A Forensic Enabled Data Provenance Model For Public Cloud, Shariful Haque, Travis Atkison
Journal of Digital Forensics, Security and Law
Cloud computing is a newly emerging technology where storage, computation and services are extensively shared among a large number of users through virtualization and distributed computing. This technology makes the process of detecting the physical location or ownership of a particular piece of data even more complicated. As a result, improvements in data provenance techniques became necessary. Provenance refers to the record describing the origin and other historical information about a piece of data. An advanced data provenance system will give forensic investigators a transparent idea about the data's lineage, and help to resolve disputes over controversial pieces of data …

Islamic marriages allow polygamy on the condition that the husband can do justice. This fair concept is interesting to study because it is not easy to measure fairness in an action. By going through juridical analysis studies and using literature research, the authors examine two main issues, namely the philosophy of polygamy marriage according to Islamic law and how the concept of justice in polygamy is applied according to the philosophy of Islamic law. There are several conditions that must be met for men who will do polygamy. One of the requirements mentioned in the Qur'an is that it can …

The choice of law that can be chosen to obtain and realize a win-win solution in solving civil disputes over land is of course through alternative dispute resolution. By way of negotiation, mediation and conciliation. In the …

The Federal Circuit's Summary Affirmance Habit, Andrew Hoffman
The Federal Circuit's Summary Affirmance Habit, Andrew Hoffman
BYU Law Review
The Federal Circuit is certainly unique among the circuit courts of appeals. Its exclusive jurisdiction over patents places it in a powerful position. But with that power comes a responsibility to oversee the development of the law. And in the last decade, the court has fallen short of fulfilling this obligation—particularly with regard to clarifying provisions of the America Invents Act. The court has repeatedly disregarded important questions of law by use of Rule 36 summary affirmance. Though other courts of appeals regularly use summary disposition as a means of dealing with burgeoning dockets, the Federal Circuit uses summary affirmance …
A Cognitive Theory Of The Third-Party Doctrine And Digital Papers, H. Brian Holland
A Cognitive Theory Of The Third-Party Doctrine And Digital Papers, H. Brian Holland
Faculty Scholarship
For nearly 200 years, an individual’s personal papers enjoyed near-absolute protection from government search and seizure. That is no longer the case. With the widespread adoption of cloud-based information processing and storage services, the third-party doctrine operates to effectively strip our digital papers of meaningful Fourth Amendment protections.
This Article presents a new approach to reconciling current third-party doctrine with the technological realities of modern personal information processing. Our most sensitive data is now processed and stored on cloud computing systems owned and operated by third parties. Although we may consider these services to be private and generally secure, the …
Leave Your Guns At Home: The Constitutionality Of A Prohibition On Carrying Firearms At Political Demonstrations, Luke Morgan
Leave Your Guns At Home: The Constitutionality Of A Prohibition On Carrying Firearms At Political Demonstrations, Luke Morgan
Duke Law Journal
Armed protest has long been a tool of American political groups. Neo-Nazis, socialists, fascists, antifascists, the Black Panthers, neo-Confederates, and others have all taken up arms not necessarily to do violence, but to do politics. But such protests always risk rending a violent hole in our social fabric. If war is politics by other means, armed protests erase the distinction.
This Note argues that the Constitution’s relevant guarantees of individual rights—the First and Second Amendments—do not include a constitutional right to armed protest.
With respect to free speech, it is unlikely that current doctrine would cover armed protests. But, considering …
Fixing Soft Dollars Is Not That Hard: A Consent And Reporting Framework For Regulating Client Commission Arrangements, Brendan Biffany
Fixing Soft Dollars Is Not That Hard: A Consent And Reporting Framework For Regulating Client Commission Arrangements, Brendan Biffany
Duke Law Journal
Under soft dollar arrangements, investment advisers promise portfolio trades to participating brokers in exchange for investment research or other benefits. Recently, some academics, financial regulators, and practitioners have scrutinized such arrangements, arguing that they provide an avenue for advisers to unjustly enrich themselves at the expense of their clients. However, others defend soft dollar arrangements, seeing them as a mechanism for binding advisers to clients and increasing client returns.
A safe harbor currently protects advisers’ use of soft dollars, so long as certain minimum requirements are met. Critics argue that soft dollars should be banned outright, contending that advisers should …

Statutory Interpretation And The Rest Of The Iceberg: Divergences Between The Lower Federal Courts And The Supreme Court, Aaron-Andrew P. Bruhl
Duke Law Journal
This Article examines the methods of statutory interpretation used by the lower federal courts, especially the federal district courts, and compares those methods to the practices of the U.S. Supreme Court. This novel research reveals both similarities across courts and some striking differences. The research shows that some interpretive tools are highly overrepresented in the Supreme Court’s decisions, while other tools are much more prevalent in the lower courts. Differences in prevalence persist even after accounting for the selection effect that stems from the Supreme Court’s discretionary docket. Another finding—based on a study of 40 years of cases from all …

When designers obtain exclusive intellectual property (IP) rights in the functional aspects of their creations, they can wield these rights to increase both the costs to their competitors and the prices that consumers must pay for their goods. IP rights and the costs they entail are justified when they create incentives for designers to invest in new, socially valuable designs. But the law must be wary of allowing rights to be misused. Accordingly, IP law has employed a series of doctrinal and costly screens to channel designs into the appropriate regime—copyright law, design patent law, or utility patent law—depending upon …
Principles And Consequences In A Virtue Ethics Analysis Of Affirmative Action, Caleb H A Brown
Principles And Consequences In A Virtue Ethics Analysis Of Affirmative Action, Caleb H A Brown
Montview Journal of Research & Scholarship
In this paper, I evaluate affirmative action from the framework of virtue ethics. In doing so, I consider the principles behind affirmative action as well as its consequences because a perfectly virtuous person will act per just principles but will also be concerned with the consequences of her actions. An attempt to restore justice that utilizes a mechanism known to be ineffective is not truly an attempt to restore justice, and so is not virtuous. Therefore, if affirmative action is principally justified, a complete virtue ethical analysis will still ask, “Do we know if it works?” I conclude that affirmative …
