100 Years Of International Ip - Reflections On Past, Present And Future, Frederick M. Abbott Jan 2023

100 Years Of International Ip - Reflections On Past, Present And Future, Frederick M. Abbott

Cardozo Arts & Entertainment Law Journal

The article reflects on the past 100 years of international intellectual property (IP) law, highlighting its evolution from regional agreements to global systems like the TRIPS Agreement. It emphasizes that IP rights are shaped by human policies and societal needs, not inherent qualities, making them adaptable. Current challenges include balancing IP protection with public access, addressing cybercrime, and grappling with AI-generated works.

The Next 100 Years Of International Intellectual Property: Integrating Human Rights And Corporate Social Responsibility, Julia Janewa Osei-Tutu Jan 2023

The Next 100 Years Of International Intellectual Property: Integrating Human Rights And Corporate Social Responsibility, Julia Janewa Osei-Tutu

Cardozo Arts & Entertainment Law Journal

The article predicts that international intellectual property (IP) law will increasingly integrate human rights and corporate social responsibility (CSR) into its framework over the next century. This shift reflects a broader trend of balancing IP protection with societal concerns, such as public health, cultural heritage, and human development. The author argues that while the TRIPS Agreement established minimum IP standards, future agreements will prioritize equitable access to knowledge, medicines, and traditional knowledge, aligning IP law with global sustainability and human rights goals.

Three Megatrends In The International Intellectual Property Regime, Peter K. Yu Jan 2023

Three Megatrends In The International Intellectual Property Regime, Peter K. Yu

Cardozo Arts & Entertainment Law Journal

The international intellectual property (IP) regime has undergone significant transformation over the past century, shaped by three key megatrends: the rise of emerging countries, the increasing complexity of the regime, and spatial transformation driven by new technologies. These trends have reshaped the regime's standards, policies, and challenges, with profound implications for global economic and social welfare. The article critiques the regime's historical bias toward developed nations and its overemphasis on trade interests, advocating for a balanced approach that integrates public welfare and human rights considerations. It concludes that the regime's growing complexity necessitates new institutional frameworks and vocabularies to address …

Why And What Federal Nil Rights Legislation Is Needed, Matthew J. Mitten Jan 2023

Why And What Federal Nil Rights Legislation Is Needed, Matthew J. Mitten

Cardozo Arts & Entertainment Law Journal

The article argues that federal Name, Image, and Likeness (NIL) rights legislation is essential to maintain the amateur/educational model of intercollegiate sports, preserve the distinction between college and professional athletics, and ensure competitive balance. It emphasizes the need for national uniformity to prevent conflicting state laws and address antitrust concerns.

Nil Collectives - Title Ix's Latest Challenge, Kassandra Ramsey Jan 2023

Nil Collectives - Title Ix's Latest Challenge, Kassandra Ramsey

Cardozo Arts & Entertainment Law Journal

The article explores the intersection of Name, Image, and Likeness (NIL) Collectives and Title IX, arguing that while NIL Collectives are not directly subject to Title IX, colleges and universities must ensure these organizations comply with Title IX to maintain gender equity. Schools are responsible due to their federal funding and their promotion of these collectives, necessitating guidelines, education, and audits to prevent disparities in opportunities for male and female athletes.

The Supreme Court's Decision In Ncaa V. Board Of Regents: Did The Ncaa Really Misread It So Badly?, John Wolohan

Cardozo Arts & Entertainment Law Journal

Today, college athletes like LSU gymnast Olivia Dunne and Alabama quarterback Bryce Young can earn hundreds of thousands of dollars a year from social media and product endorsements. However; it was only a couple of years ago that the National Collegiate Athletic Association (NCAA) declared University of Central Florida football player Donald De La Haye ineligible to play because he refused to stop monetizing his videos on YouTube, thereby losing his scholarship. The purpose of this paper is to examine the impact the Supreme Court's 1984 decision in NCAA v. Board of Regents has had in the NCAA, going from …

