Striking The Right Balance: Following The Doj's Lead For Innovation In Standardized Technology, Kristen Osenga
Striking The Right Balance: Following The Doj's Lead For Innovation In Standardized Technology, Kristen Osenga
Akron Law Review
Today’s technology standards are the result of an extraordinary amount of innovation, collaboration and competition. These concepts are interrelated, and each is enhanced or enabled by intellectual property. Where these three concepts come together in standards development, it is unsurprising that antitrust concerns are also present. Specifically, the interests of contributors, participants, and implementers must be fairly balanced to ensure that the appropriate types and levels of innovation, collaboration, and competition can occur—and that the public will benefit. It is important that antitrust enforcement involving standards development organizations and owners of standards essential patents recognize the careful balance of these …
After The Trolls: Patent Litigation As Ex Post Market-Making, Robert Merges
After The Trolls: Patent Litigation As Ex Post Market-Making, Robert Merges
Akron Law Review
Patent policy has been dominated lately by efforts to reduce rent-seeking patent troll litigation. As recent reforms begin to take effect, it is timely to consider the more constructive aspects of patent litigation. This Article contends that the lag between product development and patent litigation, which pushes the problem of patent valuation into the ex post (after product development) period, serves just such a positive function. Re-search, development, and product roll-out can all take place first. Then, at a later stage, patent litigation sorts out the relative merits and contributions of the various inventors and competitors who contributed to the …
Emotions And Intellectual Property Law, Margaret Chon
Emotions And Intellectual Property Law, Margaret Chon
Akron Law Review
Emotions constitute an integral part of the diverse approaches that we bring to bear upon our most pressing law and policy issues. This article explores the role of emotions in intellectual property, information, and technology law (IP). Like other areas of law, IP commits to, prioritizes, and even honors, reason, logic, and facts—which can result in the sidelining of the affective components of law. Yet our affective responses to legal and other phenomena influence both cognition and reason. Part I of the article provides a general overview of the field of law and emotions, pointing out how this approach to …
Trademarks And The Covid-19 Pandemic: An Empirical Analysis Of Trademark Applications Including The Terms "Covid," "Coronavirus," "Quarantine," "Social Distancing," "Six Feet Apart," And "Shelter In Place", Irene Calboli
Akron Law Review
True to its nature as a (hopefully) once in a lifetime event, the COVID-19 pandemic has led to a tsunami of trademark applications. These include the terms “COVID,” “Coronavirus,” and other medical and pandemic-management related terms. This unprecedented number of applications has been highlighted by several commentators in general terms in the past months. This Article examines these applications in detail. Notably, the Article presents the first and most complete survey of the applications filed between the onset of the pandemic and the end of 2020, which include the following terms: “COVID,” “Coronavirus,” “Quarantine,” “Social Distancing,” “Six Feet Apart,” and …

Testing The Efficacy Of Leadership For Empowerment And Abuse Prevention (Leap), A Healthy Relationship Training Intervention For People With Intellectual Disability, Parthenia Dinora, Seb Prohn, Elizabeth P. Cramer, Molly Dellinger-Wray, Caitlin Mayton, Allison D'Aguiliar
Developmental Disabilities Network Journal
Leadership for Empowerment and Abuse Prevention (LEAP) is an abuse prevention intervention for people with intellectual disability. The purpose of this research was to evaluate the intervention’s efficacy. Findings indicated no significant differences in scenario identification questions depicting acceptable or concerning situations. However, statistically significant improvements were noted in participants’ depth of understanding, including their ability to correctly describe why a scenario was abusive or exploitative and what to do next when confronted with unhealthy situations. Limitations and implications for practice are discussed.
College Students’ Knowledge Of And Openness To Students With Autism Spectrum Disorder, Louis W. Turchetta, Valerie Ryan
College Students’ Knowledge Of And Openness To Students With Autism Spectrum Disorder, Louis W. Turchetta, Valerie Ryan
Developmental Disabilities Network Journal
College students with autism spectrum disorder (ASD) face challenges due to limited understanding of this condition. This study investigates college students' awareness of and openness to peers with ASD using an educational intervention. Data were analyzed via a pre–post survey design with two groups.
Factorial analysis of variance showed no significant differences between groups. However, a Wilcoxon signed-rank test revealed significant differences in the treatment group’s ranks on the openness scale and knowledge scale between pre- and post-intervention surveys. Findings yielded small (openness) and large effect sizes (knowledge) as expected. Brief educational interventions in required courses can thus potentially enhance …

Advance Care Planning Within Individualized Care Plans: A Component Of Emergency Preparedness, Heather L. Church, Christina Marsack-Topolewski, Jacqueline M. Mcginley, Victoria Knoke
Developmental Disabilities Network Journal
Federally-legislated Medicaid requirements for recipients with intellectual and/or developmental disabilities (IDD) to have a person-centered plan (PCP) do not specifically require that advanced care plans (ACP) be a component of the plan. However, coronavirus disease 2019 (COVID-19) has provided a salient reminder of the importance of incorporating ACP within the PCP for people who have IDD. As demonstrated by situations arising from COVID-19, emergencies and crises can dramatically alter access to care for people with IDD. This paper synthesizes results from an environmental scan related to ACP for adults with IDD. Findings suggest that the use of ACP, particularly when …
Student Loan Debt Forgiveness In A Pandemic, Samantha Berger
Student Loan Debt Forgiveness In A Pandemic, Samantha Berger
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
The COVID-19 pandemic has changed the lives of Americans across the country negatively impacting the health and livelihoods of millions. Student loan debt statistics for 2021 show U.S. student loan debt is the second highest consumer debt in the United States--crippling 45 million borrowers who collectively owe nearly $1.7 trillion. As part of the CARES Act, passed in March of 2020 in response to the Covid-19 pandemic, student loans were paused; meaning, no federal student loan payments were owed, no interest accrued, and no student loans in default would be collected.

