The legal research course is over a century old. As a law school subject, it predates many doctrinal courses, as well as the advent of clinical legal education. It is several decades older than its sister subject, legal writing. In spite of its age and obvious importance, the place of the legal research course in the law school curriculum remains contested. While some law faculties recognize the value of legal research instruction and require a standalone legal research course in the first year, the vast majority combine it with legal writing (often over the objections of legal writing instructors and …

Adjusting The Aperture: The International Law Case For Qualifying Unmanned Vessels As Warships, Malgorzata Materna
Adjusting The Aperture: The International Law Case For Qualifying Unmanned Vessels As Warships, Malgorzata Materna
International Law Studies
A number of stakeholders in the international community have advocated for the establishment of restrictions on the development and acquisition of unmanned vessels capable of contributing to naval warfare. These efforts are often based on the notion that the law did not anticipate the existence and use of unmanned vessels, and therefore the drafters of applicable legal frameworks—including the longstanding international law definition of a “warship”—did not consider them. However, this article evaluates, element by element, how unmanned vessels can, should, and already do meet the requirements for the warship designation under international law, based on a reading compatible with …

Justice House At Niagara University: An Emerging Approach To Teaching Vincentian Social Justice During And After The Covid-19 Pandemic, Kevin A. Hinkley
Journal of Vincentian Social Action
Some commentators have predicted that the disruptive effects of the COVID-19 pandemic will transform the landscape of higher education in the United States. For example, Scott Galloway, Professor of Marketing at NYU Stern School of Business, predicts that most U.S. colleges and universities will either “go out of business or become a shadow of themselves.” Professor Galloway argues that the few elite universities that survive will enter into corporate partnerships with Big Tech companies such as Google, Apple, and Meta. From this perspective, for the overwhelming majority of U.S. colleges and universities there won’t be a “post-pandemic recovery”— at least …
Accepting Educational Responsibility For Social Justice: Homeless Mothers’ And Children’S Need Of Education About Health And Nutrition, Smita Guha
Journal of Vincentian Social Action
The goal is to improve health and nutrition among new mothers and their children who were living in shelters. The mothers received workshops and booklets consisting of information, quick and healthy recipes, and learned how to prepare home-made meals with a low budget. The mothers realized nutritious foods are important for them and their children. They learned how to manage time to make nutritious food at the residence. Children regardless of their background, are our future and we need to pay attention to their needs now so that future problems could be prevented. The significance of this study is immense …

Exploring Sexual Health Education Disparities Among Latina Immigrants In Jackson Heights, N.Y., Maria Camila Lopez, Hira Shafeeq
Exploring Sexual Health Education Disparities Among Latina Immigrants In Jackson Heights, N.Y., Maria Camila Lopez, Hira Shafeeq
Journal of Vincentian Social Action
The purpose of the current study is to explore the factors that influence sexual health decisions of female Latina immigrants with low socioeconomic status in an urban area. We aimed to evaluate the possible preventive steps to lower their risk of contracting STDs. The need for this study was highlighted by research findings that suggest that health disparities among Hispanic immigrants have had a significant impact on their poor quality of life due to lack of proper access to medical care and misdiagnosis due to differences in risk factors and manifestations of the disease. Sexual health is a constant issue …
Mental Health Stigma As A Sociocultural Complex Within Panamanian Culture, Arielle Sanders
Mental Health Stigma As A Sociocultural Complex Within Panamanian Culture, Arielle Sanders
Journal of Vincentian Social Action
The purpose of this study is to examine mental health stigma within the sociocultural context shared by members of the Panamanian population. Mental health stigma is complex because it manifests itself differently according to the cultural context in which it is experienced. Culture informs individual beliefs, behaviors, and attitudes regarding how a person should live within their immediate household and within society. This social conditioning is accomplished through a variety of means, including the passing down of social norms, traditions, and customs. Ultimately, these cultural characteristics encourage socially acceptable behaviors while simultaneously discouraging undesirable behaviors in order to maintain group …

Book Bans, Academic Freedom, And The Academic Law Library: Reflections On An Aall Discussion Den, Olivia Smith Schlinck
Library Staff Online Writings
Discussion Dens are consistently among my favorite programs at the AALL Annual Meeting, and Leslie Street’s Book Bans, Academic Freedom, and the Academic Law Library discussion was truly a highlight of AALL 2023. Street approached this difficult and ever-evolving issue with expertise, passion, and open-mindedness, guiding the group to consider: what can law librarians do to support our colleagues in states facing books bans on diversity, equity, and inclusion (DEI) bases?

Learning From Land Use Reforms: Housing Outcomes And Regulatory Change, Noah Kazis
Learning From Land Use Reforms: Housing Outcomes And Regulatory Change, Noah Kazis
Law & Economics Working Papers
This essay serves as the introduction for an edited, interdisciplinary symposium of articles studying recent land use reforms at the state and local level. These papers provide important descriptive analyses of a range of policy interventions, using quantitative and qualitative methods to provide new empirical insights into zoning reform strategies.
After situating and summarizing the collected articles, the Introduction draws out shared themes. For example, these essays demonstrate the efficacy of recent reforms, not only at facilitating housing production but at doing so in especially difficult contexts (like when producing affordable housing and redeveloping single-family neighborhoods). They point to the …

The Apex Bone Wearing Out In The Light Of Sharia And Science, Omar Gabis
The Apex Bone Wearing Out In The Light Of Sharia And Science, Omar Gabis
An-Najah University Journal for Research - B (Humanities)
This research studies an issue in which Sharia scholars differed in the past, while was not of interest to scholars recently, namely: Does the last part of the human coccyx bone (apex) dissolve? Some hadith mentioned that the apex wears out, which was the reason for the divergence of the opinions of scholars in answer to this question over time. As far as informed, the researcher did not find a schooler who singled out this issue in any scientific research. The difficulty of answering this question may lie in the inability to conduct empirical research on this part, in addition …

The Nebraska Criminal Law Practitioner's Guide To Representing Non-Citizens In State Court Proceedings, 2023 Edition, Kevin Ruser
The Nebraska Criminal Law Practitioner's Guide to Representing Non-Citizens in State Court Proceedings
PREFACE TO THE 2023 EDITION I promised myself, after the long-overdue revisions reflected in the 2021 edition, that I would do my best to update this Guide every year. This is the second installment on that pledge. Although there have been modest changes these past two years, there are still important updates incorporated into this year’s edition. I have also expanded on some of the topics that appeared in the 2021-2022 editions, as my thinking – and caselaw – continue to evolve.
On March 31, 2010, the lives of criminal law practitioners changed dramatically. On that day, the United States …
