The Supreme Court is divided over the constitutional law of community supervision. The justices disagree about the nature of a defendant’s liberty under supervision, the rights that apply when the government punishes violations, and the relationship between parole, probation, and supervised release. These divisions came to a head in 2019’s United States v. Haymond, where the justices split 4–1–4 on whether the right to a jury trial applies to revocation of supervised release. Their opinions focused on the original understanding of the jury right at the time the Constitution was ratified.
This Article aims to settle the debate over …
Scrutinizing The Bathroom Binary: Equal Protection Theories For Nonbinary Students, Annie Schuver
Scrutinizing The Bathroom Binary: Equal Protection Theories For Nonbinary Students, Annie Schuver
Michigan Law Review
Over the past decade, transgender students have challenged discriminatory school bathroom policies under the Equal Protection Clause with varying success. But another group of students, facing similar discrimination, has yet to see its day in court. Like their transgender peers, nonbinary students often lack access to gender-appropriate restrooms at school. Many K–12 schools offer only “boys” and “girls” restrooms, ignoring the needs of students who identify as neither boys nor girls, as both of those genders, or as something else entirely. Forced to use sex-segregated bathrooms (or no bathroom at all), nonbinary students suffer adverse health, safety, and educational outcomes. …

Have You Been To Orlando?: In Relation To The Regulation Of Self-Preferencing In Antitrust Law, Eunkwang Ha
South Carolina Journal of International Law and Business
As a mother of two and a South Korean professional studying abroad in the United States, one of my top priorities for our family's time here was to visit Orlando. My children had endured quite a bit of disruption as I pursued my professional goals, and I felt visiting Disney World and Universal Studios would be a bit of recompense. Although I wanted to use a package deal from a Korean travel agency, it was not a good choice because I needed to stay at hotels connected to Disney World and Universal Studios.
Due to the self-preferencing of Disney World …

Chapter 13: Let’S Call The Whole Thing Off, Lawrence Ponoroff
Emory Bankruptcy Developments Journal
Courts cannot agree on much of anything about chapter 13, and legislators cannot agree and are confused over what to do about it. This state of affairs benefits no one and shows no signs of abating. So, in this Article, I propose to throw in the towel by imagining a world without chapter 13. Spoiler alert: although I am not superstitious, with just a few tweaks and tucks to chapter 7, I think the Bankruptcy Code might just be better off operating like a high-rise elevator that goes directly from floor twelve to floor fourteen. I will lay it out …
Rural Health Care In The Age Of Hospital Bankruptcies, Sonal Rastogi
Rural Health Care In The Age Of Hospital Bankruptcies, Sonal Rastogi
Emory Bankruptcy Developments Journal
In recent years, the United States has witnessed a surge in bankruptcy filings within the healthcare sector. Inflation, rising expenses, shifts in payment models, labor shortages, legislative uncertainty, and mounting pharmaceutical costs have impacted all healthcare organizations, casting a shadow over communities. This is particularly evident in rural America where hospital closures have shrunk access to healthcare services. This Comment delves into the challenges and interests at play when healthcare entities and nonprofit organizations navigate bankruptcy proceedings, paying particular attention to the challenges faced by health care business bankruptcy proceedings.
This Comment argues that the current bankruptcy framework requires adjustments …
Bankrupting The Matrix: Daos And The Code, Ryan Levin
Bankrupting The Matrix: Daos And The Code, Ryan Levin
Emory Bankruptcy Developments Journal
The utilization of the novel Decentralized Autonomous Organization (“DAO”) structure to conduct business activity creates substantial challenges for the Bankruptcy Code (the “Code”). The characteristics of this unregulated, extralegal entity, built entirely on a blockchain and controlled by anonymous members through digital tokens, provides endless opportunities to avoid legal enforcement and exploit the Code. While the Code has provisions to apply to both individuals and organized actors, such as partnerships and corporations, neither DAOs nor their individual token holders fit neatly into these molds. When a DAO, or a DAO token holder, eventually faces bankruptcy, the current state of the …
The Rise Of Uptier Transactions In The Leveraged Loan Market, Joshua Bichovsky
The Rise Of Uptier Transactions In The Leveraged Loan Market, Joshua Bichovsky
Emory Bankruptcy Developments Journal
The use of uptier transactions has exploded in the leveraged loan market, precipitated by economic pressure, flexible debt documentation, and permissive treatment by courts. In an uptier transaction, a borrower typically issues senior debt to a new or pre-existing group of lenders by exchanging outstanding debt for superpriority debt, thereby subordinating an existing class of lenders. The principal result of these transactions is that the borrower may obtain follow-on secured financing without offering the investment to all its lenders, thereby materially decreasing the value of each excluded lender’s investment. Due to the material effects of these transactions to unsuspecting lenders, …

Liquidating Fiduciary Warning: Do Not Follow The Yellow (Corp.) Brick Road, Jeremiah A. Carew Iii
Emory Bankruptcy Developments Journal
Yellow Corporation, the 99-year-old trucking giant, filed for bankruptcy on August 6, 2023. A week before filing, the company abruptly shut down its operations and laid off its entire workforce of thirty thousand employees. Under the Warn Act, employers like Yellow are required to notify their employees 60 days before conducting any mass layoffs or plant closings. Yellow, however, claimed that it did not need to give any advanced notice to its employees because it qualified for an obscure exception to the Warn Act known as the liquidating fiduciary exception.