Rewriting Our Nation's Deadly Traffic Manual, Sara C. Bronin, Gregory H. Shill
Rewriting Our Nation's Deadly Traffic Manual, Sara C. Bronin, Gregory H. Shill
Cornell Law Faculty Publications
Every day, Americans entrust their lives to a road system that is governed by the Manual on Uniform Traffic Control Devices for Streets and Highways (the Manual). On its face, this Federal Highway Administration (FHWA) publication is a straightforward technical document. It contains over eight hundred pages of engineering guidance on everything from traffic-light placement to the font of highway signs. It also establishes acceptable methods for officials to modify speed limits.
While such provisions may sound inconsequential, some of the Manual’s provisions have far-reaching, even deadly, consequences. They prioritize vehicular speed over public safety, mobility over other uses of …
The Eminence Of An Incompetent Forensic Expert Versus The Innocence Of The Defendant, Eza Bella Zakirova
The Eminence Of An Incompetent Forensic Expert Versus The Innocence Of The Defendant, Eza Bella Zakirova
Cardozo International & Comparative Law Review (CICLR) Blog
Globally, nearly all criminal investigations revolve around one key element–forensic evidence. Technology also aids forensic investigations which help experts reach a verdict directed at the real perpetrator—the defendant or someone else. Forensic investigations are highlighted by the media as something supernatural; forensic investigators get to find out what happened at the crime scene before anyone else. As a result, general society tends to assume expert testimony to be 100% accurate. However, general society may not be aware of the fact that under Federal Rule of Evidence 702, a person may qualify to be an expert witness if he has at …

“Nature is my ultimate inspiration . . . I have always been drawn to nature.” Those were the words of Andres Amador, a current San Francisco-based artist known for his large-scale works on sandy beaches. He represents the assemblage of artists who have used nature as creative inspiration. However, the current anthropogenic increase in global temperatures, i.e., “climate change,” threatens the natural systems that inspire artists like Andres. Climate change, in turn, threatens artistic creations, both existing and future ones.

Many television shows that have concluded and/or gone off the air have found second lives via streaming services. “Friends” and “Sex & the City,” which both aired their last episodes in 2004, are available on HBO Max. “Seinfeld,” which concluded in 1998, is available on Netflix, and “The Office (U.S.),” which ended in 2013, is available on Peacock. However, as the public enjoys consuming older content on demand, both companies and talent are wrestling with how to interpret older contracts that did not contemplate, or expressly provide for, distribution of content on digital platforms that did not exist at the …

An Open Governor’S Seat, Open Constitutional Question, And The Need For An Answer, Samuel Steele Mclelland, James R. Baxter
Arkansas Law Notes
Another election cycle always means a renewal of fresh lawsuits and legal questions, and 2022 is no exception. the announcement of Sarah Huckabee Sanders’s run for Governor of Arkansas reignites an interesting aspect of Arkansas’s Constitution: must a candidate for Governor live in the State of Arkansas for seven consecutive years, immediately preceding taking office? A final ruling by the Arkansas Supreme Court will give clarity and stability going forward for the most important elected position in the state.

Divine Intervention, Part Ii: Narratives Of Norm Entrepreneurship In Canadian Religious Freedom Litigation, Kathryn Chan, Howard Kislowicz
Dalhousie Law Journal
Constitutional litigation has become a central arena for debate about human rights. Groups from all points on the political spectrum have turned to legal advocacy, “intervening” in judicial proceedings in an effort to advance their preferred interpretations of particular rights.
Judges and scholars remain divided on whether and how interveners are valuable. This paper evaluates a main rationale for intervention: interveners improve adjudication by enriching courts’ understandings of the issues before them. We use qualitative analysis to examine the extent to which interveners in Canada have succeeded in contributing to judicial pronouncements on the scope and meaning of religious freedom. …

Linguistic Branching Of Semantics In Arabic: A Social Approach, Hanan Ismael Amayreh, Mohammad Ismael Amayreh
Al-Balqa Journal for Research and Studies البلقاء للبحوث والدراسات
Linguist Branching is appropriate for Arabic Language as words branch out mostly from roots, and every root becomes a tree, which is different from others, not because of the tree itself, but because of what society uses. Language branching expresses the controversial relationship between the language and the rules that govern it from one side, and society’s preference of certain terms over others from the other side. This study tries to answer the following questions: does the language impose the used words, or does it offer options for society to choose what suits it? The study reaches a conclusion that …

The The Universe Is On Our Side: Restoring Faith In American Public Life, Bruce Ledewitz
Ledewitz Books
In The Universe Is On Our Side, Bruce Ledewitz argues that there has been a breakdown in American public life that no election can fix - Americans struggle to even converse about politics and the usual explanations for our condition have failed to make things better. Ledewitz posits that America is living with the consequences of the Death of God, which Friedrich Nietzsche presumed would be momentous and irreversible. For a long time, God acted as the story of the meaning of our lives. America's future requires that we begin a new story by each of us asking a question posed …

Approaching The Hiv Epidemic And Covid-19 Pandemic With Incarcerated People, Olivia Nevola
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
The COVID-19 pandemic has brought to light structural inequalities that disproportionately affect marginalized populations, especially those targeted by America’s mass incarceration system. There are several parallels between the responses to public health issues that stem from the COVID-19 pandemic and HIV/AIDS epidemic in mass incarceration facilities. Our system of mass incarceration must be reformed to properly address not only the current pandemics across the nation, but also future impending health crises. This kind of reform involves addressing the social and structural determinants of health both inside and outside of correctional facilities.
