The Global Minimum Tax Agreement: An End To Corporate Tax Havens?, Colleen Essid
SLU Law Journal Online
The June 2021 OECD Global Tax Agreement between countries advocates for a Global Minimum Corporate Tax (GMT) rate of 15%. In this article, Colleen Essid argues that if the negotiating countries manage to overcome roadblocks from countries such as Ireland and the potential hurdle of U.S. congressional approval, the GMT could mean the end of the modern-day tax haven.

Factors Associated With Police Shooting Mortality: A Focus On Race And A Plea For More Comprehensive Data, Justin Nix, John Shjarback
College of Humanities and Social Sciences Departmental Research
Objectives. To quantify nonfatal injurious police shootings of people and examine the factors associated with victim mortality. Methods. We gathered victim-level data on fatal and nonfatal injurious police shootings from four states that have such information publicly available: Florida (2009-14), Colorado (2010-19), Texas (2015-19), and California (2016-19). For each state, we examined bivariate associations between mortality and race/ethnicity, gender, age, weapon, and access to trauma care. We also estimated logistic regression models predicting victim mortality in each state. Results. Forty-five percent of these police shooting victims (N=1,322) did not die. Black-white disparities were more pronounced in nonfatal injurious police shootings …

This case raises the difficult question of how to deal with the stain of racial restrictive covenants that have long been rendered unenforceable and illegal but remain in the property records. Petitioner is seeking to have such an offending covenant physically removed from the public records relating to his real property under authority of former Washington statute RCW 49.60.227 (2018). Since Petitioner has begun this quest, the legislature amended RCW 49.60.227 to provide a more detailed procedure to address the remnants of racism in property records, but this new procedure does not afford Petitioner the remedy that he sought under …

The civil and criminal justice systems are built on an adversarial model, but only in the criminal sphere does the defendant possess a constitutional right to representation at public expense. As a result, while representation is the default in criminal cases, more than three quarters of civil cases involve an unrepresented party. That disconnect flows from the Supreme Court’s decisions in Gideon v. Wainwright and Lassiter v. Department of Social Services. Gideon held that the Constitution guarantees a right to counsel for a defendant facing imprisonment for a criminal offense, regardless of the nature of the crime or the length of …

Ethical Dilemma: Police Access To Private Internet Data An Analysis Of The Ecpa Of 1986, Its Effects On The St. Louis Area, And The Proposed Solutions To Remedy This Outdated Document., Amber Essary
Undergraduate Research Symposium
My research was focused on the ethical dilemma of police access to private internet data and how it pertains to the outdated Electronic Communications Privacy Act (ECPA) of 1986. This work contains a case study of serial killer Maury Travis, an overview of the history of the ECPA, an argument for why police should have access to private data, an ethical analysis of the two solutions to this dilemma, and an argument for what solution I believe to be the best one. My research concluded that the two possible solutions to this dilemma were to revise the ECPA or to …

The U.S. Copyright Office is proposing procedures for a library or archive to preemptively opt out of Copyright Claims Board (CCB) proceedings, as directed by the Copyright Alternative in Small-Claims Enforcement (CASE) Act of 2020. Additionally, the Office is proposing procedures to address a party’s decision to participate in or opt out of a class action arising out of the same transaction or occurrence as a claim before the CCB.
The CASE Act directs the Register to establish regulations allowing a library or archives that does not wish to participate in proceedings before the CCB to preemptively opt out …

Gordon College v. Margaret DeWeese-Boyd
On Petition for Writ of Certiorari to the Supreme Judicial Court of Massachusetts
From the Summary of Argument
This Court should grant certiorari to make clear that the First Amendment guarantees religious colleges and universities the same vital protections that safeguard a religious grade school’s freedom to select the teachers who personify and teach its faith. Despite this Court’s recent admonition that such protections apply to a religious school’s selection of “any ‘employee’ . . . who serves as a messenger or teacher of its faith,” Our Lady of Guadalupe Sch. v. …
