How Solar Scammers Threaten The Green Energy Movement, Chase Cohen
How Solar Scammers Threaten The Green Energy Movement, Chase Cohen
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
In response to rising energy costs[1] and escalating climate change anxiety, a growing number of Americans are ditching fossil fuels and seeking alternative, clean energy solutions to power their homes. While this is a positive step towards achieving carbon neutrality, there are associated risks, as some see this newfound demand as an opportunity to manipulate vulnerable consumers. As a result, bad actors within the clean energy industry exacerbate the problem of climate change by discouraging homeowners from embracing climate-friendly energy solutions due to fears of predatory lending, property damage, and exploitation.

Generative Artificial Intelligence And Copyright In The Film And Media Industry, Victor A. Oberting Iv
Generative Artificial Intelligence And Copyright In The Film And Media Industry, Victor A. Oberting Iv
Washington and Lee Law Review Online
The development of generative artificial intelligence (“GAI” or “generative AI”) introduces compelling benefits and capabilities to filmmakers and artists, but also brings complications regarding copyright of creative works. The American film and media industry in particular illustrates the scope of GAI’s legal, economic, and ethical implications. Though GAI may exhibit characteristics of independent agency or intent, GAI models are best understood as a new set of tools that serve a diverse range of applications in the creative process. The potential benefits of this set of tools can only be realized, then, if the filmmakers who use them are not unreasonably …
A Jacksonian Theory Of Estoppel In Ip Litigation Against The United States, Leonard C. Brahin
A Jacksonian Theory Of Estoppel In Ip Litigation Against The United States, Leonard C. Brahin
Washington and Lee Law Review Online
As an intellectual property infringer, the federal government occupies a unique position as both the entity that approved the infringed patent or trademark and an entity capable of arguing for its invalidity. By arguing for invalidity, the federal government assumes that it should be exempt from the traditional rules of procedural estoppel. Indeed, the government believes that even though it granted intellectual property rights (after careful research and deliberation and following the express review of an officer appointed with the advice and consent of the Senate), it should have a second bite at the apple to invalidate a patent or …

Title IX prohibits schools from responding with deliberate indifference to student-on-student sexual harassment that interferes with, or threatens to interfere with, a victim’s education. It also prohibits schools from retaliating against students who engage in Title IX protected activity, such as reporting an assault. Here, another Marshall student sexually assaulted Roe at an offcampus residence near Marshall’s campus. Roe reported the assault and other instances of student-on-student relationship abuse. In the assault’s aftermath, Roe missed classes and limited her time on campus because she was afraid of encountering her assailant. Her grades suffered. Marshall did not address the …

Detangling Knots In The Narratives: A Response To Theunis Roux, Aparna Chandra
Detangling Knots In The Narratives: A Response To Theunis Roux, Aparna Chandra
Articles
This article is part of a symposium on Theunis Roux's article titled 'Grand Narratives of Transition and the Quest for Democratic Constitutionalism in India and South Africa', which proposes two dominant narratives about the constitutional transitions in India and South Africa. The author focuses on Indian constitutional praxis to evaluate the claims of both. Part A engages with Roux’s version of the 'Liberal Progressive Narrative' and demonstrates what post-liberal accounts of the Indian constitutional transition offers that differs from the standard narrative as presented by Roux. Part B turns to the 'Culturalist Grand Narrative' and teases out the differences between …

Transformación De La Sociedad Saharaui: Evolución Histórica Y Reorganización Social, Mustapha Ouzir
Journal of Maya Heritage
Este artículo analiza la evolución histórica y los cambios sociales en la región sahariana, desde Oued Nun hasta el río Senegal, destacando el impacto de la llegada de las tribus Banu Hassan sobre la población autóctona amazigh Sanhaja. "Legally Magic" Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Roseanna Sommers, Kate Weisburd
"Legally Magic" Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Roseanna Sommers, Kate Weisburd
Northwestern University Law Review
Fifth Amendment case law (including Miranda v. Arizona) requires that individuals assert their right to counsel or silence using “explicit,” “clear,” and “unambiguous” statements—or, as some dissenting judges have lamented, using “legally magic” words. Through a survey of 1,718 members of the U.S. public, we investigate what ordinary people believe it takes to assert the right to counsel and the right to silence. We then compare their perceptions against prevailing legal standards governing invocation.
With respect to the right to counsel, the survey results indicate that members of the public have a uniformly lower threshold for invocation than do …

