Disposability And Survival: The Legal And Social Marginalization Of Black Transwomen, Rachel Still

Public Interest Law Reporter

The criminalization of Black transwomen emerges not as an incidental consequence of law but as a deliberate, structural process intertwined with a long history of racial, gendered, and class-based oppression. From the horrors of slavery to contemporary policing, the state has consistently defined and regulated Black trans bodies through a lens of disposability. This article explores the historical and contemporary forces that contribute to the marginalization and criminalization of Black transwomen, emphasizing how race, gender, and socio-economic status intersect to create a landscape of legal violence that continues to shape their lives and deaths.

The experiences of Black transwomen reveal …

The Unfulfilled Promise Of Obergefell For Children Of Lgbtq+ Parents: Advancing Non-Discrimination Laws For Familial Association, Jeffrey Dodge Jan 2025

The Unfulfilled Promise Of Obergefell For Children Of Lgbtq+ Parents: Advancing Non-Discrimination Laws For Familial Association, Jeffrey Dodge

Faculty Scholarship

Since the 2015 Obergefell v. Hodges decision, same-sex marriages have increased significantly in the United States. The American Community Survey data collected in 2022 shows that there are around 1.3 million same-sex couple households in the country, up from 565,000 in 2028. Just over half of these couples are legally married, up nearly 400% from prior to Obergefell. This data not only shows the significance of Obergefell for the LGBTQ+ community, but it also frames a generational shift in attitudes on marriage and family.

With the rise in same-sex couples accessing marriage has come greater visibility, representation, and acknowledgement. …

Climate Proof Electricity, Kristen Van De Biezendos Jan 2025

Climate Proof Electricity, Kristen Van De Biezendos

Faculty Scholarship

The devastating impacts of climate change make themselves known in the form of fires, floods, droughts, storms, extreme heat and cold, and worsening socioeconomic conditions around the globe. At the same time, the U.S. electricity system has never been more vulnerable to severe weather. Even as we embark on a national project to decarbonize the electricity system by 2035, the U.S. leads the developed world in power outages. These outages are in large part due to aging infrastructure, improperly weatherized systems, vegetation crashing down on transmission and distribution lines and—perhaps most devastating of all—wildfires caused by fallen power lines in …

More Than Miscommunication: Rethinking Interpretation At The Asylum Office, Pooja R. Dadhania, Hillary Mellinger Jan 2025

More Than Miscommunication: Rethinking Interpretation At The Asylum Office, Pooja R. Dadhania, Hillary Mellinger

Faculty Scholarship

The United States requires asylum applicants to provide their own interpreters for their interviews at the Asylum Office, barring exceptional circumstances. Applicants can face significant hurdles in finding suitable interpreters, who play a critical role in giving them a voice in the asylum process. Inaccurate interpretation can have serious ramifications such as denial of an applicant’s asylum claim. Despite the critical need for meaningful language access in the asylum process, interpretation at the Asylum Office remains understudied. This article represents a first attempt at bringing the scholarly and practitioner communities together to rethink interpretation at the Asylum Office, with the …

An Economic Comparison Of Succession Law Systems: Prioritizing Spouses Vs. Forced Shares For Children And Proposal For A Standards Based Approach To Child Disinheritance Jan 2025

An Economic Comparison Of Succession Law Systems: Prioritizing Spouses Vs. Forced Shares For Children And Proposal For A Standards Based Approach To Child Disinheritance

Florida A & M University Law Review

In the United States (“U.S.”), the foundation of succession law is the freedom of disposition. Priority is placed on the testator’s freedom to choose what happens with their property after they die. Thus, laws governing the distribution of property in both testate and intestate situations are aimed at honoring the testator’s intent. In the U.S., spouses are given preferential treatment under succession laws and intestacy laws. However, children are not given as great a level of protection as spouses and a testator can legally disinherit a child. This approach is unique because several other countries, along with one U.S. state, …

Florida A & M University Law Review

This article analyzes the problem of heirs’ property in Puerto Rico in three sections. Section I commences with the complexities related to Puerto Rico’s civil law system. The Change That Needs To Be Made: A Shift From Juvenile Life Without Parole To The Use Of Rehabilitative Programs In Florida Jan 2025

The Change That Needs To Be Made: A Shift From Juvenile Life Without Parole To The Use Of Rehabilitative Programs In Florida

Florida A & M University Law Review

Life without parole is the harshest sentence a minor can receive for a homicide offense. Florida is one of a few states that still allow this type of sentence for minors. This sentence violates the Eighth Amendment of the Constitution because it is a cruel and unusual punishment as it locks up a minor for the rest of his or her life, or at least for most of it. Life without parole for juveniles who commit homicide offenses should no longer be available in Florida. A juvenile should receive a sentence that does not keep them incarcerated for the majority …
