The Prejudicial Impact Of Federal Rule Of Evidence 609 On Black Defendants, Niara Morrison
The Prejudicial Impact Of Federal Rule Of Evidence 609 On Black Defendants, Niara Morrison
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
Federal Rule of Evidence 609, Impeachment by Evidence of a Criminal Conviction, allows the litigating parties to attack a witness’s “character for truthfulness” by evidence of a criminal conviction at trial. The rule allows a witness’s prior felony conviction or any conviction that involved a dishonest act or false statement to be admitted by a trial judge for impeachment purposes. Often defendant-witnesses are the most affected by this rule because it allows jurors to make a propensity inference about the defendant’s (un)truthful character, although it may not actually be representative of their character or probative of the crime at hand. …
The Predictive Influence Of Challenging Behavior On Parent Stress In Young Children With Autism Spectrum Disorder, Paige Weir
LSU Master's Theses
Autism spectrum disorder (ASD) is a neurodevelopmental disorder characterized by deficits in social communication, restricted interest, and repetitive patterns of behavior. Individuals with ASD also exhibit challenging behaviors that affect parent and caregiver stress directly. However, researchers have not yet examined the predictive influence of specific challenging behaviors on parent stress, particularly in young children (i.e., infants and toddlers) with ASD. Therefore, the current study expands existing literature by a) investigating the influence that challenging behaviors of young children with ASD have on parent stress and b) examining the unique contribution that each behavior (i.e., aggressive/disruptive behavior, stereotypy, and self-injurious …
The Real Monopoly Is In The Boardroom, Ramsi Woodcock
The Real Monopoly Is In The Boardroom, Ramsi Woodcock
Law Faculty Popular Media
We have always thought of the problem of monopoly as a problem of size or of markets. We say that Facebook is a monopoly because it is too big, or because it is in the nature of networked markets to reward scale.
But what if the problem of monopoly were really a problem of firm governance?
We don’t hate monopolies in themselves; we hate them for what they do. They charge us higher prices or deliver us lower-quality products. They pay us less or make our jobs harder.
But what a monopolist does is determined not by its size …

The Covid-19 Pandemic, Diversity And Inclusion, And The Practice Of Law, Jacob Burns Center For Ethics In The Practice Of Law
2021 Event Invitations
The COVID-19 pandemic has exposed preexisting weaknesses in many areas of life and the law. In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.
On November 8th, the Burns Center will host the authors of this study and JoAnne Epps, Senior …

Asking The Menstruation Question To Achieve Menstrual Justice, Margaret E. Johnson
Asking The Menstruation Question To Achieve Menstrual Justice, Margaret E. Johnson
All Faculty Scholarship
Menstruation is a situs of discrimination, oppression, harassment, and microaggression. Employers fire workers for bleeding and experiencing period pain. Schools control menstruating students’ access to bathrooms, products, and menstrual education. Prisons control their residents’ free access to menstrual products. There are both “obvious and non-obvious relationships” between menstrual discrimination and discrimination on the basis of race, gender, class, gender identity, and disability. This Essay suggests we ask the “menstruation question” as part of our examination of all forms of intersectional oppressions and to achieve menstrual justice. For example, if we see something racist, we should ask “where is the menstrual …

Problematic Interactions Between AI and Health Privacy Nicholson Price, University of Michigan Law SchoolFollow Abstract The interaction of artificial intelligence (AI) and health privacy is a two-way street. Both directions are problematic. This Essay makes two main points. First, the advent of artificial intelligence weakens the legal protections for health privacy by rendering deidentification less reliable and by inferring health information from unprotected data sources. Second, the legal rules that protect health privacy nonetheless detrimentally impact the development of AI used in the health system by introducing multiple sources of bias: collection and sharing of data by a small set …

Don't Bite The Bait: Phishing Attack For Internet Banking (E-Banking), Ilker Kara
Don't Bite The Bait: Phishing Attack For Internet Banking (E-Banking), Ilker Kara
Journal of Digital Forensics, Security and Law
Phishing attacks are based on obtaining desired information from users quickly and easily with the help of misdirecting, panicking, curiosity, or excitement. Most of the phishing web sites are designed on internet banking(e-banking) and the attackers can acquire financial information of misled users with the tactics and discourses they develop. Despite the increase of prevention techniques against phishing attacks day by day, an effective solution could not be found for this issue due to the human factor. Because of this reason, real phishing attack studies are essential to study and analyze the attackers’ attack techniques and strategies. This study focused …