The Nil Revolution: What's Next?, Andrew Zimbalist Jan 2023

The Nil Revolution: What's Next?, Andrew Zimbalist

Cardozo Arts & Entertainment Law Journal

The article examines the transformative impact of the NIL (Name, Image, and Likeness) revolution on college athletics, highlighting its legal, economic, and educational implications. It traces the evolution from historical amateurism to recent legal challenges, such as White v. NCAA and O'Bannon v. NCAA, which have reshaped compensation rules for student-athletes. The NIL revolution has introduced a new market where athletes can earn money, but it also raises concerns about equity, financial sustainability for colleges, and the educational welfare of athletes. The author argues that while the NCAA has struggled to lead reforms effectively, Congressional intervention may be necessary …

Ambushing Nil Restrictions: How Nil "Conflict Language" Policies Conflict With The First Amendment, Sam C. Ehrlich, Neal C. Ternes Jan 2023

Ambushing Nil Restrictions: How Nil "Conflict Language" Policies Conflict With The First Amendment, Sam C. Ehrlich, Neal C. Ternes

Cardozo Arts & Entertainment Law Journal

The article argues that state NIL (Name, Image, and Likeness) laws and institutional policies restricting college athletes from signing sponsorship deals conflicting with school sponsors infringe upon athletes' First Amendment rights. These restrictions, often broad and imprecise, fail to meet constitutional standards, particularly under the Central Hudson test for commercial speech, and risk being struck down as unconstitutional prior restraints.

Visions For The International Decade Of Indigenous Languages 2022-2032, Kristen A. Carpenter, Andrew Cowell, Alexis Palmer

Publications

The United Nations General Assembly recently proclaimed the International Decade of Indigenous Languages ( "IDIL") from 2022-2032 to "to draw attention to the critical loss of indigenous languages and the urgent need to preserve, revitalize and promote indigenous languages and to take urgent steps at the national and international levels." The Decade is an opportunity to expose and address the severe loss of Indigenous Peoples' languages locally, regionally, and globally. It is a chance for the entire world community to gather together and commit to bringing Indigenous languages back from the brink of dormancy or extinction.

In response to the Joint Committee on Taxation’s July 2023 request for comments on application of various Internal Revenue Code sections on digital assets, we propose a consistent set of rules to apply current law to digital assets. We highlight that the underlying economics and characteristics of transactions should be the primary concern for the application of rules and the valuation of digital assets. We believe any digital asset rules should (1) treat classes of digital assets with unique characteristics differently based on their economics, (2) minimize incentives for users to engage in tax-motivated structuring of transactions, and (3) allow …

Implementing War Torts, Rebecca Crootof Jan 2023

Implementing War Torts, Rebecca Crootof

Law Faculty Publications

Under the law of armed conflict, no entity is accountable for lawful acts in war that cause harm, and accountability mechanisms for unlawful acts (like war crimes) rarely create a right to compensation for victims. Accordingly, states now regularly create bespoke institutions, like the proposed International Claims Commission for Ukraine, to resolve mass claims associated with international crises. While helpful for specific and politically popular populations, these one-off institutions have limited jurisdiction and thus limited effect. Creating an international “war torts” regime—which would establish route to compensation for civilians harmed in armed conflict—would better address this accountability gap for all …

The Internet Tax Freedom Act At 25, Walter Hellerstein, Andrew D. Appleby Jan 2023

The Internet Tax Freedom Act At 25, Walter Hellerstein, Andrew D. Appleby

Scholarly Works

In October 1998, Congress enacted the Internet Tax Freedom Act (ITFA), a temporary three-year “moratorium” on the enactment of new state and local “taxes on Internet access” and on “multiple or discriminatory taxes on electronic commerce.” After extending the act temporarily several times, Congress, in 2016, finally and controversially struck the language temporarily extending the act, thereby making it permanent.

