, Michael L. Smith

Faculty Articles

It’s finally time to answer the big question. This Article draws on the surprisingly robust literature examining the definition, essence, and significance of bullshit and evaluates whether originalist constitutional interpretation fits the bill. I begin with Harry Frankfurt’s definition of bullshit as utterances made in pursuit of the speaker’s goals without regard for their truth value. I also rely on alternate formulations, including bullshit as unclarifiable nonsense as well as contextual and audience-centric variations of bullshit.

While not all instances of originalism are bullshit, I identify those instances which are, and go on to demonstrate that originalism is uniquely prone …

Everything New Is Old Again: The Coming Metaverse, Platforms As Premises, And Addressing Harms That Occur Behind The Veil Of Scale, Lara Putnam, Jena Martin Jan 2025

Everything New Is Old Again: The Coming Metaverse, Platforms As Premises, And Addressing Harms That Occur Behind The Veil Of Scale, Lara Putnam, Jena Martin

Faculty Articles

Increasingly, social media companies have engaged in the creation, development, and deployment of "worlds" within a virtual reality setting, leading to significant interactions among users within these engineered spaces. However, this expansion has also been accompanied by harms. While some harms are unique to immersive reality technology, many mirror harms that occur in the analog environment, including fraud, theft, verbal abuse, and child sexual exploitation. Others replicate harms that have already exploded in non-immersive online spaces, including image-based sexual exploitation, cyberstalking, and invasion of privacy. Unfortunately, the architecture and infrastructure of these spaces has created what we coin here to …

Lost Fatherhood: Including Fathers In The Post-Dobbs Abortion Debate, Linda L. Schlueter Jan 2025

Lost Fatherhood: Including Fathers In The Post-Dobbs Abortion Debate, Linda L. Schlueter

Faculty Articles

Scientific studies over the last five decades show the negative impact an abortion can have on the men who fathered the aborted children. These studies demonstrate that those men-even if they supported the woman's decision to have an abortion-can experience a variety of psychological problems including depression, anger, hopelessness, helplessness, broken or damaged relationships, feelings of emasculation, and loneliness. Despite these compelling studies, little or no real attention is given to involving men in the legal debate regarding abortion. The abortion debate presents a legal Rubik's Cube of thorny issues that can affect the mother, the father, and the unborn …

"The Gift Of A Golden Voice": Shaping The Right Of Publicity To Protect Performers From A.I. Abuses, Sebastian Saavedra

Cardozo Arts & Entertainment Law Journal

The note explores the evolving nature of the right of publicity, a unique area of intellectual property and privacy law that protects individuals' control over their likeness and persona. It examines the challenges posed by emerging technologies, particularly AI-generated content, and advocates for a balanced approach that integrates elements from trademark and copyright law while respecting First Amendment rights. The analysis emphasizes the need to protect performers' rights to their public image without undermining established legal frameworks.

The British Museum's Deceit In The Parthenon Marbles Controversy, Hannah M. Bartfield, Morgan E. Spencer, David Rudenstine Jan 2025

The British Museum's Deceit In The Parthenon Marbles Controversy, Hannah M. Bartfield, Morgan E. Spencer, David Rudenstine

Cardozo Arts & Entertainment Law Journal

The article challenges the British claim of legal ownership over the Parthenon sculptures, arguing that the documents cited by the British government and the British Museum to justify the removal of the marbles are flawed and intentionally misleading. Through a detailed analysis of the Italian and English documents, the article demonstrates that the British narrative of lawful removal lacks credibility, as the documents contain significant discrepancies and mistranslations that undermine their validity. The evidence presented, including scholarly critiques, conclusively discredits the British claim, emphasizing the need for accountability and the return of the marbles to Greece.

Don't Bet On It: Sports Betting And Consequential Detrimental Impact, Melinda Roth Jan 2025

Don't Bet On It: Sports Betting And Consequential Detrimental Impact, Melinda Roth

Cardozo Arts & Entertainment Law Journal

In 2018, the U.S. Supreme Court's decision in Murphy v. NCAA struck down the Professional and Amateur Sports Protection Act (PASPA). Since 1992, this federal law had prohibited most states from allowing sports betting, with some limited exceptions. Following the landmark ruling in Murphy, 39 states and the District of Columbia have moved to permit variousforms of legalized sports betting. The industry is growing exponentially, reaching almost $150 billion in total legalized bets in 2024, and $14 billion in revenues.

Both states and professional sports leagues are profiting handsomely from this burgeoning new sector. Unfortunately, legalized sports gambling is not …

Duped: The Implications Of The Proliferaiton Of Superfake Luxury Goods And What Consumers May Not Have Considered, Riann Colbert Jan 2025

Duped: The Implications Of The Proliferaiton Of Superfake Luxury Goods And What Consumers May Not Have Considered, Riann Colbert

Cardozo Arts & Entertainment Law Journal

The proliferation of "Superfake" luxury goods, which are high-quality counterfeit items nearly indistinguishable from authentic products, poses significant challenges to trademark law, consumer protection, and the broader economy. These items, often sold through e-commerce platforms, not only undermine legitimate businesses but also expose consumers to health risks, support organized crime, and perpetuate environmental harm. The note advocates for enhanced legal frameworks and consumer education to mitigate these issues.

