Deconstructing Dog Sniffs At Traffic Stops, Andrea J. Garland Jan 2023

Deconstructing Dog Sniffs At Traffic Stops, Andrea J. Garland

Marquette Law Review

Trial courts often uphold searches of cars at traffic stops when the grounds for the search are that a drug dog established probable cause to think that the vehicle was involved in a drug crime. Traditionally, courts have not considered the sniffs to be searches. The United States Supreme Court has relied on two presumptions to uphold searches based on dog sniffs. These are (1) the dog is trained to only signal the presence of the scent of contraband; and (2) the dog does not physically occupy the vehicle but simply walks around the vehicle.

Right Of Association For Platform Workers In Thailand (A Case Study Of Food Delivery Platform Workers), Kanut Thamromdee Jan 2023

Right Of Association For Platform Workers In Thailand (A Case Study Of Food Delivery Platform Workers), Kanut Thamromdee

Chulalongkorn University Theses and Dissertations (Chula ETD)

Platform work has become the prominent form of employment in the last decade due to its unique features which are seemingly beneficial to workers, whether it is flexibility, autonomy, diverse job opportunities or ease of entry resulting in many people choosing to be platform workers working with platform providers on platforms. During the last decade, platform work has rapidly grown thanks to the advanced technology and innovative business models; however, it seems that Thai labour law focusing on traditional employment has not been adequately developed to catch up the growth of platform work in Thailand. Platform providers have classified platform …

Wto Trade Facilitation Agreement: Doing Enough For Developing Countries?, Soe Ohnmar Aung

Chulalongkorn University Theses and Dissertations (Chula ETD)

The WTO Trade Facilitation Agreement was concluded in 2013. It aims to facilitate theinternational trade through simplifying, harmonizing and standardizing procedures, therebyreducing the trade costs. It has reached a milestone of fourteen years since its adoption. However, there is a question about the effectiveness and efficiency of the WTO TFA for itsmembers and international trade. Based on that, this study will consider two questions: whetherthe structural framework of the WTO Trade Facilitation Agreement is even for developingcountries in terms of implementing obligations, and whether it reduces trade costs fordeveloping countries. In exploring, it applies the doctrinal legal research methodology. Thisstudy argues …

Stakeholderism Silo Busting, Aneil Kovvali Jan 2023

Stakeholderism Silo Busting, Aneil Kovvali

Articles by Maurer Faculty

The fields of antitrust, bankruptcy, corporate, and securities law are undergoing tumultuous debates. On one side in each field is the dominant view that each field should focus exclusively on a specific constituency—antitrust on consumers, bankruptcy on creditors, corporate law on shareholders, and securities regulation on financial investors. On the other side is a growing insurgency that seeks to broaden the focus to a larger set of stakeholders, including workers, the environment, and political communities. But these conversations have largely proceeded in parallel, with each debate unfolding within the framework and literature of a single field. Studying these debates together …

Codifying Antisemitism, Mark Goldfeder Jan 2023

Codifying Antisemitism, Mark Goldfeder

Scholarly Works

Antisemitic harassment and discrimination are unlawful in many contexts, but without a standard definition of what 'antisemitism' includes, that idea is almost meaningless. This has led to an equal protection problem for members of the Jewish community, which is why states across the country have started to pass laws adopting the International Holocaust Remembrance Alliance ("IHRA") Definition of antisemitism for use in clarifying the application of existing legal protections for Jewish people from crime and discrimination. Thus far, the bills that have passed have for the most part been overwhelmingly bipartisan, but there have been minor pockets of pushback in …

Faith And Faithfulness: Vocation As Self, Others, And A Third Thing, Joel A. Nichols Jan 2023

Faith And Faithfulness: Vocation As Self, Others, And A Third Thing, Joel A. Nichols