With its idiosyncratic legislative history and statutory language, as well as the recent attention it has received in connection with legal challenges to digital services and analogous taxes, we thought it would be appropriate to commemorate ITFA’s 25th birthday by …

Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk Jan 2023

Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk

Scholarly Works

Protection of emergent works is impossible. Without an author, there is no expression of ideas which can be original, and thus no copyrightable work. Indeed, the whole system of copyright law, its conceptual building blocks of idea-expression dichotomy, originality, authorship, and the concept of a protectable work operate in the notation of human creativity. Emergent works fall outside of copyright’s positive ontology, being akin to ideas, facts, or subject-matter predicated by technical considerations, rather than authorial creativity. In other words, they do not exist as things in law and thus cannot as such be owned. Rather, like any idea, they …

The Immigration Implications Of Presidential Pot Pardons, Jason A. Cade Jan 2023

The Immigration Implications Of Presidential Pot Pardons, Jason A. Cade

Scholarly Works

This Essay examines the immigration implications of President Joe Biden’s Proclamation on October 6, 2022, pardoning most federal and D.C. offenders who committed the offense of simple marijuana possession. A late twentieth century interpretive shift by the Board of Immigration Appeals holds that pardons only prevent deportation for certain criminal history categories, which do not include controlled substance offenses, and thus far lower federal courts have deferred to the agency’s approach.Nevertheless, according to the analysis I offer, President Biden’s cannabis pardons should be deemed fully effective to eliminate all immigration penalties. All of the immigrant pardon cases to reach the …

Brokered Abuse, Thomas E. Kadri Jan 2023

Brokered Abuse, Thomas E. Kadri

Scholarly Works

Data brokers are abuse enablers. These companies, which traffic information about people for profit, facilitate interpersonal abuse by making it easier to find and contact people. By thwarting people’s obscurity, brokers expose them to physical, psychological, financial, and reputational harm. To date, there have been four common legal responses to this situation: prohibiting abusive acts, mandating broker transparency, limiting data collection, and restricting data disclosure. Though these measures each have some merit, none is adequate, and several recent privacy laws have even made matters worse. Put simply, the current legal landscape is neither effective nor empathetic.

This Essay explores the …

A Worker-Centered Trade Policy, Desiree Leclercq Jan 2023

A Worker-Centered Trade Policy, Desiree Leclercq

Scholarly Works

What is a “worker-centered” trade policy? The Biden administration claims that it means protecting all workers—foreign and American—from exploitative working conditions in trade sectors. The administration’s vigorous enforcement of international labor rights suggests a significant departure from previous U.S. trade priorities centered on domestic interests. For economic and humanitarian reasons, various policymakers and scholars celebrate these developments. They optimistically assume that the administration’s new trade policy will influence foreign governments and facilities to comply with international labor rights in trade if the costs of noncompliance outweigh the benefits. They also assume that the policy will influence compliance with strong labor …

Building The World We Want In An Era Of Climate Anxiety, Rebecca Bratspies Jan 2023

Building The World We Want In An Era Of Climate Anxiety, Rebecca Bratspies

Chapman Law Review

"It is 'unequivocal' that human activity is driving climate change.2 For clarity, unequivocal means 'leaving no doubt: clear, unambiguous[.]'3 The mean global temperature is already more than 1.1ºC above pre-industrial levels.4 And the trajectory is heading in the wrong direction. Keeping temperature increases below 1.5ºC, the level generally agreed on as essential for preventing the worst climate catastrophes,5 seems increasingly out of reach.6 Moreover, even at current levels of warming, the global climate appears to have gone completely off the rails. Widespread, rapid changes ranging from extreme temperatures,7 violent storms,8 accelerating ice melt,9 and expanding wildfire zones10 have become commonplace."

A Corpus Linguistic Analysis Of “Possessions” In American English, 1760-1776, James C. Phillips Jan 2023

A Corpus Linguistic Analysis Of “Possessions” In American English, 1760-1776, James C. Phillips

Chapman Law Review

"This article will proceed in four parts. Part I introduces the question at issue in the context of the first state constitution to include the term: the Pennsylvania Constitution. It does so, at least in part, because other state constitutions arguably copied the Pennsylvania Constitution, and thus the meaning of that constitution likely sheds light on the state constitutions that followed it. Part I also describes the litigation where the issue of the meaning of possessions comes up. Part II highlights shortcomings of the traditional tools usually employed in constitutional interpretation. Part III explains how the tools of corpus linguistics …

"If law students are the lifeblood of a law school, Professor Nancy Schultz was the beating heart of Chapman’s Fowler School of Law. For twenty-seven years she ran the Competitions Program at Chapman with passion and humility. Her loss is devastating."