South Korea’S Financial Supervisory Service Mediating Disputes Over Hong Kong-Tied Equity-Linked Security Losses, Michele Kallo
South Korea’S Financial Supervisory Service Mediating Disputes Over Hong Kong-Tied Equity-Linked Security Losses, Michele Kallo
Cardozo Journal of Conflict Resolution (CJCR) Blog
Since January 8, 2024, South Korea’s financial regulator, Financial Supervisory Service (FSS), has investigated major Korean banks for selling high-risk equity-linked securities (ELS) products linked to Hong Kong’s Hang Seng China Enterprises Index (HSCEI), which resulted in substantial financial losses among South Korean investors. An ELS is a derivative product that promises returns if the underlying asset—in this case, the HSCEI—stays above a specified “knock-in” level until it matures. Due to the severe decline in the HSCEI, many ELS products have seen drastic devaluations, leading to significant losses for investors, including those who are risk averse. Investors aged 65 and …
Criminal Juror Challenges And Csli: A Rule 16 Revision To Maintain Impartial Juries, Ivy Kaplan
Criminal Juror Challenges And Csli: A Rule 16 Revision To Maintain Impartial Juries, Ivy Kaplan
Northwestern University Law Review
The Sixth Amendment of the U.S. Constitution guarantees criminal defendants “the right to a speedy and public trial by an impartial jury of the State.” Voir dire, the procedure during which the prosecution and the defense may challenge prospective jurors for cause or exercise peremptory challenges, purports to uphold this right. When the prosecution has access to cellular geolocation data on prospective jurors that the defense lacks, however, it may jeopardize the defendant’s Sixth Amendment rights.
This Note proposes a solution to that problem in the form of an addition to Rule 16 of the Federal Rules of Criminal Procedure. …
Accommodating Incompetency In Immigration Court, Elizabeth Jordan
Accommodating Incompetency In Immigration Court, Elizabeth Jordan
Northwestern University Law Review
In criminal law, an individual must be deemed competent to stand trial, yet our immigration courts routinely order the deportation of incompetent noncitizens. A removal proceeding against a noncitizen—where an outcome of deportation often risks life-threatening harm—continues apace even if the noncitizen has been deemed incompetent by the immigration judge. In place of halting proceedings, the immigration judge imposes “safeguards” pursuant to a provision of the immigration code that neither defines nor explains the term. In practice, judges’ application of the term “safeguards” is often absurd. The implications of continuing a proceeding against a noncitizen with a disability affecting competency …
The Sec As An Entrepreneurial Enforcer, James J. Park
The Sec As An Entrepreneurial Enforcer, James J. Park
Northwestern University Law Review
The truth of disclosures by public companies is policed by both private plaintiffs and the Securities and Exchange Commission (SEC). The courts and many commentators have viewed the SEC as a more responsible enforcer than private litigants. Entrepreneurial enforcers with a profit motive have an incentive to advance questionable legal theories to expand the reach of Rule 10b-5, the primary federal prohibition of securities fraud. In contrast, the conventional view is that a public enforcer will bring straightforward cases against public companies. This Article argues that this perception is dated, and that the SEC has become more entrepreneurial in its …
Taxation's Limits, Luís C. Calderón Gómez
Taxation's Limits, Luís C. Calderón Gómez
Northwestern University Law Review
Countless pages have been devoted to the question of why everyone should pay tax, yet its opposite has gone largely unnoticed: why should some people and organizations not pay tax? Our tax system exempts from ordinary income taxation a wide and diverse array of people and organizations engaged in significant economic activity—from parents providing childcare services for their family to consular activities and charities operating animal shelters—seemingly without a convincing explanation. Perhaps because of the dizzying diversity of tax-exempt activities, scholars and policymakers have avoided comprehensively or coherently justifying our exemption regimes.
This Article develops a novel normative theory that …
Rising Temperatures, The Prison Litigation Reform Act, And The Heat Death Of Human Dignity In Texas Prisons, Brianne Wylie
Rising Temperatures, The Prison Litigation Reform Act, And The Heat Death Of Human Dignity In Texas Prisons, Brianne Wylie
Northwestern University Law Review
This Note seeks to shed light on the life-threatening danger of extreme heat in un-air-conditioned Texas prisons. The Prison Litigation Reform Act (PLRA) starkly limits the relief available to those suffering and dying in these prisons. This Note proposes an amendment to the legislation that could create a path toward lasting relief for incarcerated people. After analyzing the effects of increasing heat on the particularly vulnerable prison population, this Note analyzes how the Supreme Court and the Fifth Circuit have handled claims alleging constitutionally violative prison conditions under the Eighth Amendment—in short, ineffectively, if at all. This Note then details …

The Legal Regulation Of Government Companies In The Uae, Abdulla Saeed Alharbi
Thesis/ Dissertation Defenses
The United Arab Emirates has witnessed a remarkable economic development in the past years, as the state is no longer completely dependent on oil and its derivatives, but has begun to diversify its economy and sources of income in it, and the state has relied in building, developing and diversifying this economy on the so-called government companies established and managed by the government, whether through direct supervision or in other ways that differ from the traditional methods of managing the public facility, and the establishment of these government companies came as a desire From the government to protect its economic …
Tendencias Fonéticas Y Aspectos Gramaticales Del Español Hablado En El Sáhara, Mustapha Ouzir
Tendencias Fonéticas Y Aspectos Gramaticales Del Español Hablado En El Sáhara, Mustapha Ouzir
Journal of Maya Heritage