Touro Law Review

Many of us are prone to thinking in binaries—in “either/or” categories, or in black-and-white thinking. Lawyers seem to be especially skilled at this, as we are trained to identify two things and then try to navigate between them or name their similarities and differences. But staying within that framework can be unhelpful, and even stifling, at times. This Essay explores the intersection of faith and the practice of law, especially the idea of vocation. It offers an approach to get out of the binary by suggesting that looking at a third thing is essential. For vocation, this includes (1) listening …

A Cross-Jurisdictional Analysis Of Penalties For Possession Of Contraband Phones By Inmates And A Proposal To Increase The Federal Penalty, Andrew W. Eichner Jan 2023

A Cross-Jurisdictional Analysis Of Penalties For Possession Of Contraband Phones By Inmates And A Proposal To Increase The Federal Penalty, Andrew W. Eichner

Touro Law Review

The federal penalty for possession of a contraband phone by an inmate is currently a statutory maximum of one year of imprisonment, which is a Class A misdemeanor. This Article surveys 56 jurisdictions from across the United States (the 50 States, the District of Columbia, the Commonwealths of Puerto Rico and the Northern Mariana Islands, American Samoa, Guam, and the U.S. Virgin Islands) and discovers that the federal penalty for this offense is much lower than the national average for comparable offenses, which is an average statutory maximum of five years of imprisonment. To rectify this discrepancy, the Article proposes …

Can A Christian Be A Lawyer Or Can Both God And Jackson Browne Be Right, Randy Lee Jan 2023

Can A Christian Be A Lawyer Or Can Both God And Jackson Browne Be Right, Randy Lee

Touro Law Review

Jesus’s final command at His final meal before His death was to “love one another.” No less than Jackson Browne insisted that the ultimate absurdity in an absurd world is a “lawyer in love.” Thus, Jesus has commanded that even lawyers must love, but Jackson Browne has emphatically stressed that lawyers are incapable of love. Given the apparent conflict for lawyers between these two observations of Jesus and Jackson Browne, one might wonder whether one can be a Christian and a lawyer both. Can both God and Jackson Browne be right? Of course, the government could seemingly make the answer …

Proceed With Caution: Criminal Responsibility For Non-Participating Actors In University Hazing Incidents, Charlie Penrod Jan 2023

Proceed With Caution: Criminal Responsibility For Non-Participating Actors In University Hazing Incidents, Charlie Penrod

Touro Law Review

Hazing in university fraternities has become an epidemic. Most hazing involves new pledges who are coerced to endure physical, emotional, or psychological harm to prove themselves worthy of admission to the group. Sadly, many students suffer severe injuries from hazing, up to and including death. Many states have passed specific laws banning hazing and expanded the universe of persons guilty of hazing to possibly include non-participants who aided the hazing. In 2020, a Florida appellate court broadened this further, potentially holding a fraternity president responsible for hazing for making the mistake of allowing liquor at an off-campus party. The fraternity …

2022 Conference Of Religiously Affiliated Law Schools: Reflections On Faculty Vocation And Support, Lucia A. Silecchia

Touro Law Review

In the United States, numerous law schools identify themselves as “religiously affiliated.” There are many opportunities and challenges that come with such affiliation. What “religiously affiliated” may mean for a law school’s faculty is a particularly critical aspect of this question. I was grateful to have been invited to reflect on what religious affiliation might mean for faculty hiring at the “Past, Present, and Future of Religiously Affiliated Law Schools” conference. What follows are reflections that consider not merely that question—important as it is—but also explore what happens after the hiring decision to make the vocation to teach at a …

An Appeal To Books, Amir H. Ali

Michigan Law Review

This feels a fit, even urgent, moment to celebrate our books and the role they play vis-à-vis the law, the courts, and the truth.

As this issue goes to print, our nation’s highest court faces forceful criticism that some of its most significant decisions have been detached from objective fact. In recent Terms, the Supreme Court’s majority has doubled down on deciding major constitutional questions based on “history and tradition”—that is, the majority’s understanding of what the nation was like centuries ago. Just as quickly as these justices praised the objectivity of their fealty to history, they met widespread rebuke …
