Don’T Hold Your Horses: Solutions To The Bureau Of Land Management’S Failure To Manage Wild Horse Populations, Sutaria, Kiran Mahendra Aug 2025

Don’T Hold Your Horses: Solutions To The Bureau Of Land Management’S Failure To Manage Wild Horse Populations, Sutaria, Kiran Mahendra

Santa Clara Law Review

Since the Wild Free-Roaming Horses and Burros Act (WFHA) was enacted in 1971 – mandating protection and management of the wild horse and burro population – the BLM has triggered a public outcry over its mismanagement of wild horses. From inhumane roundup processes to a well-intentioned but poorly executed adoption program that inadvertently subjects horses to cruel conditions and slaughter, the BLM’s efforts have continuously undermined wild horse preservation. When an overwhelming majority of Americans push for wild horse protections, and wild horse preservation is a topic that largely receives bipartisan support, it is hard to understand the current status …

Paradise Lost In The Patent Law? Changing Visions Of Technology In The Subject Matter Inquiry, Dana Remus Irwin Aug 2025

Paradise Lost In The Patent Law? Changing Visions Of Technology In The Subject Matter Inquiry, Dana Remus Irwin

Florida Law Review

In recent decades, the Patent and Trademark Office and the federal courts have dramatically expanded the scope of patentable subject matter—the set of inventions eligible for patent protection. Existing scholarship has taken a narrow view of this expansion. Scholars argue on efficiency grounds that without more meaningful limits on the scope of patentable subject matter, future invention will be impeded rather than encouraged. This Article takes a broader view of the subject matter inquiry, tracing its historical development and its changing theories of technology, from the patent system’s inception to the present. This Article demonstrates that through these theories of …

Ai At Work, Algorithmic Bosses, And The Ambivalence Of Automation, Antonio Aloisi, Valerio De Stefano Aug 2025

Ai At Work, Algorithmic Bosses, And The Ambivalence Of Automation, Antonio Aloisi, Valerio De Stefano

All Papers

This chapter revisits a foundational question (“what do bosses do?”) to explore how artificial intelligence (AI) is reshaping power dynamics in the workplace. Far from neutral tools of optimisation, algorithmic systems increasingly amplify managerial prerogatives, embedding them into automated processes that are difficult to scrutinise or contest. These developments give rise to a paradox: managers and workers are simultaneously augmented and disempowered, caught in systems that intensify control while eroding autonomy. Drawing on legal, organisational, and regulatory perspectives, we argue that existing safeguards, ranging from data protection rights to information and consultation, are ill-equipped to confront this shift. The chapter …

The Patent Landscape Of Chagas Disease Vaccines Indicates Major Underinvestment In An Emerging Global Health Threat, Stanley Kowalski, Lily Widdup, Bradley Johnson Aug 2025

The Patent Landscape Of Chagas Disease Vaccines Indicates Major Underinvestment In An Emerging Global Health Threat, Stanley Kowalski, Lily Widdup, Bradley Johnson

Law Faculty Scholarship

Considering the enormous human and economic toll Chagas disease inflicts, investment in R&D of medical innovations such as diagnostics, pharmaceuticals and vaccines remains disproportionately low.  The patent landscape of Chagas’ disease vaccine innovation corroborates this unfortunate trend: an alarming paucity of investment which confirms this disease as among the most neglected of the neglected diseases.  However, the article then articulates how patent information can also be viewed as a starting point, and indeed springboard, for international collaboration to accelerate vaccine development via a dynamic opening-innovation strategy.

Restrictions On Veto Power: Holding The Permanent Five Accountable In The Face Of Intervention And Peacekeeping Operations, Theo Aldrighi Aug 2025

Restrictions On Veto Power: Holding The Permanent Five Accountable In The Face Of Intervention And Peacekeeping Operations, Theo Aldrighi

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

ABSTRACT: This article examines the structural constraints of the United Nations Security Council, with a focus on the veto power of its permanent members and its implications for intervention and peacekeeping. Through a realist lens and grounded in structural analysis, it contends that the recurrent paralysis of the Council in the face of mass atrocities stems from entrenched power asymmetries. The paper advances a bifold proposal: the adoption of the French-Mexican initiative to suspend veto use in cases of mass atrocities, and the entrenchment of the Council’s authority to authorize the use of force under defined conditions. Drawing on case …

The Effects Of A Geopolitical Policy—Case Study Of “Korea Limitation Order” Upon The Cultural Entertainment Industry In China, Zhilin Li Aug 2025

The Effects Of A Geopolitical Policy—Case Study Of “Korea Limitation Order” Upon The Cultural Entertainment Industry In China, Zhilin Li

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

This paper examines the impact on the South Korean Cultural Entertainment Indus- try(CEI) of China’s “Korea Limitation Order”. In November 2016, Beijing restricted South Korean artists from holding concerts and the broadcast of South Korean TV dramas and banned cooperation between the two countries in the entertainment in- dustries. This paper focuses on the effect this had on exports of cultural products and relating industries from Korea, and how Korea was able to adjust to this geopolitical shock. I examine exports from Korea to China, Japan, and the United States using data from Cultural Entertainment Industry Products Exports, such as …

Does Bilingualism On Resumes Affect Callback Rates?, Autumn Halfpenny Aug 2025

Does Bilingualism On Resumes Affect Callback Rates?, Autumn Halfpenny

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

I study the influence of bilingualism in Spanish on the likelihood of receiving a callback for female customer service positions in the Chicago area. Data are collected from sixteen unique resumes submitted to 131 different job postings in an audit study, with applicants differing in bilingual ability. Bilingualism in Spanish significantly in- creases the likelihood of a callback by 17.86%-25.4%, implying bilingualism is valued in customer service roles. This suggests that bilingualism in Spanish may increase job prospects. While previous research studies this using observational and survey data, I use an audit study design with resumes to obtain causal results. …

