Excluded But Equal, Gali Racabi
Excluded But Equal, Gali Racabi
William & Mary Bill of Rights Journal
Work law is excessively exclusionary. Canonical examples include agriculture workers, independent contractors, and domestic workers. But work law excludes far more workers and employers than those familiar categories. Whole sectors, occupations, business sizes, wage arrangements, geographical areas, and more are excluded from the basic tenets of economic citizenship, including federal, state, and local minimum wage; overtime; and safety and labor protection laws.
Equal protection claims govern the authority of legislatures to determine who is in and who is out of work laws. Excluded workers and included employers now routinely use state and federal constitutional equal protection arguments against exclusionary work …

Life, Liberty, And Freedom From Non-Consensual Pelvic Exams?, Michaela Cotton
William & Mary Bill of Rights Journal
[T]here is a need for the federal government to intervene and finally ban the practice of performing non-consensual pelvic exams, and it can do so under the Due Process Clause of the Fourteenth Amendment, which guarantees the right to refuse involuntary medical treatment. Part I will provide a brief overview of pelvic exams and informed consent; Part II draws on policy considerations for banning this practice and tackles counter-arguments; Part III will discuss the relevant federal law and case precedent; Part IV demonstrates how federal law applies to non-consensual pelvic exams; and, finally, Part V will further explain the need …

In imagining the National People of Color Legal Scholarship Conference, the planning committee brainstormed about the theme of the conference and the scope of panels and opportunities that would capture the breadth and vibrancy of scholarship by faculty of color. An antecedent, however, to that scholarship is the entry, success, and thriving of faculty of color in the academy.

This issue includes articles, conference transcripts, and book reviews that date to 2019. The woeful delay is solely the result of our own editorial failure, and we wish to apologize on behalf of the Journal to our readers and to the many contributing authors who put their trust in us. Rest assured that procedures have been established to prevent reoccurrence of such unacceptable time lags. But do know that we appreciate having fallen far short of professional standards in this instance.

Hukum pertanahan nasional melarang pemindahan hak milik atas tanah kepada Warga Negara Asing (WNA), termasuk melalui perjanjian pinjam nama, sesuai Pasal 21 ayat (1) UUPA.

The gig economy consists of individuals, known as gig workers, who perform on-demand labor through digital platforms, such as apps or websites. This structure provides gig workers flexible employment opportunities and autonomy over their hours. However, employers often incorrectly label gig workers as independent contractors, allowing employers to avoid paying federal and state taxes while also withholding worker protections typically required by federal law. Mislabeling gig workers persists due to the lack of state regulations defining the scope of employment relationships in the emerging gig industry, and the enforcement of arbitration clauses between workers and employers hinders the enactment of …

Natural resources is one of the essential aspects of life and human existence. Indonesia is known as a country with abundant natural resources. Therefore, their management must be conducted transparently to prevent corruption and ensure that natural resources are managed in the most efficient and beneficial way fore the community. If natural resources controlled by the state are not managed based on principles reflecting justice, there is a potential that the benefits will only be enjoyed by a small group of people. The mechanism of granting Special Mining Business Permits (WIUPK) through auction is one way to embody the principles …

The comparative analysis of the structural and characteristic aspects of State-Owned Enterprises (BUMN) in Indonesia and Malaysia highlights differences in their approaches to managing these state-owned companies. In Indonesia, BUMN are regulated by Law No. 19 of 2003, which divides BUMN into Persero and Perum. However, bureaucratic structures with strict hierarchies and political intervention often hinder market efficiency and responsiveness. Meanwhile, Government-Linked Companies (GLCs) in Malaysia, under the supervision of Khazanah Nasional Berhad, demonstrate a more streamlined and flexible structure. They operate with higher autonomy and tight supervision, enabling quicker responses to market changes. In terms of governance, Indonesia applies …

Since its establishment under Law Number 2 of 2009 concerning The Indonesian Export Financing Institution (LPEI), the Indonesian Export Financing Institution has gained additional capital participation nine times between 2010 and 2021 by the passage of government regulations. The rules for extra capital in the legislation on its establishment only take the form of regulations in the event that the capital of the Indonesian Export Financing Institution is decreased by a particular amount, but the additional capital that has been carried out thus far is not meant to replace the capital deficiency. As a result, this research was undertaken to …

The settler communities on the water have faced various problems such as legal certainty for settlements, threats of eviction, difficulty in accessing clean water and acts of discrimination. In this research, there are 2 (two) things to be studied, firstly what is the position of the settler community on the water in terms of the principle of common property resources in marine management and secondly what is …

Privacy Risks And Regulatory Challenges In Smart Grids And Renewable Energy Systems, Mikołaj Rajca
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
Smart grid technologies are central to the global shift towards a more efficient and sustainable energy infrastructure, integrating advanced digital systems with traditional power networks. While these technologies offer significant benefits, including enhanced energy management and the seamless integration of renewable energy sources, they also introduce complex privacy challenges. The extensive data collection and real-time communication capabilities inherent in smart grids raise concerns over consumer privacy, data breaches, and cybersecurity threats. This paper critically examines these privacy risks within the context of evolving regulatory frameworks such as the GDPR, NIS2 Directive, and the forthcoming EU AI Act. The discussion emphasizes …

Attempts To Define The Concept Of ‘Dark Patterns’ In The Doctrine And Activities Of Authorities Of Eu Member States, Damian Kazimierski
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
The aim of the paper is to trace the different ways of defining the concept of ‘dark patterns’ in the doctrine and decisional practice of authorities operating within the territory of the European Union, with particular attention placed on the Polish perspective. The publication addresses the main elements of this notion, and indicates the premises that lack consensus in the academic community and in the decisional practices of the authorities. These include, first of all, the requirement of intentionality of the use of social engineering in order to induce the user of a website or application to take the expected …
