Does law matter? Might it make a difference? Affect human behaviour? Assumptively, yes, it is easy to surmise such causation. Indeed, law can guide. Law manages. At times, law can even control and command and direct. But law is such a sprawling category. Not all laws are the same. Some laws are, in an Orwellian sense, more equal than others. Some walk on four legs, which is good, but not every law comes to walk on two legs when it is better. And some laws, well, they may not move anywhere (or anyone) at all.

China's Merger Review: The Review Agency Is In Balance With Major Stakeholders, Huizhen Chen
China's Merger Review: The Review Agency Is In Balance With Major Stakeholders, Huizhen Chen
South Carolina Journal of International Law and Business
China's relatively new merger review system continues trending toward those of the United States and the European Union. However, its merger review will never entirely converge with the Western model from either a competition policy or review methodology perspective. Such divergence from the West, this article claims, is rooted in the decision-making mechanism of China's merger reviews. Traditionally, China's decision-making mechanism has been viewed as a singular review-agency domination like that of the West. In fact, however, China's merger reviews have issued remedies reflecting policies generated by major stakeholders as well as the review agency. These co-decision-makers have balancing relationships …

Criminology research has devoted significant attention to individuals diagnosed either with antisocial personality disorder (ASPD) or psychopathy. While in the past, the two terms were used somewhat interchangeably, researchers today are starting to see that the two terms in fact represent two very different personality types and offending patterns. In this article, we examine this development from a legal perspective, considering what this might mean in terms of punishment for these two personality types based on the different characteristics they display in their actual offenses and their responses to punishment and rehabilitation. Specifically, we will focus on how the use …
New Mexico’S Independent Ethics Commission And The Long Fight To Constrain Public Corruption, Lane Towery
New Mexico’S Independent Ethics Commission And The Long Fight To Constrain Public Corruption, Lane Towery
New Mexico Law Review
After a string of high-profile corruption scandals in state government, and a decade-long legislative fight to find a solution, in 2018 New Mexico voters passed a popular constitutional amendment creating an independent ethics commission. Enabling legislation cleared the legislature during the 2019 session, and the commission began operating on January 1, 2020. The ethics commission hears complaints made against candidates, lobbyists, and public officials in the executive and legislative branches. In addition, it publishes opinions on questions of ethics in state government. The commission, however, risks failing at its mission to reduce unethical behavior because of a lack of power …

Southwestern Acequia Systems And Communities; Nurturing A Culture Of Place, Eric Romero
Natural Resources Journal
El Aqua es La Vida” (Water is Life) is a ubiquitous bumper sticker on trucks, mini vans and tractors in New Mexico, Colorado and the greater southwest. Besides a succinct, pithy statement for natural resource management, the maxim references a land ethic that is particularly evidenced in acequia communities. Put simply, acequias are human-constructed hydrological systems that deliver water to agricultural fields. These community-governed irrigation systems are common in southwestern states– particularly northern New Mexico and southern Colorado. However, the English connotation of ‘irrigation ditch” fails to reflect the different levels of meaning associated with these important water channels. A …
Integrating The Law Of The Rio Chama Through Institutional Ontologies Of The Middle Rio Grande Basin, Colin Mckenzie
Integrating The Law Of The Rio Chama Through Institutional Ontologies Of The Middle Rio Grande Basin, Colin Mckenzie
Natural Resources Journal
The Law of the River is paradigmatically the legal and policy framework for river basin governance in the largely arid Western United Sates. In parsing this notoriously arcane body of law, complexity theory and jurisprudence, or the philosophy of law, are useful tools. This work develops and applies a conceptual model of the Middle Rio Grande basin as a social–ecological system in an attempt to improve understanding, transparency, and a sense of meaning of the so-called Law of the River. This project confronts the legal ecology of the “Great River” and its principle middle valley tributary, northern New Mexico’s Rio …

Bringing Judaism Downtown: A Smart Growth Policy For Orthodox Jews, Michael Lewyn
Scholarly Works
Until the late 20th century, the most rigorously traditional Jews, haredi Jews (often referred to as “ultra-Orthodox”) tended to congregate in New York City. But as New York became more expensive and haredi population grew due to high birth rates, some haredi Jews (known collectively as “haredim”) moved to small towns and outer suburbs in search of cheaper land, sometimes creating towns dominated by haredim such as Kiryas Joel, New York and Lakewood, New Jersey. As haredi populations have continued to grow, their households now seek undeveloped land outside these enclaves. But as haredim move deeper into the countryside, zoning …

Mediation Ethics After The Singapore Convention, Zachary R. Calo
Mediation Ethics After The Singapore Convention, Zachary R. Calo
Scholarly Works
The aim of this essay is to consider the shape of mediation ethics after the Singapore Convention. It assesses the role of ethics with the Convention framework, as well as how the Convention can inform broader conversations about mediation ethics. The international commercial mediation landscape initiated by the Convention commends certain approaches to ethics for its effective and efficient operation. In particular, it is argued that the Convention system is best complemented by codes of ethics that are clear and standardized in their norms as well as modest in the scope of their regulatory ambitions. An ethical system defined by …
Non-Governmental Organisations' Impact On Educational Policy In Rural Ghana, Sarah Ayikai Okine
Non-Governmental Organisations' Impact On Educational Policy In Rural Ghana, Sarah Ayikai Okine
Walden Dissertations and Doctoral Studies
Abstract Non-governmental organizations (NGOs) have become an increasingly important factor in education globally. The social structure in developing countries such as Ghana has created a need for government to work with NGOs in the educational system to reach out to children and provide quality basic, primary education, especially in rural communities. However, there are still challenges in the discharge of their duties due to challenges in collaboration with all stakeholders. This case study addressed the perception of stakeholders regarding NGOs’ influence on Ghana’s educational system to better understand the influence and impact of NGOs on education in Ghana’s rural communities. …
Correctional Officer Opinions About Offenders With Mental Illness: The Relationships Among Opinions, Burnout, Emotional Intelligence, And Mental Health Training, Courtney Hull
Graduate Theses, Dissertations, and Problem Reports (ETD)
Rates of mental illness among incarcerated individuals in the United States are high and have been well documented. Correctional officers are on the front line of identifying symptoms and alerting mental health professionals to problems as they arise. Correctional officers often lack an understating of mental illness, feel ill-equipped to manage mental health crises, and experience high levels of job-related stress. The objective of this study was to better understand the relationship between correctional officers’ emotional intelligence and opinions about mental illness, and to identify if burnout moderated the relationship between the variables. Additionally, the study sought to understand the …

Alternative Dispute Revolutions: Technology And Adr In The Middle East Following The Covid-19 Pandemic, Zachary R. Calo, Barry Solaiman
Scholarly Works
This article seeks to close a gap in the literature on the use of alternative dispute resolution (ADR) in the Middle East. In particular, it examines unprecedented developments in countries situated in the Persian Gulf where a range of innovative institutions outside the domestic court system provide ADR services. Qatar, Saudi Arabia, and the United Arab Emirates host a number of sophisticated international courts as well as specialized dispute resolution centers backed by the English common law and recognised international arbitration and mediation rules. The COVID-19 pandemic has necessitated remote hearings around the world as courts seek to dispense justice …