The American Oligarchy, Match Dawson Jan 2025

The American Oligarchy, Match Dawson

Faculty Articles

What was designed as a constitutional republic, bound by self-rule and democratic accountability, has become an oligarchy camouflaged by the illusion of public sovereignty. The corporate architects of this new world order did not seize power through conquest or force: they legislated, litigated, and purchased it into existence. Oligarchic rule is more than a simple political crisis. It is a democratic one. Just as prior generations have been called upon to preserve the republic against threats to liberty, we now face our own defining challenge and must decide whether to accept a government auctioned to the highest bidder or reclaim …

“Forced Worship Stinks In God’S Nostrils”: The Inquisition, Sepharad, And The American Experiment, Isaac Amon Jan 2025

“Forced Worship Stinks In God’S Nostrils”: The Inquisition, Sepharad, And The American Experiment, Isaac Amon

Touro Law Review

In December 1791, the Bill of Rights, comprising the first 10 amendments to the U.S. Constitution, enshrined fundamental protections for individual freedoms, with the First Amendment guaranteeing liberty of conscience. This milestone, however, was the culmination of centuries of struggle. The arrival of Iberian Jews, including conversos, in North America played a pivotal role in shaping the course of American history. The Founders referenced the Inquisition in their letters and debates, particularly in discussions on legal protections for criminal suspects and the broader issue of religious liberty. Founding assurances of religious freedom to Jews and Christians stand in stark contrast …

Trading Places: The Intersection Of Lgbtq Rights And Zionist Rights Under Federal Civil Rights, Marc A. Greendorfer

Touro Law Review

While antidiscrimination laws have a long history at both the federal and state levels, the scope of coverage for these laws has evolved based on nuanced interpretations of terms that previously had established, static meanings. Many antidiscrimination laws prohibit discrimination on the basis of generic categorizations such as sex, religion or ethnicity but such terms are undergoing a rapid change in the way society understands and uses them. For example, sex, which historically has referred to biological gender at birth, now encompasses gender as well as sexual orientation. This article focuses on a recent Supreme Court decision relating to the …

Command And Consequence: Reassessing King David’S Military Decisions In The Uriah Affair – A Legal And Ethical Analysis In The Context Of Modern Legal Theory, Jonathan Hasson, Oded Mudrik, Abraham Tennenbaum

Touro Law Review

This study critically reevaluates King David's command in 2 Samuel 11 and 12 to place Uriah the Hittite in the battle's frontlines, resulting in his death, through the contemporary lens of military law and ethics. By juxtaposing the ancient narrative with modern legal doctrines, it investigates the complexities of command responsibility and the intersection of personal motives in military orders. Focusing on the interplay between David's personal entanglements with Bathsheba and his official capacity as a military leader, the analysis navigates the ethical quandaries and legal ramifications of his decisions. This piece methodically dissects the Biblical text and contemporaneous legal …

Urgensi Pembentukan Lembaga Pengawas Data Pribadi Sebagai Upaya Preventif Kebocoran Data Pribadi, Salsa Hardafi

Jurnal Hukum & Pembangunan

The rapid advancement of information technology has intensified the risks of personal data breaches and violations of privacy rights. Although Law Number 27 of 2022 on Personal Data Protection (PDP Law) has established a comprehensive legal framework for personal data protection in Indonesia, its effective implementation remains constrained by the absence of the Personal Data Protection Supervisory Authority (PDP Authority). This institutional absence creates a structural authority vacuum that weakens preventive measures, law enforcement mechanisms, and alternative dispute resolution in personal data protection. Through normative legal analysis using Hans Kelsen’s Stufenbau Theory, Nonet and Selznick’s Responsive Law Theory, and Satjipto …

Penanganan Kasus International Child Abduction Di Indonesia: Studi Kasus Penculikan Ezekiel Gionata Purba & Penculikan Enrico Johannes Susanto Carluen, Dhani Ershiano, Ari Wahyudi Hertanto, Benedetto Setyo Satrio Utomo

Jurnal Hukum & Pembangunan

Child protection, particularly in preventing and addressing cases of international child abduction, is an obligation of all states. This phenomenon frequently occurs in Indonesia when a foreign-national parent, following divorce, unilaterally takes their biological child abroad in violation of court-granted custody, guardianship, and/or access rights of the other parent. Currently, Indonesia lacks adequate legal provisions to prevent and resolve cases of international child abduction. Moreover, Indonesia has not yet acceded to the Hague Convention on the Civil Aspects of International Child Abduction 1980 (“the 1980 Hague Convention”). This convention establishes a legal mechanism to ensure the prompt return …

Penderitaan Tanpa Ukuran: Mengapa Kuhap Harus Segera Mengatur Kerugian Imateriil?, Setiani Budi Utami, Mardian Putra Frans

Jurnal Hukum & Pembangunan

Law enforcement must ensure that the justice process operates in accordance with the principles of true justice. The criminal justice system in Indonesia emerged as a response to public dissatisfaction with the performance of law enforcement agencies that overly emphasized formal law and order alone, without regard for human dignity. The preamble of the Criminal Procedure Code (KUHAP) affirms that this system aims to protect human dignity, thus substantive justice must be prioritized. In this context, human rights, particularly the protection of crime victims, become crucial. However, in practice, victims are often marginalized, especially regarding compensation for immaterial damages that …

Dekolonisasi Hukum Perdata Indonesia: Kritik Terhadap Warisan Kolonial Dan Implikasinya Terhadap Pembangunan Hukum Berkeadilan, R. Mustar Lofi

Jurnal Hukum & Pembangunan

Is One Cow’S Waste Another (Hu)Man’S Treasure? Exploring The Environmental And Energy Impacts Of Manure Biogas, Katie Thompson

Animal Law Review

There is no question that manure biogas, a form of natural gas derived from animal waste, is quickly becoming the most valuable product supplied by factory farms, known also as concentrated animal feeding operations (CAFOs). Manure biogas can be used to produce heat, electricity, or transportation fuel, but its greatest profit stream rests in the myriad government credits and subsidies it can garner. Although turning trash into treasure by giving waste a new life may appear laudable and worthy of such investment, this Article argues that manure biogas is far from a sustainable solution to the United States’ environmental and …