The Effects Of Pandemic School Closures On Standardized Testing Outcomes: Evidence From Connecticut, Michael Manieri Aug 2025

The Effects Of Pandemic School Closures On Standardized Testing Outcomes: Evidence From Connecticut, Michael Manieri

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

During the Covid-19 pandemic, schools around the nation closed to prevent the virus’s spread. Following these closures, students’ performance on standardized exams worsened. Using a two-way fixed effect model with district and year fixed effects, I examine if the use of non-traditional schooling modes (i.e. hybrid and virtual) during the pandemic is associated with lower ELA and Math proficiency rates in Connecticut public schools. I find that Connecticut public school districts’ Math and ELA pass rates on the annual Smarter Balanced exam significantly decreased as they used higher levels of virtual and hybrid education. The magnitude of this decrease was …

Jefferson Et Al. Reply, Osmat Jefferson, W. Nicholson Price Ii, S. Sean Tu, Saurabh Vishnubhakat, Arti K. Rai

Articles

Notwithstanding Amgen’s strenuous objections, the core premise of our article should be uncontroversial to most policy analysts: biosimilar firms that simply want to manufacture an originator biologic in the manner it was manufactured at the time of US Food and Drug Administration (FDA) approval should be able to enter the market expeditiously once valid manufacturing (and other valid patents) that legitimately cover the ‘at approval’ biologic have expired. Our core premise relies on the widely accepted values of patent validity and notice. Instead of expensive litigation discovery fights over such ‘at approval’ issues, of the sort Amgen itself has spearheaded …

Health Impacts Of Restrictive Migration Policies: A Qualitative Study Of Highly Educated Iranian Immigrants And International Students In The U.S., Sarvenaz Taridashti, Mitra Naseh, Elvira M. Zamora Garcia, Jihye Lee Aug 2025

Health Impacts Of Restrictive Migration Policies: A Qualitative Study Of Highly Educated Iranian Immigrants And International Students In The U.S., Sarvenaz Taridashti, Mitra Naseh, Elvira M. Zamora Garcia, Jihye Lee

Montclair State University Scholarship & Creative Works

Immigrants constitute a substantial portion of the United States population and represent a significant minoritized group whose health is impacted by the country’s migration policies as social determinants of health. This qualitative study used a phenomenological approach to document and explore the lived experiences of highly educated Iranian immigrants and International Students within the context of U.S. migration policies while considering the Social Determinants of Health framework. In-depth semi-structured interviews were conducted with 23 participants. Reflexive thematic analysis of the data revealed four major themes (1) entry and reentry visa restrictions for Iranians; (2) the emotional and social impact of …

All Quiet On The Northern Front — The Eu Directive On Adequate Minimum Wages As Seen From Sweden, Andrea Iossa Aug 2025

All Quiet On The Northern Front — The Eu Directive On Adequate Minimum Wages As Seen From Sweden, Andrea Iossa

Dispatches

ON 15 NOVEMBER 2024, the deadline for the implementation of the European Union (EU) Directive on Adequate Minimum Wages1 (hereinafter the Directive) passed. While most of the EU Member States have missed it (ETUC, 2024), a group of countries has instead opted for what the European Trade Union Institute senior researcher Torsten Müller defines as a “minimalistic” transposition (Staunton, 2024). Sweden is among them. The governmental inquiry issued in 2023 states that the Swedish system already meets the Directive’s requirements (Gunnarsson, 2023). No implementing measures are therefore needed — besides an extension of the tasks assigned to the National Mediation …

From Legal Grey Area To Legal Recognition: Recent Legislative Reforms Regarding Sex Work Under Employment Contracts In Belgium, Ninon Ramlot Aug 2025

From Legal Grey Area To Legal Recognition: Recent Legislative Reforms Regarding Sex Work Under Employment Contracts In Belgium, Ninon Ramlot

Dispatches

ON 1ST DECEMBER 2024, the Law of 3 May 2024 portant des dispositions en matière du travail du sexe sous contrat de travail [laying down provisions on sex work under an employment contract] entered into force in Belgium.1 This piece of legislation establishes a strict legal framework for an employer to lawfully employ sex workers, without this being condemned under the criminal offence of procuring, as well as creating an employee status tailored to sex workers. This Act is another building block in the broader process undertaken over the last few years to resolve the legal inconsistency surrounding sex work …

China’S Reform On Gradual Delay Of The Retirement Age, Zhenxing Ke Aug 2025

China’S Reform On Gradual Delay Of The Retirement Age, Zhenxing Ke

Dispatches

APPROXIMATELY A DECADE AGO, China began considering postponing the retirement age, and this concept has now been officially implemented. On 13 September 2024, the Standing Committee of the National People’s Congress passed the “Decision on the Implementation of Gradual Delay of the Retirement Age, 关于实施渐进式延迟法定退休年龄的决定,” (the “Decision on Retirement Age”). Concurrently, the State Council issued the “Measures to Gradually Delay of Statutory Retirement Age,” 关于渐进式延迟法定退休年龄 的办法, (the “Measures on Retirement Age”) providing detailed provisions. This marks the first instance of China raising its retirement age in several decades. Prior to this reform, the retirement age in China was 50 years …