Morality Vs. Mortality: The Ethics Of Physician-Assisted Death In The United States, Ashley Price
Morality Vs. Mortality: The Ethics Of Physician-Assisted Death In The United States, Ashley Price
Williams Honors College, Honors Research Projects
According to the American Academy of Hospice and Palliative Medicine, physician-assisted death is defined as a physician providing, at the patient’s request, a prescription for a lethal dose of medication that the patient can self-administer by ingestion, with the explicit intention of ending life. This paper will examine the different perspectives on the prevalent issue revolving around the ethics and criminality of physician-assisted death and euthanasia in the medical field – a heavily debated topic since the concept was conceived. It will explore the history and controversy revolving around the practice using ethical, faith-based, and scientific perspectives relating respectively to …
The Consumer’S Choice To Boycott, Agnes Bresee
The Consumer’S Choice To Boycott, Agnes Bresee
Seattle University Law Review
In the wake of employees losing their jobs upon voicing their political opinions concerning Israel, Harvard and Columbia law students’ job offers being rescinded upon expressing support for Palestine, and the names and social media profiles of individuals who support Palestine being collected and listed on Canary Mission, such backlash may leave many Americans wondering what form of resistance to settler-colonialist apartheid is acceptable in the twenty-first century. Recently, the movement to collectively boycott brands like Starbucks, which sued its Worker’s Union for a tweet expressing support for Palestine; Disney, which donated money to Israel; and McDonald’s, where a location …

An Information Flow Model Of Online Mediation: Jeopardizing Privacy And Autonomy In The Shadow Of Innovation, Rachel Ringort, Ayelet Sela
Cardozo Journal of Conflict Resolution
Online mediation has developed significantly over the past decade, and increasingly so following the COVID-19 pandemic. Online mediation platforms are now integrated into both private and public settings, enabling mediation through diverse means-from videoconferencing software to dedicated platforms that use various procedural and technological tools, including artificial intelligencepowered applications. The digital transformation of the mediation process introduces challenges and opportunities for mediators, parties, and mediation platforms, many of which stem from new digital datahandling practices. This article explores how such digital transformation of mediation impacts the parties' rights to self-determination and privacy. Recognizing that these rights derive from the parties' …

Comparing Joint Session And Caucus Outcomes: Factoring In Substantive Discussions And Case Characteristics, Roselle L. Wissler, Art Hinshaw
Cardozo Journal of Conflict Resolution
Many of the traditional components of initial joint sessions occur less frequently today than they did historically and are more likely to take place during initial caucuses than during initial joint sessions. These changes in mediation practice lead to questions about whether initial joint sessions still provide the benefits historically attributed to them and whether initial caucuses now provide not only the benefits specifically ascribed to them but also the benefits typically associated with initial joint sessions. The presentArticle addresses these questions while taking into consideration differences in case and mediator characteristics as well as the extent of discussions in …

Arbitral Reliance On "Precedent", Ariana R. Levinson
Cardozo Journal of Conflict Resolution
We conclude that "precedent" may not be the most appropriate term for arbitrators' reliance on other awards. While the term "precedent" might be used loosely in the sense that any past event is a precedent for any future event, the doctrines of stare decisis, collateral estoppel, and res judicata do not apply in labor arbitration. Only if a contract explicitly states or is interpreted by arbitrators to require past awards between the same parties to bind them into the future until a change is negotiated to the contract will these doctrines be utilized by arbitrators. Much more often, including in …

Artificial Intelligence And Mediation Ethics, Zachary R. Calo
Artificial Intelligence And Mediation Ethics, Zachary R. Calo
Cardozo Journal of Conflict Resolution
Artificial intelligence ("Al") presents many opportunities to improve the efficiency, effectiveness, and accessibility of mediation. More than that, it has potential to transform the nature of how mediation is practiced and what mediation is. While Al might not yet play a significant role in many mediations, there is widespread recognition that the technology is disrupting many established dispute resolution practices. What mediation will look like on the other side is unclear, but it will not be the same.

Technology And Victims' Compensation Systems: The Brumadinho Experience, Diego Faleck
Cardozo Journal of Conflict Resolution
The rupture of the B-I dam of the C6rrego do Feijio Mine, in Brumadinho, Minas Gerais, Brazil, owned by the company VALE S/A, which occurred on January 25, 2019, gave rise, from the point of view of civil liability, to a series of extrajudicial measures of socioeconomic reparation. These measures include the payment of emergency compensation to more than 100,000 people, and the implementation of an individual, optional, and voluntary compensation program for civil and labor claims, for the victims and their families. The compensation program was designed according to the principles and techniques of the evolving field of study …
What Mediation Romantics Can Learn From The Model T (Or Maybe The Chevrolet Trax), Nancy A. Welsh
What Mediation Romantics Can Learn From The Model T (Or Maybe The Chevrolet Trax), Nancy A. Welsh
Cardozo Journal of Conflict Resolution
When mediation was reintroduced to the U.S. in the 1970s, it was infused with a democracy-and-self-determination-enhancing, social justice ethos. As the process has been very successfully institutionalized, however, these ambitions have been scaled backalthough, at least arguably, certain "mediative elements" have actually been adopted (or coopted) by other procedural innovations. Perhaps it is time for those of us frustrated with the evolution of mediation to reconcile ourselves to the reality and value of a "basic" model of mediation designed for the sole purpose of getting parties from dispute to settlement-in much the same way that the basic model of a …

Addressing New York's Scaffolding Issue Through An Arbitration Framework, Jared Man
Cardozo Journal of Conflict Resolution
New York City is one of the most, if not the most, famous cities in the world. Whether it is the melting pot of cultures, the signature attitude of its residents, or the numerous attractions, people flock to New York to either see the city with their own eyes or end up moving here to become part of the city itself. However, one of New York's most notable features is the beautiful architecture it boasts. Every neighborhood comes with its own distinct feeling once you pass through it, which in large part has to do with kinds of buildings that …