Ukraine’S Quest For Justice: Accountability For Atrocities Committed In The Russia-Ukraine War, Tetiana Karpus Jan 2023

Ukraine’S Quest For Justice: Accountability For Atrocities Committed In The Russia-Ukraine War, Tetiana Karpus

Dissertations and Theses

The Russian Federation's full-scale military invasion of Ukraine on February 24, 2022, has been marked by numerous documented atrocities, potentially falling under the categories of war crimes and crimes against humanity. This thesis aims to explore whether these apparent human rights and humanitarian law violations merit international prosecution. It also assesses the suitability and feasibility of various mechanisms, such as establishing national courts, "internationalized" or "hybrid" tribunals, or resorting to the International Criminal Court (ICC), drawing insights from past experiences in transitional and retributive justice.

Philosophical Counselling And Mediation Theory And Practice: Exploring A Pathway To Justice, Nayha Acharya Jan 2023

Philosophical Counselling And Mediation Theory And Practice: Exploring A Pathway To Justice, Nayha Acharya

Articles, Book Chapters, & Popular Press

This paper will demonstrate how philosophical counselling would invaluably contribute to the arena of conflict resolution via mediation and civil justice generally. Mediation is a conflict resolution process that involves a third party who facilitates disputants in arriving at a self-determined resolution. This process is being incorporated into civil justice systems globally, but how mediation should be conducted to achieve truly just outcomes needs immediate and thoughtful attention. At its best, mediation empowers parties to co-create a just and fair resolution to their conflict through a dialogical exploration of their interests, needs, and relevant norms and values. This is dramatically …

Crayons, Contests, & Copyright: Contracting To Use A Child’S Creative Work, Kaelyn Timmins-Reed

Chapman Law Review

"From crayon drawings on a parent’s refrigerator to an award-winning short film by a fourteen-year-old, children and young people under the age of eighteen are constantly creating.2 Society encourages children to create: there are many programs, including Youth Communication and Kids in the Spotlight, discussed in greater detail below, that encourage and empower youth to express themselves by writing or making films in order to heal, grow, and advocate for themselves.3 Though children have no affirmative legal 'right to create,' the United Nation’s Convention on the Rights of the Child states that, subject to certain restrictions, children 'shall have the …

Protecting Personal Dignity: Advocating For A Federal Right Of Publicity Against Pornographic Deepfakes, Tyler Von Denlinger

Chapman Law Review

"For these reasons, a federal right of publicity must be adopted to protect victims from pornographic deepfakes. A federal right of publicity would give victims the legal standing to sue online platforms that host nonconsensual media and a remedy to remove the deepfakes from these websites."

Sustainable Seabed Mining And The Phase 1 Environmental Standards And Guidelines, Keith Macmaster Jan 2023

Sustainable Seabed Mining And The Phase 1 Environmental Standards And Guidelines, Keith Macmaster

Articles, Book Chapters, & Popular Press

The oceans are home to a rich diversity of plant and animal life and a source of food and marine resources that drive economies. Climate change and pollution are changing ocean dynamics and the ability to support life. Seabed mining in areas beyond national jurisdiction will add to the ocean's stressors and could cause severe environmental damage. The International Seabed Authority (“ISA”) is mandated to manage access to and benefits from the seabed, its subsoil and mineral resources in areas beyond national jurisdiction (the “Area”). Although the United Nations Convention on the Law of the Sea sets out the legal …

Flying Towards Extinction: The Role Of The Aviation Industry In Perpetuating International Wildlife Trafficking, Isabelle Dominguez Jan 2023

Flying Towards Extinction: The Role Of The Aviation Industry In Perpetuating International Wildlife Trafficking, Isabelle Dominguez

Journal of Air Law and Commerce

In the past sixty years, the world has developed significant concern for burgeoning environmental issues. Starting in the 1960s, governments, industries, and the public have embraced efforts to set standards for public and private actors in areas of environmental concern. Particularly, increased globalization has led to an increase in the trade of wildlife and its products, including endangered species.

Unregulated wildlife trade implicates various issues, such as conservation concerns, the spread of diseases, and even funding for criminal organizations. While sovereign governments work independently and together to combat wildlife trafficking and its effects, current law leaves significant gaps in the …
